    January 31, 2003: US Conducts Covert Surveillance Against United Nations Delegates
    Frank Koza, chief of staff in the “Regional Targets” section of the National Security Agency, issues a secret memo to senior NSA officials that orders staff to conduct aggressive, covert surveillance against several United Nations Security Council members. This surveillance, which has the potential to wreak havoc on US relations with its fellow nations, is reportedly ordered by George W. Bush and his national security adviser, Condoleezza Rice. Koza, whose section spies on countries considered strategically important to US interests, is trying to compile information on certain Security Council members in order to help the United States to win an upcoming UN resolution vote on whether to support military action against Iraq (see February 24, 2003. The targeted members are the delegations from Angola, Cameroon, Chile, Mexico, Guinea, and Pakistan, who together make up the so-called “Middle Six.” These six nations are officially “on the fence,” and their votes are being aggressively courted by both the pro-war faction, led by the US and Great Britain, and the anti-war faction, led by France, Russia and China (see Mid-February 2003-March 2003. [Observer, 3/2/2003] Bulgaria is another nation targeted, and that operation will apparently be successful, because within days Bulgaria joined the US in supporting the Iraq war resolution. Oddly, Mexico, another fence-straddler, is not targeted, but tht may be because, in journalist Martin Bright’s words, “the Americans had other means of twisting the arms of the Mexicans.” (Bright is one of the authors of the original news report.) The surveillance program will backfire with at least one country, Chile, who has its own history of being victimized by US “dirty tricks” and CIA-led coups. Chile is almost certain to oppose the US resolution. [Australian Broadcasting Corporation, 3/6/2003] It is also likely, some experts believe, that China is an ultimate target of the spy operation, since the junior translater who will leak the Koza memo in February, Katharine Gun, is fluent in Mandarin Chinese and is unlikely to have seen the memo unless she would have been involved in translating it into that language. [AlterNet, 2/18/2004] Later assessment shows that many experts believe the spying operation scuttled any chance the US had of winning the UN vote, as well as the last-ditch attempt by the UN to find a compromise that would avert a US-British invasion of Iraq. [Observer, 2/15/2004] Chile’s ambassador to Great Britain, Mariano Fernandez, will say after learning of the NSA surveillance, “We cannot understand why the United States was spying on Chile. We were very surprised. Relations have been good with America since the time of George Bush, Sr.” [Observer, 3/9/2003] Mexico’s UN representative, Adolfo Aguilar Zinser, will tell the Observer a year later that he and other UN delegates believed at the time that they were being spied upon by the US during their meetings. “The surprising thing was the very rapid flow of information to the US quarters,” he will recall. “It was very obvious to the countries involved in the discussion on Iraq that we were being observed and that our communications were probably being tapped. The information was being gathered to benefit the United States.” [Observer, 2/15/2004]

    • The memo comes just five days before Colin Powell’s extraordinary presentation to the UN to build a case for war against Iraq (see [complete_timeline_of_the_2003_invasion_of_iraq_442]]), and is evidence of the US’s plans to do everything possible to influence the UN to vote to authorize war with that nation. The memo says the eavesdropping push “will probably peak” after Powell’s speech. [Baltimore Sun, 3/4/2003]
    • The NSA wants information about how these countries’ delegations “will vote on any second resolution on Iraq, but also ‘policies’, ‘negotiating positions’, ‘alliances’ and ‘dependencies’—the whole gamut of information that could give US policymakers an edge in obtaining results favorable to US goals or to head off surprises.” [Observer, 3/2/2003] Bright will tell other reporters on March 9, “It’s quite clear what they were going for was not only the voting patterns and the voting plans and the negotiations with other interested parties such as the French or the Chinese, it wasn’t just the bare bones, it was also the office telephone communications and email communications and also what are described as ‘domestic coms’, which is the home telephones of people working within the UN. This can only mean that they were looking for personal information. That is, information which could be used against those delagates. It’s even clear from the memo that this was an aggressive operation. It wasn’t simply a neutral surveillance operation.” According to Bright’s sources, the orders for the program came “from a level at least as high as Condoleezza Rice, who is the President’s National Security Adviser.” [Australian Broadcasting Corporation, 3/6/2003] Koza advises his fellow NSA officials that the agency is “mounting a surge” aimed at gaining covert information that will help the US in its negotiations. This information will be used for the US’s so-called Quick Response Capability (QRC), “against” the six delegations. In the memo, Koza writes that the staff should also monitor “existing non-UN Security Council Member UN-related and domestic comms [office and home telephones] for anything useful related to Security Council deliberations,” suggesting that not only are the delegates to be monitored in their UN offices, but at their homes as well. Koza’s memo is copied to senior officials at an unnamed foreign intelligence agency (later revealed to be Great Britain). Koza addresses those officials: “We’d appreciate your support in getting the word to your analysts who might have similar more indirect access to valuable information from accesses in your product lines [intelligence sources].…I suspect that you’ll be hearing more along these lines in formal channels.” The surveillance is part of a comprehensive attempt by the US to influence other nations to vote to authorize a war against Iraq; these US attempts include proffers of economic and military aid, and threats that existing aid packages will be withdrawn. A European intelligence source says, The Americans are being very purposeful about this.” [National Security Agency, 1/31/2003; Observer, 3/2/2003; Observer, 2/8/2004]
    • Interestingly, while the European and other regional media have produced intensive coverage of the news of the NSA’s wiretapping of the UN, the American media virtually ignores the story until 2004, when Gun’s court case is scheduled to commence (see February 26, 2004). Bright, in an interview with an Australian news outlet, says on March 6 that “[i]t’s as well not to get too paranoid about these things and too conspiratorial,” he was scheduled for interviews by three major US television news outlets, NBC, Fox News, and CNN, who all “appeared very excited about the story to the extent of sending cars to my house to get me into the studio, and at the last minute, were told by their American desks to drop the story. I think they’ve got some questions to answer too.” [Australian Broadcasting Corporation, 3/6/2003] Most US print media outlets fail to cover the story, either. The New York Times, the self-described newspaper of record for the US, do not cover the story whatsoever. The Times’s deputy foreign editor, Alison Smale, says on March 5, “Well, it’s not that we haven’t been interested, [but] we could get no confirmation or comment” on the memo from US officials. “We would normally expect to do our own intelligence reporting.” The Washington Post publishes a single story about the operation, focusing on the idea that surveillance at the UN is business as usual. The Los Angeles Times fixes on claims by unnamed “former top intelligence officials” believe Koza’s memo is a forgery. (When the memo is proven to be authentic, both the Post and the Los Angeles Times refuse to print anything further on the story.) Author Norman Solomon writes, “In contrast to the courage of the lone woman who leaked the NSA memo—and in contrast to the journalistic vigor of the Observer team that exposed it—the most powerful US news outlets gave the revelation the media equivalent of a yawn. Top officials of the Bush administration, no doubt relieved at the lack of US media concern about the NSA’s illicit spying, must have been very encouraged.” [ZNet, 12/28/2005]
    • The United Nations will launch its own inquiry into the NSA surveillance operation (see March 9, 2003).
    (2:00 pm) January 31, 2003: Bush Tells Blairs US Going to War Regardless of Inspection Results; US Considering Luring Saddam into Shooting at US Aircraft Painted in UN Colors
    US President George Bush and British Prime Minister Tony Blair meet at the White House to discuss Iraq. Blair presses Bush to seek a second UN resolution that would provide specific legal backing for the use of force against Iraq. According to the minutes of the meeting, Bush says that “the diplomatic strategy [has] to be arranged around the military planning” and that the “US would put its full weight behind efforts to get another resolution and would ‘twist arms’ and ‘even threaten.’” But if such efforts fail, Bush is recorded saying, “military action would follow anyway.” Bush also tells Blair that he hopes to commence military action on March 10. Blair does not demur and offers Britain’s total support for the war, saying that he was “solidly with the president and ready to do whatever it took to disarm Saddam.” Notwithstanding, he insists that “a second Security Council resolution would provide an insurance policy against the unexpected, and international cover, including with the Arabs.” According to Bush, the question that needs to be addressed is what should they cite as evidence that Iraq is in breach of his obligations under UN Resolution 1441. The minutes indicate that there is concern that inspections have failed to provide sufficient evidence of a material breach. “The US was thinking of flying U2 reconnaissance aircraft with fighter cover over Iraq, painted in UN colors,” the minutes report. “If Saddam fired on them, he would be in breach.” [Sands, 2005; Channel 4 News (London), 2/2/2006; MSNBC, 2/2/2006; Guardian, 2/3/2006; New York Times, 3/27/2006] The Times of London later notes that this proposal “would have made sense only if the spy plane was ordered to fly at an altitude within range of Iraqi missiles.” In this case, the plane would be far below the 90,000 foot altitude it is capable of operating at. [London Times, 2/2/2006; Channel 4 News (London), 2/2/2006] In addition to the U2 idea, Bush also says it is “also possible that a defector could be brought out who would give a public presentation about Saddam’s WMD, and there was also a small possibility that Saddam would be assassinated.” At one point during the two-hour meeting, Bush also says he thinks “it unlikely that there would be internecine warfare between the different religious and ethnic groups.” [Sands, 2005; New York Times, 3/27/2006] Also present at the meeting are Blair’s foreign policy advisor, Sir David Manning, his aid Matthew Rycoft, and his chief of staff, Jonathan Powell; National Security Advisor Condoleezza Rice and her deputy, Dan Fried; and Bush’s chief of staff, Andrew Card.     (4:12 pm - 4:25 pm) January 31, 2003: Bush and Blair Acknowledge No Direct Link Between Saddam and 9/11
    During a joint press conference with President George Bush and British Prime Minister Blair at the White House, the two leaders are asked by a reporter, “One question for you both. Do you believe that there is a link between Saddam Hussein, a direct link, and the men who attacked on September the 11th?” Bush answers succinctly, “I can’t make that claim.” [US President, 2/3/2003]

