The FISA courts allow a 3 day window on getting a warrant. If you think it's important enough to wiretap someone, you can do so, and then apply for a FISA warrant 3 days later. Since its' inception, the FISA courts have received 19,000 requests for wiretaps, and have turned down 5.

As the September 11th Advocates said today, the NSA intercepted two calls about 9/11 in the days beforehand, and STILL weren't able to translate them in time to save those people.