    The President presents his fiscal 2004 budget proposal. In it are billions of dollars in taxpayer subsidies to energy companies and several anti-environment provisions including cuts to the Environmental Protection Agency, natural resources spending, renewable energy programs, and clean water programs including a $492 million, or 37 percent, cut from a revolving fund used by states to upgrade sewage and septic systems and storm-water run-off projects.     US Secretary of Defense Donald Rumsfeld and General Richard Myers, chairman of the US Joint Chiefs of Staff, inform the House of Representatives Armed Services Committee that they intend to seek permission from George Bush to use calmative agents (see February 12, 2001-March 30, 2001) against Iraqi civilians, in cave systems or to take prisoners. [NewsMax, 2/6/2003; Independent, 2/16/2003] Rumsfeld calls the 1993 Chemical Weapons Convention (CWC) a “straightjacket” [Baltimore Sun, 3/27/2003; Guardian, 4/8/2003] and insists that “there are times when the use of non-lethal riot agents is perfectly appropriate.” [NewsMax, 2/6/2003; Christian Science Monitor, 2/14/2003; Guardian, 3/12/2003; Guardian, 4/8/2003] Under the provisions of the CWC, military use of chemicals—including non-lethal gases like tear gas—is prohibited.     February 6, 2003: President Bush Summarizes Allegations against Iraq; Accuses Saddam Hussein of Making ‘Iraq into a Prison, a Poison Factory, and a Torture Chamber’
    With Secretary of State Colin Powell at his side, President Bush speaks about Iraq in the Roosevelt Room, repeating many of the allegations that were made in Powell’s speech to the UN the day before (see 10:30 a.m. February 5, 2003). [US President, 2/10/2003]
    • “The regime has never accounted for a vast arsenal of deadly biological and chemical weapons. …. The Iraqi regime has actively and secretly attempted to obtain equipment needed to produce chemical, biological, and nuclear weapons. Firsthand witnesses have informed us that Iraq has at least seven mobile factories for the production of biological agents, equipment mounted on trucks and rails to evade discovery. Using these factories, Iraq could produce within just months hundreds of pounds of biological poisons.… Iraq has never accounted for thousands of bombs and shells capable of delivering chemical weapons. The regime is actively pursuing components for prohibited ballistic missiles. And we have sources that tell us that Saddam Hussein recently authorized Iraqi field commanders to use chemical weapons—the very weapons the dictator tells the world he does not have.” [US President, 2/10/2003]
    • “The Iraqi regime has acquired and tested the means to deliver weapons of mass destruction. All the world has now seen the footage of an Iraqi Mirage aircraft with a fuel tank modified to spray biological agents over wide areas. Iraq has developed spray devices that could be used on unmanned aerial vehicles with ranges far beyond what is permitted by the Security Council. A UAV launched from a vessel off the American coast could reach hundreds of miles inland.” [US President, 2/10/2003]
    • “One of the greatest dangers we face is that weapons of mass destruction might be passed to terrorists, who would not hesitate to use those weapons. Saddam Hussein has longstanding, direct and continuing ties to terrorist networks. Senior members of Iraqi intelligence and al-Qaeda have met at least eight times since the early 1990s. Iraq has sent bomb-making and document forgery experts to work with al-Qaeda. Iraq has also provided al-Qaeda with chemical and biological weapons training.” [US President, 2/10/2003; Newsweek, 11/10/2005]
    • “We also know that Iraq is harboring a terrorist network, headed by a senior al-Qaeda terrorist planner. The network runs a poison and explosive training center in northeast Iraq, and many of its leaders are known to be in Baghdad. The head of this network traveled to Baghdad for medical treatment and stayed for months. Nearly two dozen associates joined him there and have been operating in Baghdad for more than eight months.” [US President, 2/10/2003]

    February 7, 2003: Bush Says It’s Up To Saddam Hussein Whether There Is War or Peace
    When President Bush is asked by a reporter if he believes Iraq can be “disarmed” without the use of force, the president responds that it’s up to Saddam Hussein. He asserts that Saddam Hussein has been playing “a game with the inspectors” for the last 90 days. “But Saddam Hussein is—he’s treated the demands of the world as a joke up to now, and it was his choice to make,” Bush says. “He’s the person who gets to decide war and peace.” [US President, 2/10/2003]

    President Bush telephones Mexican President Vicente Fox to discuss Mexico’s stance on Iraq. Shortly after the phone call, the Mexican government issues a 2-page policy directive backing Bush’s policy on Iraq. It states that its position is that Iraq must disarm immediately and makes no mention of the weapons inspections. “Nothing is more urgent, no time can be lost in achieving this objective,” it says. The last point of the directive notes the importance of Mexico’s relationship with the United States and the need to have a policy based on Mexico’s national interests. “We know that this issue is of critical importance to the United States and to the Bush administration,” the directive also says. [Associated Press, 2/26/2003]

    February 27, 2003: Iraq Destroys its Al Samoud Missiles; US Describes Iraq’s Actions as ‘Deception’
    Iraq agrees to destroy all the equipment associated with its Al Samoud missile program, including warheads, SA-2 missile engines, machinery to produce missile motors, fuel, launchers, testing equipment, components as well as all software and documentation. The UN had earlier concluded that the missile program was in violation of UN resolutions because the range of the missiles exceeds the 150km limit imposed in 1991 after the Gulf War (see February 12, 2003). Responding to news of Iraq’s decision, White House Press Secretary Ari Fleischer dismisses any suggestion that it is an example of Iraqi cooperation. Instead he describes it as “deception.” He says, “This is the deception the president predicted. We do expect that they will destroy at least some of their missiles.” He also says that Iraq’s actions constitute “propaganda, wrapped in a lie, inside a falsehood.” And Donald Rumsfeld offers a similar interpretation of Iraq’s actions. He says: “I don’t see a change in the pattern at all. You know, this is exactly what’s been going to for years…. They refuse to cooperate, don’t cooperate, drag it out, wait until someone finally nails them with one little piece of the whole puzzle and refuse to do anything about it and then finally when they see the pressure building, they say well, maybe we’ll do some of that.” Bush similarly states: “The discussion about these rockets is part of [Saddam’s] campaign of deception. See, he’ll say, ‘I’m not going to destroy the rockets,’ and then he’ll have a change of mind this weekend and destroy the rockets and say, ‘I’ve disarmed.’” And Powell says: “I think it’s just more indication of the reality that we have been trying to convey to the world, that Saddam Hussein is trying to string it out, trying to divert attention, trying to pretend he is cooperating when he is not cooperating, try[ing] to use process as an excuse for not cooperating and not complying with the will of the international community.” [BBC, 1/28/2003; Associated Press, 2/28/2003; Fox News, 2/28/2003; New York Times, 3/1/2003]

    Spring 2003: Aid to Afghanistan Falls Short of Promises
    At the beginning of 2002, the US, Britain, and other countries around the world made large pledges of aid to Afghanistan (see November 2001-January 2002). But with a new war in Iraq taking considerable focus in the West, those pledges appear to be largely unfulfilled. In February 2003, Sen. Joseph Biden (D) says, “I think [the Bush administration has] already given up the ghost in Afghanistan. They’ve basically turned it over to the warlords.” In December 2002, President Bush signed a law authorizing close to $1 billion a year in aid to Afghanistan for the next four years. But one month later, when Bush submitted his actual budget to Congress, it authorized no money for Afghanistan aid whatsoever. Congress soon authorizes $300 million, but Sen. Chuck Hagel (R) notes that this amount “does not come near” the promise made a short time before. Ahmed Wali Karzai, brother of Afghanistan’s president Hamid Karzai, complains to the press, “What was promised to Afghans with the collapse of the Taliban was a new life of hope and change. But what was delivered? Nothing…There have been no significant changes for people.… [I don’t] know what to say to people anymore.” [Salon, 4/10/2003] As of early 2003, there are only about 3,000 Afghan soldiers who have been trained for the country’s new army, and many of those have quit because they had not been paid in more than six months. By contrast, there are roughly 200,000 fighters controlled by warlords. [Salon, 4/10/2003; Observer, 5/25/2003] A study of post-conflict zones done by Care International estimates that Bosnia is receiving international aid of $326 per person, and Kosovo $288 per person, but Afghanistan is receiving only $42 per person. There is one peacekeeper per 113 people in Bosnia, one per 48 people in Kosovo, but one per 5,380 in Afghanistan (and those are not allowed outside the capital of Kabul). [Observer, 5/25/2003] Only 3 percent of all international aid spent in Afghanistan has been for reconstruction, 13 percent is for emergency aid, and the rest is spent on security. One Afghan minister complains, “We don’t even have enough money to pay [government] wages, let alone plan reconstruction.” [Guardian, 9/20/2003] The Independent reports, “Afghans have also listened with astonishment as Americans portray their country’s experience since the overthrow of the Taliban as a ‘success’. Another Western observer summed up his views more acidly. ‘If the Americans think this is success, then outright failure must be pretty horrible to behold.’” [Independent, 2/24/2003]

    March 3, 2003: Bush’s Efforts in Fighting Terrorism Since 9/11 Are Called an ‘Abysmal Failure’
    An article in the New Republic claims that “President Bush has repeatedly stifled efforts to strengthen domestic safeguards against further terrorist attacks. As a consequence, homeland security remains perilously deficient.” The article cites numerous examples to support this contention, and comments: “Bush’s record on homeland security ought to be considered a scandal. Yet, not only is it not a scandal, it’s not even a story, having largely failed to register with the public, the media, or even the political elite.” It points out numerous examples where the administration has opposed the spending of more money to protect against an attack and argues: “The White House appears to grasp that Bush’s standing on national security issues, especially after September 11, is so unassailable that he does not need to shore it up. Instead, the administration seems to view his wartime popularity as a massive bank of political capital from which they can withdraw and spend on other, unrelated causes. In the short run, this strategy is a political boon for Bush and his party. But, in the long run, it divides and weakens the nation against its external threats.” [New Republic, 3/3/2003] Here are some of the examples of evidence supporting this article’s arguments pointed out in this and subsequent articles:

    • Airports are said to be unacceptably vulnerable to terrorism. [Associated Press, 6/8/2004]
    • Terrorist watch lists remain unconsolidated. [United Press International, 4/30/2003]
    • Basic background checks on air security personnel remain undone. [Time, 7/8/2003]
    • The Treasury Department has assigned five times as many agents to investigate Cuban embargo violations as it has to track al-Qaeda’s finances. [Associated Press, 4/30/2004]
    • The White House has spurned a request for 80 more investigators to track and disrupt the global financial networks of US-designated terrorist groups. [New York Times, 4/4/2004]
    • Cases involving “international terrorism” have been fizzling out in US courts. [Los Angeles Times, 12/9/2003]
    • Experts have concluded that the Iraq War has diverted resources from the war on terrorism and made the US less secure. [MSNBC, 7/29/2003; Salon, 7/31/2003]
    • Investigations have shown that most chemical plants across the US remain dangerously vulnerable to a guerilla-style attack. Some plants have virtually no security at all, often not even locked gates. Explosions at some of these plants could kill more than a million people. Yet the Bush administration has so far successfully opposed strengthening security regulations, apparently at the behest of chemical industry lobbyists. [New Republic, 3/3/2003; New Jersey Star-Ledger, 1/28/2005]
    • There has been a huge increase in government spending to train and respond to terrorist attacks, but Time magazine reports that the geographical spread of “funding appears to be almost inversely proportional to risk.” [Time, 3/21/2004]
    • Several high-profile studies have concluded that despite its frequent “bear any burden” rhetoric, the Bush administration has grossly underfunded domestic security. [New Republic, 3/3/2003; New York Times, 7/25/2003]
    • Community-based “first responders” lack basic equipment, including protective clothing and radios. [New Republic, 3/3/2003; New York Times, 7/25/2003]
    • Spending on computer upgrades, airport security, more customs agents, port security, border controls, chemical plant security, bioweapon vaccinations, and much more, is far below needed levels and often below Promised levels. [New Republic, 3/3/2003]
    March 6, 2003: Bush Says Decision Has Not Been Made To Use Force Against Iraq
    During a press conference, Bush is asked if the US will provide journalists, humanitarian workers, and weapons inspectors enough time to leave Iraq before the war begins, if it comes to that. Bush responds that people will be given a chance, but also recommends to journalists, “If you’re going, and we start action, leave.” He also insists that no decision has been made to use military force. “I’ve not made up our mind about military action,” Bush says. “Hopefully, this can be done peacefully.” At the conclusion of the press conference, Bush again says that he has not made any decision to use force. “I want to remind you that it’s his choice to make as to whether or not we go to war. It’s Saddam’s choice. He’s the person that can make the choice of war and peace.” [US President, 3/10/2003]

    During a televised national press conference, President Bush states that the US will call for a vote in the UN Security Council, regardless of the anticipated vote. A reporter asks, “[T]he Security Council faces a vote next week on a resolution implicitly authorizing an attack on Iraq. Will you call for a vote on that resolution, even if you aren’t sure you have the vote?” Bush responds: “No matter what the whip count is, we’re calling for the vote. We want to see people stand up and say what their opinion is about Saddam Hussein and the utility of the United Nations Security Council. And so, you bet. It’s time for people to show their cards, to let the world know where they stand when it comes to Saddam.” But 11 days later, Bush will announce that the US will not call for a vote, saying, “The United Nations Security Council has not lived up to its responsibilities, so we will rise to ours.” The decision is made not to seek a second resolution when it becomes apparent that it would not pass.     March 8, 2003: Bush Says Saddam is Refusing to Disarm; Says US Is Doing Everything Possible To Avoid War
    In a radio address, Bush asserts that “it is clear” from the report given by Chief United Nations Weapons Inspector Hans Blix to the UN Security Council the day before (see March 7, 2003) “that Saddam Hussein is still violating the demands of the United Nations by refusing to disarm.” While Blix described Iraq’s destruction of Al Samoud II missiles (see March 1, 2003) as significant, Bush downplays this, claiming the US has intelligence that Saddam Hussein “ordered the continued production of the very same type of missiles.” Near the conclusion of his radio address, Bush says: “We are doing everything we can to avoid war in Iraq. But if Saddam Hussein does not disarm peacefully, he will be disarmed by force.” [US President, 3/17/2003]

    March 9, 2003: UN Investigates NSA Wiretapping of Security Council Delegates
    The United Nations launches an investigation into the electronic and physical surveillance of a number of its Security Council delegates by the National Security Agency (see January 31, 2003). The NSA operation, revealed the week before, was apparently leaked to Britain’s Observer by Katharine Gun, who works at Britain’s Government Communications Headquarters (GCHQ) and has been arrested on suspicion of breaking Britain’s Official Secrets Act (see February 2003). The NSA also solicited the assistance of an intelligence agency of an unnamed “friendly foreign government”; it is believed to be Great Britain. The leak is touted as “more timely and potentially more important than the Pentagon Papers” by celebrated whistleblower Daniel Ellsberg. The leak of the NSA surveillance program has caused deep embarrassment for the Bush administration, which is working to recruit supporters for a second UN resolution authorizing military force against Iraq (see February 24, 2003). The authorization for the NSA operation is believed to have come from National Security Adviser Rice, but US intelligence experts say that such a decision would have had to involve Defense Secretary Donald Rumsfeld, CIA Director George Tenet, and NSA Director Michael Hayden. President Bush, by necessity, would have been informed of the proposed operation at one of his daily intelligence briefings. While such surveillance of foreign diplomats at the UN is legal under the US’s Foreign Intelligence Surveillance Act (FISA), it violates the Vienna Convention on Diplomatic Relations. According to international law expert Dr. John Quigley, the Vienna Convention stipulates: “The receiving state shall permit and protect free communication on the part of the mission for all official purposes…. The official correspondence of the mission shall be inviolable.” [Observer, 3/9/2003]

    March 17, 2003
    In a televised address to the nation, shortly before the US officially begins its invasion of Iraq, President George W. Bush justifies the need to use military force. He asserts that the US has “pursued patient and honorable efforts to disarm the Iraqi regime without war,” but that Iraq “has uniformly defied Security Council resolutions demanding full disarmament.” He maintains that Iraq “continues to possess and conceal some of the most lethal weapons ever devised” and “has aided, trained, and harbored terrorists, including operatives of al-Qaeda.” “Today, no nation can possibly claim that Iraq has disarmed,” he insists. Bush then gives Saddam Hussein an ultimatum, warning the Iraqi leader that if he and his sons do not leave Iraq within 48 hours, the US will use military force to topple his government. The choice is his, Bush says. “Should Saddam Hussein choose confrontation, the American people can know that every measure has been taken to avoid war, and every measure will be taken to win it.” He assures Iraqis that the US will liberate them and bring them democracy and warns Iraq’s military not to destroy its country’s oil wells or obey orders to deploy weapons of mass destruction.     March 17-18, 2003: FBI Alleges Al-Qaeda Likely to Attack to Help Saddam Hussein
    On March 17, 2003, the National Alert Level is raised to orange. The FBI warns of terror strikes directed by Iraqi leader Saddam Hussein or “allied or sympathetic terrorist organizations, most notably the al-Qaeda network.” This warning clearly attempts to establish a connection between Saddam Hussein and the terrorist activities of al-Qaeda. Interestingly, this third orange alert comes three days before President Bush invades Iraq, opening what he calls the “central front of the War on Terror.” The attack claim is debunked by future CIA director Porter Goss, then the chair of the House intelligence committee. He states that there is no intelligence which suggests a new attack. [Rolling Stone, 9/21/2006 pdf file] The next day, the Arizona National Guard is alerted and sent to an Arizona nuclear plant because “an attack by al-Qaeda agents [is] imminent.” No attack materializes.     March 18, 2003: Bush Sends Letter to Congress Justifying Decision to Invade Iraq
    Bush sends a letter to Congress justifying the invasion of Iraq. First, he has determined that further diplomacy will not protect the US. Second, he is “continuing to take the necessary actions against international terrorists and terrorist organizations, including those nations, organizations, or persons who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001.” [US President, 3/24/2003] This mimics language from a bill passed by Congress in October 2002 (see 1:15 a.m. October 11, 2002), which granted Bush the power to declare war against Iraq if a link with the 9/11 attacks is shown and several other conditions are met. [US Congress, 10/2/2002] But there is no evidence linking Iraq to the 9/11 attacks, a simple fact that even Bush has acknowledged (see (4:12 pm - 4:25 pm) January 31, 2003).

    March 20, 2003: President Bush Signs Executive Order Transferring Frozen Iraqi Funds to Federal Reserve Bank
    President George Bush issues an executive order transferring frozen Iraqi assets held in US banks to a US Treasury Special Purpose Account (TSPA) that has been established at the Federal Reserve Bank of New York. The secretary of the treasury, currently John W. Snow, is given authority over the funds. [US President, 3/20/2003 pdf file]

    March 21, 2003: Ari Fleischer Insists Bush Administration Has Evidence of Iraqi WMD
    White House Press Secretary Ari Fleischer says during his daily press briefing, “Well, there is no question that we have evidence and information that Iraq has weapons of mass destruction, biological and chemical particularly. This was the reason that the president felt so strongly that we needed to take military action to disarm Saddam Hussein, since he would not do it himself.” [White House, 3/21/2003]

    March 26, 2003: Bush Delays Release of Government Documents
    Bush signs an executive order delaying the public release of millions of government documents, citing the need to more thoroughly review them first. The government faced a April 17 deadline for declassifying millions of documents at least 25 years old. [Reuters, 3/26/2003] The order also treats all material sent to American officials from foreign governments, no matter how routine, as subject to classification. It expands the ability of the CIA to shield documents from declassification. And for the first time, it gives the vice president the power to classify information. The New York Times says, “Offering that power to Vice President Dick Cheney, who has shown indifference to the public’s right to know what is going on inside the executive branch, seems a particularly worrying development.” [New York Times, 3/28/2003]

    In a speech to US troops at MacDill Air Force Base in Tampa, Florida, US President George Bush says: “We will help the Iraqi people to find the benefits and assume the duties of self-government. The form of those institutions will arise from Iraq’s own culture and its own choices.” [US President, 3/31/2003]

    April 28, 2003
    US President George Bush, in discussion on the future of Iraq at the Performing Arts Center in Dearborn, Michigan, says: “As freedom takes hold in Iraq, the Iraqi people will choose their own leaders and their own government. America has no intention of imposing our form of government or our culture. Yet, we will ensure that all Iraqis have a voice in the new government.” [US President, 5/5/2003]

    President Bush, donning a custom-made flight suit, is ferried in a Navy S-3B Viking jet to the deck of the USS Abraham Lincoln anchored off the coast of San Diego where he declares the cessation of major combat operations in Iraq. A banner unfurled behind the president reads, “Mission Accomplished.” [CNN, 5/2/2003] US military officials will subsequently say that the event meant that captives being held in Iraq would no longer be treated as prisoners of war under the third article of the Geneva Conventions, but instead as civilians being held by an occupying power under the fourth article of the Geneva Conventions—which allows long term detentions for prisoners deemed a threat to governing authorities.     May 4, 2003: US Immediately Rejects Comprehensive Peace Proposal by Iran’s Top Leadership
    In the wake of the US-led conquest of Iraq, the government of Iran worries that they will be targeted for US invasion next. Sadegh Kharrazi, Iran’s ambassador to France and the nephew of Foreign Minister Kamal Kharrazi, drafts a bold proposal to negotiate with the US on all the outstanding conflicts between them. [American Prospect, 5/21/2006] The proposal was reviewed and approved by Iran’s top leaders Supreme Leader Ayatollah Ali Khamenei, President Mohammad Khatami, and Foreign Minister Kamal Kharrazi. Tim Guldimann, the Swiss ambassador to Iran, is used as an intermediary since the US and Iran do not have formal diplomatic relations. [Washington Post, 2/14/2007]
    • According to the language of the proposal, it offers “decisive action against any terrorists (above all, al-Qaeda) in Iranian territory” and “full cooperation and exchange of all relevant information.” In return, Iran wants “pursuit of anti-Iranian terrorists, above all [the Mujahedeen-e Khalq (MEK)],” a dissident Iranian group which the US officially lists as a terrorist organization.
    • Iran also offers to accept much tighter controls by the International Atomic Energy Agency (IAEA) in exchange for “full access to peaceful nuclear technology.” It proposes “full transparency for security [assurance] that there are no Iranian endeavors to develop or possess WMD” and “full cooperation with IAEA based on Iranian adoption of all relevant instruments (93+2 and all further IAEA protocols).” That is a references to IAEA protocols that would guarantee the IAEA access to any declared or undeclared facility on short notice.
    • The proposal also offers a dramatic change in Iranian policy towards Israel. Iran would accept an Arab league declaration approving a land-for-peace principle and a comprehensive peace with Israel in return for Israel’s withdrawal to 1967 lines, a softening of Iran’s usual policy.
    • The proposal further offers to stop any Iranian support of Palestinian opposition groups such as Hamas and proposes to convert Hezbollah into “a mere political organization within Lebanon.” It further offers “coordination of Iranian influence for activity supporting political stabilization and the establishment of democratic institutions and a nonreligious government” in Iraq.
    • In return, Iran wants a democratic government in Iran, which would mean its Shiite allies would come to power since the Shiites make up a majority of the Iraqi population. The proposal wants the US to remove Iran from its “axis of evil” and list of terrorism sponsors.
    The American Prospect will later comment that “Iran’s historic proposal for a broad diplomatic agreement should have prompted high-level discussions over the details of an American response.” State Department counter-terrorism expert Flynt Leverett will later call it a “respectable effort” to start negotiations with the US. But within days, the US rejects the proposal without even holding an interagency meeting to discuss its possible merits. Guldimann, the Swiss intermediary, is reprimanded for having passed the proposal to the US. [American Prospect, 5/21/2006] Larry Wilkerson, Secretary of State Colin Powell’s chief of staff, will later say that it was a significant proposal for beginning “meaningful talks” between the US and Iran but that it “was a non-starter so long as [Dick] Cheney was Vice President and the principal influence on Bush.” [Newsweek, 2/8/2007] He will also say that the State Department supported the offer, “but as soon as it got to the Vice President’s office, the old mantra of ‘We don’t talk to evil‘… reasserted itself” and Cheney’s office turned the offer down. [BBC, 1/18/2007] Deputy Secretary of State Richard Armitage will later claim that, “We couldn’t determine what was the Iranians’ and what was the Swiss ambassador’s,” and says that he though the Iranians “were trying to put too much on the table.” National Security Adviser Condoleezza Rice will say of the proposal, “perhaps somebody saw something of the like” but “I just don’t remember ever seeing any such thing.” [Newsweek, 2/8/2007] Colin Powell will later say that President Bush simply didn’t want to negotiate with an Iranian government that he believed should not be in power. “My position… was that we ought to find ways to restart talks with Iran… But there was a reluctance on the part of the president to do that.” He also says, “You can’t negotiate when you tell the other side, ‘Give us what a negotiation would produce before the negotiations start.’” [Newsweek, 2/12/2007] Days later, Iran will propose a more limited exchange of al-Qaeda prisoners for MEK prisoners, but the US will reject that too (see Mid-May 2003). In 2007, the BBC will note, “Observers say the Iranian offer as outlined nearly four years ago corresponds pretty closely to what Washington is demanding from Tehran now.” [BBC, 1/18/2007]

    May 9, 2003: Bush Proposes US Free Trade Zone for Middle East
    President Bush, in a commencement address at the University of South Carolina, says: “Soon, Iraqis from every ethnic group will choose members of an interim authority. The people of Iraq are building a free society from the ground up, and they are able to do so because the dictator and his regime are no more…. Across the globe, free markets and trade have helped defeat poverty, and taught men and women the habits of liberty. So I propose the establishment of a US-Middle East free trade area within a decade, to bring the Middle East into an expanding circle of opportunity, to provide hope for the people who live in that region. We will work with our partners to ensure that small and mid-sized businesses have access to capital, and support efforts in the region to develop central laws on property rights and good business practices. By replacing corruption and self-dealing, with free markets and fair laws, the people of the Middle East will grow in prosperity and freedom.” [US President, 5/12/2003]

    Mid-May 2003: US Rejects Al-Qaeda-MEK Prisoner Exchange with Iran
    Around May 4, 2003, Iran attempted to start negotiations in an attempt to resolve all outstanding issues between Iran and the US. The US completely rejected the offer within days. Iran immediately comes back with a more limited proposal, offering to hand over a group of al-Qaeda leaders being held in Iran in return for the US to hand over leaders of the Mujahedeen of Iran (MEK). The US had already officially listed MEK as a terrorist group. [American Prospect, 5/21/2006] Iran is believed to be holding a number of top al-Qaeda leaders, including military commander Saif al-Adel and Osama bin Laden’s son Saad bin Laden (see Spring 2002). The US had captured about 4,000 members of MEK in Iraq the month before, in bases where they had been staging attacks against Iran. Iran pledges to grant amnesty to most of the MEK prisoners, try only 65 leaders, forgo the death penalty on them, and allow the Red Cross to supervise the transfer. [Washington Post, 7/9/2004] Iran proposes to start with an exchange of information, offering to share the list of names of al-Qaeda operatives they are detaining in return for the US to share the list of names of MEK operatives US forces has captured in Iraq. This exchange of names is discussed at a White House meeting. Hardliners in favor of regime change in Iran argue that MEK is different than al-Qaeda. President Bush is said to respond, “But we say there is no such thing as a good terrorist.” [American Prospect, 5/21/2006] And he initially seems in favor of a prisoner exchange, saying about the MEK, “Why not? They’re terrorists.” [Washington Post, 7/9/2004] But Bush does not immediately approve the exchange of names, although he does approve the disarming of MEK who have surrendered to US troops and he allows the State Department to continue secret negotiations on the issue of exchanging names and prisoners in Switzerland. But on May 12, 2003, a bombing in Riyadh, Saudi Arabia kills a number of US citizens (see May 12, 2003). Defense Secretary Rumsfeld, Vice President Cheney, and other neoconservatives argue that the bombing was planned by al-Qaeda leaders being held in Iran. [American Prospect, 5/21/2006] The Washington Post will report in 2007 that, “US intelligence officials said there are suspicions, but no proof, that one of [the al-Qaeda leaders in Iran] may have been involved from afar in planning” the Riyadh bombing. Some of Bush’s top advisers argue in favor of trading the prisoners, suggesting that directly interrogating the al-Qaeda leaders could result in important new intelligence leads. But Cheney and Rumsfeld argue that any deal would legitimize Iran’s government. Bush ultimately offers to accept information about the al-Qaeda leaders without offering anything in return. Not surprisingly, Iran refuses. [Washington Post, 2/10/2007] A planned meeting between US and Iranian officials on May 21 is canceled and negotiations come to a halt. The American Prospect will later comment, “In a masterstroke, Rumsfeld and Cheney had shut down the only diplomatic avenue available for communicating with Iran and convinced Bush that Iran was on the same side as al-Qaeda.” [American Prospect, 5/21/2006] Flynt Leverett, a State Department official dealing with Middle East policy, will later say, “Why we didn’t cut this deal is beyond me.” [Washington Post, 7/9/2004] One anonymous senior US official will later say, “One reason nothing came of it was because we knew that there were parts of the US government who didn’t want to give them the MEK because they had other plans for them… like overthrowing the Iranian government.” [MSNBC, 6/24/205]

    May 20, 2003: Dubious Orange Alert Announced for Memorial Day
    For a second Memorial Day in a row (see May 20-24, 2002), the National Alert Level is raised to orange following warnings that “al-Qaeda has entered an operational period worldwide.” Authorities say that recent attacks abroad have raised concerns about an impending attack on the US. The Department of Homeland Security issued this fourth orange alert due to what it calls “the heightened vulnerability associated with the Memorial Day holiday.” However, Homeland Security Secretary Tom Ridge says there is no “credible, specific information” about targets or method of attack.” He does state that “weapons of mass destruction, including those containing chemical, biological or radiological agents or materials, cannot be discounted.” [CNN, 5/20/2003] But federal law enforcement sources say the credibility of the threat is doubtful. They also say those transmissions are not the reason why the government has raised the threat level to orange. [News 8 Austin, 5/20/2003] Meanwhile, two weeks after President Bush declared “Mission Accomplished” in Iraq (see May 1, 2003), the administration’s plan to implement Iraqi self-rule is postponed “indefinitely” due to looting and lawlessness (see May 20, 2003).     May 20, 2003: Two Weeks After ‘Mission Accomplished,’ Lawlessness Delays Iraqi Self-Rule
    Just over two weeks after President Bush visits the the USS Abraham Lincoln to declare an end to major combat operations in Iraq in the infamous “Mission Accomplished” appearance (see May 1, 2003), the administration’s plan to implement Iraqi self-rule is postponed “indefinitely” due to looting and lawlessness.     May 22, 2003: Bush Grants Legal Immunity to Iraqi Oil Industry
    Bush signs Executive Order 13303, which declares: “Unless licensed or otherwise authorized pursuant to this order, any attachment, judgment, decree, lien, execution, garnishment, or other judicial process is prohibited, and shall be deemed null and void, with respect to the following: the Development Fund for Iraq, and all Iraqi petroleum and petroleum products, and interests therein, and proceeds, obligations, or any financial instruments of any nature whatsoever arising from or related to the sale or marketing thereof, and interests therein, in which any foreign country or a national thereof has any interest, that are in the United States, that hereafter come within the United States, or that are or hereafter come within the possession or control of United States persons.” Watchdog groups interpret this as a way of granting a sweeping legal immunity from lawsuits and criminal charges to US oil firms that do business with Iraqi oil.     2:28 p.m. May 29, 2003: Bush Claims US Found Mobile Biological Weapons Labs in Iraq
    In an interview with Polish TV station TVP, President Bush says: “We found the weapons of mass destruction. We found biological laboratories (see April 19, 2003; May 9, 2003). You remember when Colin Powell stood up in front of the world, and he said, Iraq has got laboratories, mobile labs to build biological weapons. They’re illegal. They’re against the United Nations resolutions, and we’ve so far discovered two. And we’ll find more weapons as time goes on. But for those who say we haven’t found the banned manufacturing devices or banned weapons, they’re wrong, we found them.” [Washington Post, 5/31/2003; US President, 6/6/2003; New York Times, 6/26/2003]

    June 1, 2003: Bush Again Says US Found Mobile Biological Weapons Lab in Iraq
    In St. Petersburg, Russia, Bush says, in response to a US reporter’s question, “Yes, we found a biological laboratory in Iraq (see April 19, 2003) (see May 9, 2003) which the UN prohibited.” [Rosbalt News Agency, 1/6/2003]

    President Bush sends Congress the Biennial Report on the Administration of the Coastal Zone Management Act, [US President, 6/16/2003] which proposes new rules that would undermine coastal states’ control over their coastlines by reducing public and state government participation in decisions affecting the coast and its resources. The changes would pave the way for new offshore oil and gas development. [Environmental Defense Center, 8/21/2003]

    June 23, 2003: President Bush Designates Third Enemy Combatant
    President Bush designates Ali Saleh Kahlah al-Marri as an “enemy combatant.” Al-Marri arrived in the US one day before 9/11 (see September 10, 2001) and has been in US custody since December 2001 (see December 15, 2001). He is the third declared an enemy combatant, after Yaser Esam Hamdi and Jose Padilla. They both are US citizens while he is a legal US resident. The presidential order says he “engaged in conduct that constituted hostile and war-like acts, including conduct in preparation for acts of international terrorism.” The order adds that Al-Marri “represents a continuing, present, and grave danger to the national security of the United States.” His detention is necessary, the order claims, to prevent him from participating in terrorist activities against the US. Al-Marri is subsequently detained in solitary confinement at the Naval Brig in Charleston. The immediate result of the presidential order is that the Pentagon becomes Al-Marri’s new custodian and that Al-Marri will not be entitled to legal representation or access to a US court. The order in effect precludes a pretrial hearing scheduled for July 2 and the start of a formal trial on July 22. His lawyer Mark Berman filed a motion to suppress evidence seized at Al-Marri’s apartment during an FBI search, which he says was conducted without a warrant. In addition, he claims his client was not properly advised of his rights before his initial interrogation. Officially, Al-Marri was indicted on seven counts, including making false statements to the FBI and identity and credit card fraud. He supposedly lied about contacts between September and November 2001 with an al-Qaeda paymaster in the United Arab Emirates, Mustafa Ahmed al-Hawsawi. The Justice Department also alleges that Al-Marri is an al-Qaeda sleeper operative tasked with assisting other members in carrying out future terrorist attacks. These officials say this information was provided by another detainee, believed to be a member of al-Qaeda, who also claims Al-Marri is trained in the use of poisons. Other detainees have told interrogators that Al-Marri met with Osama bin Laden at the Al-Farouq training camp in Afghanistan, where he offered to become a martyr. An additional reason for Al-Marri’s designation of enemy combatant appears to be the possibility of drawing more information from him. Attorney General Ashcroft states: “An individual with that kind of situation is an individual who might know a lot about what could happen, might know the names of individuals, information being so key to intelligence and prevention.” [CNN, 6/24/2003]

    June 26, 2003
    In honor of United Nations International Day in Support of Victims of Torture, President Bush releases a statement saying that the US is “committed to the world-wide elimination of torture and [is] leading this fight by example.” Bush calls on all nations to join the US in “prohibiting, investigating, and prosecuting all acts of torture and in undertaking to prevent cruel and unusual punishment.” In his speech he also condemns countries who have refused to admit international human rights monitors into their facilities. “Notorious human rights abusers, including, among others, Burma, Cuba, North Korea, Iran, and Zimbabwe, have long sought to shield their abuses from the eyes of the world by staging elaborate deceptions and denying access to international human rights monitors.” [US President, 6/30/2003; Human Rights Watch, 5/7/2004]

    July 2, 2003
    Interior Secretary Gale Norton presents President George Bush with a report detailing the achievements of the National Park Service. The report calls attention to the $2.9 billion that the Bush administration says it has set aside for the park’s maintenance backlog. [National Park Service, 7/2/2003] But the figure is misleading because it actually refers the park’s entire maintenance budget. Only $370 million of that amount represents funds allocated to the maintenance backlog. Moreover, as the National Parks Conservation Association notes, “the president’s budget is [actually] contributing to the backlog by ignoring the annual needs of the national parks, which continue to operate with only two-thirds of the needed funding.” [Salt Lake Tribune, 7/9/2003; CNN, 8/15/2003; Salt Lake Tribune, 8/16/2003] According to the General Accounting Office, the Park Service needs upwards of $6.8 billion to complete the deferred maintenance and repairs. Critics of the administration’s record also note that the administration’s lax enforcement of clean air policies and its plan to replace some parks’ staff with private contractors are serious threats to the national park system.     July 2, 2003: Bush Sends Message to Enemy Fighters in Iraq: ‘Bring ‘em On!’
    President Bush, responding to the news of the continuous and mounting stream of attacks on coalition troops, says: “There are some who feel that, you know, the conditions are such that they can attack us there. My answer is, bring ‘em on. We have the force necessary to deal with the situation.” In reference to the administration’s state goal of peace in the Middle East, Bush says: “I mean, there are people there who still hate. They hate Israel. They hate the idea of peace. They can’t stand the thought of a peaceful state existing side-by-side with Israel. And they may be willing to attack. And what we must continue to do is to reject that kind of thought.” A delegation of senators visiting Iraq mirrors the president’s message. “This coalition of armed forces is never, ever going to give in, irrespective of what is thrown at it,” says Republican Sen.     July 11, 2003: CIA Officially Retracts Uranium-From-Africa Claim
    Referring to Bush’s 2003 State of the Union address, CIA director George Tenet says in a written statement, “These 16 words should never have been included in the text written for the president.” But Tenet denies that the White House is responsible for the mistake, putting the blame squarely on his own agency. Condoleezza Rice also blames the CIA, “If the CIA, the director of central intelligence, had said, ‘Take this out of the speech,’ it could have been gone, without question. If there were doubts about the underlying intelligence, those doubts were not communicated to the president, to the vice president or to me.” Another senior White House official, defending the president and his advisors, tells ABC news: “We were very careful with what the president said. We vetted the information at the highest levels.” But an intelligence official, also interviewed by ABC, dismisses this version of events.     It is reported that 161 US troops have been killed in action in Iraq since the start of the war. The guerrilla attacks on US forces have averaged 12 a day. Forty-seven US soldiers have died from hostile fire since President Bush declared an end to major combat on May 1, 2003 (see May 1, 2003). Fourteen soldiers have been killed in the last eight days.     July 28, 2003: Bush Opposes Release of Full 9/11 Congressional Inquiry Report
    In the wake of the release of the 9/11 Congressional Inquiry’s final report, pressure builds to release most of the still-censored sections of the report, but on this day President Bush says he is against the idea. [Associated Press, 7/29/2003; New York Times, 7/29/2003] Through an obscure rule, the Senate could force the release of the material with a majority vote [USA Today, 5/29/2003] , but apparently the number of votes in favor of this idea falls just short. MSNBC reports that “the decision to keep the passage secret… created widespread suspicion among lawmakers that the administration was trying to shield itself and its Saudi allies from embarrassment.… Three of the four leaders of the joint congressional investigation into the attacks have said they believed that much of the material on foreign financing was safe to publish but that the administration insisted on keeping it secret.” [MSNBC, 7/28/2003] Senator Richard Shelby (R), one of the main authors of the report, states that “90, 95 percent of it would not compromise, in my judgment, anything in national security.” Bush ignores a reporter’s question on Shelby’s assessment. [Associated Press, 7/29/2003] Even the Saudi government claims to be in favor of releasing the censored material so it can better respond to criticism. [MSNBC, 7/28/2003] All the censored material remains censored; however, some details of the most controversial censored sections are leaked to the media.

    July 29, 2003: David Kay Tells Top US Officials That Iraq Survey Group Has Yet to Find Evidence of WMD; Bush Unfazed
    In a briefing to the president and other top officials, Kay says that he has found no evidence of weapons of mass destruction, and says the disputed trailers (see April 19, 2003 and May 9, 2003) were probably not mobile biological factories, as the CIA and White House had claimed (see May 28, 2003 and 2:28 p.m. May 29, 2003). Present at the briefing are Dick Cheney, Donald Rumsfeld, Paul Wolfowitz, George Tenet, Condoleezza Rice, Andrew Card, and other White House aides. Kay’s briefing provokes little response from his audience. Describing the president’s reaction, Kay later says: “I’m not sure I’ve spoken to anyone at that level who seemed less inquisitive. He was interested but not pressing any questions. .. I cannot stress too much that the president was the one in the room who was the least unhappy and the least disappointed about the lack of WMDs. I came out of the Oval Office uncertain as to how to read the president. Here was an individual who was oblivious to the problems created by the failure to find WMDs. Or was this an individual who was completely at peace with himself on the decision to go to war, who didn’t question that, and who was totally focused on the here and now of what was to come?” [Isikoff and Corn, 2006, pp. 310]

    During a press conference, Bush is asked if the White House is planning to provide the public with “definitive evidence that Saddam was working with al-Qaeda terrorists” or if the alleged al-Qaeda links had been “exaggerated to justify war.” Bush responds that the US needs more time to analyze documents uncovered in Iraq. Bush explains: “Yes, I think, first of all, remember I just said we’ve been there for 90 days since the cessation of major military operations. Now, I know in our world where news comes and goes and there’s this kind of instant-instant news and you must have done this, you must do that yesterday, that there’s a level of frustration by some in the media. I’m not suggesting you’re frustrated. You don’t look frustrated to me at all. But it’s going to take time for us to gather the evidence and analyze the mounds of evidence, literally, the miles of documents that we have uncovered.” [US Newswire, 7/30/2003; US President, 8/4/2003]

    (Early August 2003): Bush Appoints Friend to Help with Privatization of Iraqi State-Owned Businesses
    President Bush appoints Thomas Foley to the new position of director of private-sector development for the interim US authority in Iraq. Foley, a corporate turnaround expert and multi-millionaire investor, attended Harvard Business School with President Bush and served as the Connecticut finance chairman for Bush’s 2000 campaign. Foley’s task will be to help open Iraq up to foreign investment and to privatize more than 200 state-owned industries, including mining, chemical, cement, and tobacco companies. Excluded from the privatization plan will be Iraq’s oil, utility, and insurance industries. [Financial Times, 8/8/2003; Washington Post, 10/2/2003] The targeted industries currently employ close to 500,000 workers, or three to four percent of the country’s total workforce. Many Iraqis are unhappy with the plan. They say only an elected Iraqi government should make such decisions. According to Fareed Yasseen, adviser to Governing Council member Adnan Pachachi, the assets will probably be sold off to foreign firms and Iraqi merchants who grew wealthy off their connections to Saddam Hussein’s regime, since they are the only ones who will be able to afford to make the purchases. He warns, “If you have a situation where state assets are sold to foreigners or result in large layoffs, this will lead to popular unrest.” [USA Today, 8/9/2007]

    President George Bush names Utah Governor Mike Leavitt as administrator of the Environmental Protection Agency, replacing Christie Todd Whitman who resigned in June. [US President, 8/18/2003] Leavitt was at the center of a controversy a couple of months ago for a back-room deal he made with Interior Secretary Gale Norton to suspend wilderness studies on millions of acres of Utah lands (see April 11, 2003). He supports replacing mandatory pollution controls with voluntary compliance programs for polluting industries and is a strong backer of the administration’s policy of shifting environmental regulation to the states. [Washington Times, 8/12/2003] During his term as governor, US Magnesium, a magnesium-processing company on the western side of the Great Salt Lake, earned the place as the nation’s worst polluter. Leavitt says that he and Bush “have a like mind and a like heart” on environmental policy. [Salt Lake Tribune, 8/12/2003] Environmentalists condemn the nomination noting that aside from Leavitt’s strong opposition to a plan to store nuclear waste on a Utah Indian reservation, the governor has a very poor environmental record. “Mike Leavitt has no credentials, no understanding and no political willpower to protect America’s clean air, clean water and clean land,” Marc Clemens, chapter coordinator for the Utah Sierra Club, tells the Salt Lake Tribune.     After heavy criticism from military families and Democratic presidential candidates, President Bush backpedals from his decision to support a plan that would have reduced the pay of the nearly 160,000 US troops in Iraq and Afghanistan. The plan proposed to eliminate the $75 per month “imminent danger pay” and the $150 per month “family separation allowance.” [Democracy Now!, 8/18/2003]

    September 12, 2003: Bush Administration Is Sued for Supposedly Having Foreknowledge of 9/11 Attacks
    9/11 victim’s relative Ellen Mariani sues the US government, claiming that certain officials had foreknowledge of the 9/11 attacks. “I’m 100 percent sure that they knew,” she says. In doing so, she is ineligible for government compensation from what she calls the “shut-up and go-away fund.” She believes she would have received around $500,000. According to a statement by her lawyer, her lawsuit against President Bush, Vice President Cheney, the CIA, Defense Department, and other administration members “is based upon prior knowledge of 9/11; knowingly failing to act, prevent or warn of 9/11; and the ongoing obstruction of justice by covering up the truth of 9/11; all in violation of the laws of the United States.” As the Toronto Star points out, this interesting story has been “buried” by the mainstream media, at least initially. Coverage has been limited mostly to Philadelphia where the case was filed and New Hampshire where Mariani lives.     September 14, 2003-September 17, 2003: Cheney Links Iraq to 9/11; Bush, Rumsfeld, and Rice All Disavow Cheney’s Claim
    Vice President Cheney says on NBC’s Meet the Press, “I think it’s not surprising that people make [the] connection” between Iraq and 9/11. He adds, “If we’re successful in Iraq… then we will have struck a major blow right at the heart of The Base, if you will, the geographic base of the terrorists who had us under assault now for many years, but most especially on 9/11.” However, two days later, Defense Secretary Rumsfeld states that he hasn’t “seen any indication that would lead” him to believe there was an Iraq-9/11 link. [Associated Press, 9/16/2003] National Security Adviser Rice says the administration has never accused Hussein of directing the 9/11 attacks. [Reuters, 9/16/2003] The next day, Bush also disavows the Cheney statement, stating, “We’ve had no evidence that Saddam Hussein was involved with September the 11th… [but] there’s no question that Saddam Hussein has al-Qaeda ties.” [CBS News, 9/17/2003; Washington Post, 9/18/2003]

    October 18, 2003: President Bush Says US Does Not Use Torture
    President Bush is asked in an Australian television interview, whether two Australians held prisoner at Guantanamo Bay are being tortured. He replies: “No, of course. We don’t torture people in America. And people who make that claim just don’t know anything about our country.” However, as Amnesty International points out, “On that same day, it was revealed that eight US soldiers had been charged with acts of brutality against prisoners of war in Iraq. One of the prisoners had died.” [Amnesty International, 10/20/2003]

    October 31, 2003
    The Environmental Protection Agency and Department of Agriculture announce a decision to approve the unrestricted sale of the pesticide atrazine. Manufacturers of the chemical will be responsible for monitoring atrazine residue levels in only a small percentage of the watersheds vulnerable to atrazine contamination and ensuring that they do not exceed the Clean Water Act’s total maximum daily load (TMDL). Other vulnerable waterways will not be monitored by the manufacturers or the EPA. For example, Syngenta—the major manufacturer of the chemical—agreed in private meetings with the EPA that it would monitor atrazine pollution in 20 of 1,172 watersheds labeled as high risk beginning in 2004. The number would double the following year. Atrazine has been linked to cancer and is potentially harmful to endangered fish, reptiles, amphibians, mussels, and aquatic plant life.     November 2003: New FEMA Official Has Strong Political Ties; Little Disaster Experience
    President George W. Bush appoints Scott R. Morris as FEMA’s deputy chief of staff. In this role, Morris will manage FEMA’s day-to-day operations, and assist in the implementation of FEMA Director Michael Brown’s priorities and policies. Prior to his appointment, Morris served as the deputy chief of staff and White House liaison for the US Small Business Administration. Before coming to Washington, he was the marketing director for the world’s leading provider of e-business applications software in California, and worked for Maverick Media in Austin, Texas as a media strategist for the George W. Bush for President primary campaign and the Bush-Cheney 2000 campaign. He has also served as the director of political communications for a private communications firm, managed grassroots activities and media strategies for the Dole for President campaign, and assisted the executive director of the Republican National Committee.     Early November 2003: Bush Administration Devises Alternative Plan to Implement Market Reforms in Iraq
    Paul Bremer meets with President Bush in Washington for a private meeting. The Coalition Provision Authority’s effort to implement a number of structural changes to Iraq’s economy is failing, and Washington needs to rethink its strategy. Members of the US-backed Iraqi interim government oppose the changes, and corporate attorneys are advising their clients that Bremer’s orders opening up Iraq to foreign investment could be challenged by a future Iraqi government on the basis that the orders violated UN Resolution 1483 (see May 22, 2003). That resolution stated that the US and Britain were bound to the Hague Regulations of 1907, which bars occupying powers from changing the laws of the occupied country (see October 18, 1907). If corporations purchase Iraqi state assets, and a future elected government declares Bremer’s orders illegal, the companies could lose their investments, the lawyers warn. The risk is so great that not a single insurance company is willing to insure its corporate clients for the “political risk” of losing their investment to expropriation. Bremer returns to Iraq from Washington with a Plan B. On June 30, the Coalition Provisional Authority will be dissolved and the sovereignty of Iraq will be turned over to a US-backed transitional government. That government will be bound by an “interim constitution” (see March 8, 2004), which will contain a clause barring the transitional government from modifying any of Bremer’s laws.     President Bush says in a speech that Syria has left “a legacy of torture, oppression, misery and ruin.” [Washington Post, 11/20/2003]

    November 12, 2003: 9/11 Commission and White House Agree to Terms of Access
    Senators of both parties have been accusing the White House of stonewalling the 9/11 Commission by blocking its demands for documents despite threats of a subpoena. [Associated Press, 10/27/2003] On this day, the White House and the 9/11 Commission strike a deal. The main issue is access to the presidential daily briefings given to President Bush. Under the deal, only some of the ten commissioners will be allowed to examine classified intelligence documents, and their notes will be subject to White House review. Some 9/11 victims’ relatives complain that the agreement gives the White House too much power. The Family Steering Committee complains, “All ten commissioners should have full, unfettered, and unrestricted access to all evidence.” It urges the public release of “the full, official, and final written agreement.” [Associated Press, 11/13/2003] Commissioner Max Cleland is unsatisfied with the deal and resigns a short time later (see December 9, 2003).

    November 14, 2003
    After 71 days of negotiations, Congressional Republicans announce that they have agreed on an energy bill that would provide some $20 billion in tax breaks for power companies. [New York Times, 11/15/2003; Christian Science Monitor, 11/19/2003] President Bush voices his support for the bill—drafted mostly by Republicans—which he says will make the US “safer and stronger” by helping to “keep the lights on, the furnaces lit, and the factories running.” He also states, “By making America less reliant on foreign sources of energy, we also will make our nation more secure.” [New York Times, 11/15/2003; US President, 11/24/2003] To facilitate the bill’s passage through Congress, “negotiators sprinkled in dozens of sweeteners sought by states and congressional districts,” including nearly $1 billion in shoreline restoration projects, tax credits for a company that manufactures fuel from compressed turkey carcasses, and a provision doubling the use of corn-based ethanol as a gasoline additive. The Republican lawmakers also dropped a section that would have opened the Arctic National Wildlife Refuge to oil exploration, as Democrats had made clear that they would vote against any bill containing such a provision. But the Republicans decided against including a Democrat-favored plan to require large utility companies to steadily increase their use of energy from clean, renewable sources such as wind and solar power.     • A provision introduced by House Majority Leader Tom DeLay that would provide energy companies and universities with $2 billion in subsidies over the next 10 years for research and development of ultra deep-water oil exploration techniques and “unconventional” natural gas extraction.     • A controversial provision granting Gulf Coast refiners of the fuel additive MTBE $2 billion in subsidies to assist them in the phasing out of MTBE production. The phase-out, originally proposed to take 4 years, is extended to 10 by the bill. MTBE, or methyl tertiary-butyl ether, which helps decrease smog, is known to contaminate groundwater. The new energy bill would also prevent communities from bringing product liability lawsuits against the manufacturers of MTBE. Tom Delay was a strong supporter of this provision, as were other legislators from Louisiana and Texas, where MTBE is produced.     • Tax incentives to encourage wind power generators, energy-efficient homes and hybrid passenger cars running on gasoline and batteries. Additionally, it sets aside funds for equipping government buildings with photovoltaic cells and developing energy-efficient traffic lights. But according to a preliminary estimate by the American Council for an Energy-Efficient Economy, these progressive reforms would eliminate only about three months worth of energy use between now and 2020.     President Bush signs into law the defense authorization bill, which contains a controversial rider allowing the Pentagon to circumvent the Marine Mammal Protection Act (MMPA) and Endangered Species Act (ESA). The MMPA prohibits government and commercial interests from engaging in activities harmful to the declining populations of whales, dolphins and seals. The act, passed in 1972, has been credited with halting the decline of some of those populations. The bill also exempts the military from certain provisions of the ESA.     • Permits the secretary of defense to exempt any military activity from the MMPA, without regard to its impact on whales, seals and dolphins.     • Extends the Pentagon’s exemptions to scientists who conduct research sponsored by the Navy or other federal agencies. [Earth Island Institute, 11/6/2004]
    • Eliminates language in the MMPA that prohibits the Navy from doing sonars, invasive research, bomb testing and other activities that threaten the habitat of whales, seals and dolphins. [Christian Science Monitor, 11/24/2003; Earth Island Institute, 11/6/2004]
    • Exempts US military bases and lands from ESA habitat-protection provisions. Defense Secretary Donald Rumsfeld says that the new exemption will “improve… military readiness” even though a General Accounting Office study found that “very few units reported being unable to achieve combat-ready status due to inadequate training areas.” [General Accounting Office, 6/2002 pdf file; Christian Science Monitor, 11/24/2003; Earth Island Institute, 11/6/2004] Encouraged by their success at weakening the MMPA and ESA, defense officials say that next year they will attempt to modify a court agreement the Pentagon accepted the month before requiring the Navy to limit where it can use its new low-frequency sonar system that has the ability to track quiet diesel submarines. Critics argue the sonar’s frequency is so loud that it could kill noise-sensitive whales and dolphins. [Washington Post, 11/16/2003] The military is also planning to seek exemptions to the Clean Air Act, the Resource Conservation and Recovery Act and the Superfund Act (see April 6, 2004).     December 1-7, 2003: Presidential Candidate Howard Dean Raises Possibility of Bush Having Foreknowledge of 9/11 Plot
    In a December 1, 2003, interview, Howard Dean discusses the possibility that President Bush is hiding information that he was warned in advance about the 9/11 attacks. Presidential candidate Dean states that “The most interesting theory that I have heard so far… is that he was warned ahead of time by the Saudis.” Six days later, Dean clarifies, “I don’t believe that… But we don’t know, and it’d be a nice thing to know.” He concludes, “Because the president won’t give information to the Kean Commission, we really don’t know what the explanation is.” [The Beat, 12/23/2003] When asked about these comments, President Bush says “Look, there’s time for politics. And, you know… there’s a time for politics. And… it’s an absurd insinuation.” Dean spokesman Jay Carson responds, “Gov. Dean has been very clear he doesn’t subscribe to or believe this theory. But the White House needs to be more forthcoming with the 9-11 commission and put all these types of theories to rest.” [Dallas Morning News, 12/15/2003]

    December 3, 2003
    President Bush signs into law the “Healthy Forest Restoration Act,” (see May 21, 2003) aimed at reducing environmental and judicial review of forest-thinning fire-prevention programs in national forests. The law—modeled on President Bush’s “Healthy Forest Initiative” —almost doubles the federal budget for forest-thinning projects to $760 million. [White House, 12/3/2003; Associated Press, 12/4/2003; Los Angeles Times, 12/4/2003] The bill axes a requirement that any proposed US Forest Service (USFS) program that may adversely affect endangered plants or animals be reviewed by the Fish and Wildlife Service or the National Marine Fisheries Service. Under the new law, reviews will instead be performed by USFS biologists or other land-management agencies. Marty Hayden, legislative director for Earthjustice, says the measure removes important checks and balances. “The conflict of interest is that the agency whose top job is to do the logging will make this decision, rather than the agency whose top job is to protect threatened or endangered species,” he explains. [Los Angeles Times, 12/4/2003] Critics of the bill argue that it will make it easier for timber companies to log large fire-resistant trees in remote parts of the forest and ignore the needs of at-risk communities who need help clearing flammable brush from the immediate areas surrounding their homes and property. Sean Cosgrove, a forest expert with the Sierra Club, tells CNN: “The timber industry fought real hard for this bill for a reason and it’s not because they want to remove brush and chaparral. Through and through this thing is about increasing commercial logging with less environmental oversight.” Overall, critics say, the law reduces environmental review, limits citizen appeals, pressures judges to quickly handle legal challenges to logging plans, and facilitates access for logging companies to America’s 20 million acres of federal forests.     December 14, 2003: Bush Has Difficulty Answering Question About 9/11 Foreknowledge
    During a press conference, Washington Times reporter Bill Sammon asks President Bush, “I know you said there will be a time for politics, but you’ve also said you wanted a change in tone in Washington. Howard Dean recently seemed to muse aloud whether you had advanced knowledge of 9/11. Do you agree or disagree with the RNC that this kind of rhetoric borders on political hate speech?” Bush stammers and pauses with his reply: “Look, there’s time for politics.… And, you know… there’s a time for politics.… And… it’s an absurd insinuation.” [CNN, 12/14/2003; Dallas Morning News, 12/15/2003]

    December 17-21, 2003: 9/11 Commission Chairman Says 9/11 Attacks Were Preventable
    For the first time, 9/11 Commissioner Thomas Kean says that the 9/11 attacks could and should have been prevented. Kean, a Bush appointee and former Republican governor of New Jersey, states that “This was not something that had to happen… There are people that, if I was doing the job, would certainly not be in the position they were in at that time because they failed. They simply failed.” In 2002, FBI Director Robert Mueller stated, “[T]here was nothing the agency could have done to anticipate and prevent the [9/11] attacks” (see May 8, 2002) and other Bush administration officials have also said the attacks were all but unstoppable. Kean promises major revelations from the FBI, CIA, Defense Department, NSA, and possibly former President Clinton and President Bush. [CBS News, 12/17/2003] But within days, Kean amends his comments. He says that he wants to make it “clear” that he meant that officials at the operational level two years ago deserved to be singled out for blame and that no judgments had been reached about senior officials. This coincides with continued attempts from the White House to paint the intelligence prior to the attacks as non-specific “chatter,” and the attacks themselves as “literally bolts from the blue.” [Boston Globe, 12/21/2003]

    Early 2004: White House, Justice Department Clash over Secret NSA Data Mining Program
    The White House and the Justice Department are at odds over the legality of the National Security Agency’s “data mining” program, which involves the NSA combing through enormous electronic databases containing personal information about millions of US citizens, ostensibly for anti-terrorism purposes and often without court warrants. Such data mining by the NSA potentially threatens citizens’ constitutional right to privacy. This clash between the White House and the Justice Department is one of the reasons that White House counsel Alberto Gonzales and chief of staff Andrew Card will try to pressure Attorney General John Ashcroft, while Ashcroft is recuperating from surgery, to reauthorize the NSA program over the objections of Deputy Attorney General James Comey. That attempt to force reauthorization over Justice Department complaints will result in the protest resignations of Ashcroft, Comey, and other Justice officials (see March 10-12, 2004). In 2007, Gonzales will deny that any such attempt to pressure Ashcroft to overrule Comey ever happened (see July 24, 2007), and will deny that there was any such dispute between the White House and Justice Department over the NSA program. Those denials will lead to calls to investigate Gonzales for perjury (see May 16, 2007). In late 2005, President Bush will admit, after the New York Times reveals the existence of the NSA warrantless wiretapping program (see Early 2002), that the program indeed exists, but will not acknowledge the data mining. Several current and former administration officials, interviewed by reporters in 2007, refuse to go into detail about the dispute between the White House and Justice Department, but say that it involves other issues along with the data mining. They will also refuse to explain what modifications to the surveillance program Bush will authorize to mollify Justice Department officials. Bush and his officials, including Gonzales, who will ascend to the position of attorney general in 2005, will repeatedly insist that he has the authority, both under the Constitution and under Congress’s authorization to use military force against terrorists passed after the 9/11 attacks (see September 14-18, 2001), to bypass the requirements for court warrants to monitor US citizens. Critics will say that such surveillance is illegal under the Foreign Intelligence Surveillance Act. [New York Times, 7/29/2007]

    January 2004: Louisiana Governor Personally Asks Bush to Fund Louisiana Coastal Restoration Project
    During President Bush’s visit to Louisiana, Governor Kathleen Blanco asks the president in a private conversation to include $50 million in his budget to begin construction work on the Louisiana Coastal Area (LCA) wetlands restoration project. She follows up with a formal letter outlining her request. [Associated Press, 2/3/2004]

    January 11, 2004: Bush Pledges Manned Spaceflight to Moon by 2020
    President George Bush pledges that the US will launch manned space flights to the moon by 2020, and eventually to Mars. [CNN, 1/11/2004; US President, 1/19/2004]

    January 13, 2004: Report on Abu Ghraib Prison Photographs Sent to White House
    The Army Criminal Investigation Division (CID) agent who received the Abu Ghraib prison photographs from Spc. Joseph Darby (see January 13, 2004), calls his boss, a colonel, who takes them to Lt. Gen. Ricardo S. Sanchez. [Signal Newspaper, 7/4/2004] Within three days, a report on the photos makes its way to Donald Rumsfeld, who informs President Bush. [New Yorker, 5/24/2004] Within the Pentagon, few people are informed—unusually few—according to Hersh, who will later write that knowledge of the abuses were “severely, and unusually restricted.” A former intelligence official will tell him: “I haven’t talked to anybody on the inside who knew; nowhere. It’s got them scratching their heads.” Rumsfeld and his civilian staff, Lt. Gen. Ricardo S. Sanchez and Gen. John P. Abizaid, reportedly try to suppress the issue during the first months of the year. “They foresaw major diplomatic problems,” according to a Pentagon official. [New Yorker, 5/17/2004] According to one former intelligence official, the Defense Secretary’s attitude is: “We’ve got a glitch in the program. We’ll prosecute it.” The former official explains to Seymour Hersh, “The cover story was that some kids got out of control.” [New Yorker, 5/24/2004]

    January 20, 2004: Bush Gives State of the Union Address; Claims Iraq had WMD-‘Related’ Programs
    George Bush gives the third state of the union address of his presidency. He states that the Iraq Survey Group found “weapons of mass destruction-related program activities” in Iraq and claims that had his administration “failed to act, the dictator’s weapons of mass destruction program would continue to this day.” [Los Angeles Times, 11/20/2005]

    January 29, 2004: David Kay Meets with President and Other White House Officials to Discuss Lack of WMDs
    David Kay, former head of the Iraq Survey Group, meets with President Bush, Dick Cheney, Condoleezza Rice, and Andrew Card. The day before (see January 28, 2004), Kay had told Congress, “We were almost all wrong” about intelligence on Iraq’s presumed arsenal of illegal weapons. Bush wants to know what went wrong, but shows no anger. “The president accepted it,” Kay later recalls. “There was no sign of disappointment from Bush. He was at peace with his decision to go to war. I don’t think he ever lost ten minutes of sleep over the failure to find WMDs.” [Isikoff and Corn, 2006, pp. 349]

    February 2, 2004: Louisiana Governor Criticizes President’s Failure to Include Adequate Funds for Louisiana Coastal Wetland Restoration Project
    Governor Kathleen Blanco says in response to the release of President Bush’s 2005 budget (see February 2, 2004): “While I am pleased to see that President Bush included some money in his executive budget to address coastal restoration in Louisiana, I must say I am disappointed that the $8 million he proposed is less than one-sixth of what I had requested. We need immediate help… to protect our state and our nation from the continued degradation of the area we call America’s Wetland.” [Associated Press, 2/3/2004]

    February 14, 2004: CIA Tells White House that Prisoner Has Recanted Claim Iraq Gave Poison and Gas Training to Al-Qaeda
    The CIA sends a memo to top Bush administration officials informing them that Ibn al-Shaykh al-Libi, an al-Qaeda operative being held in custody by the CIA, recanted his claim in January that Iraq provided training in poisons and gases to members of al-Qaeda (see September 2002). [New York Times, 7/31/2004; Newsweek, 7/5/2005; Washington Post, 11/6/2005] The claim had been used in speeches by both President George Bush (see October 7, 2002) and Secretary of State Colin Powell (see 10:30 a.m. February 5, 2003).

    February 15, 2004
    The US Forest Service reverses its ban on poisoning prairie dogs on five national grasslands in South Dakota, North Dakota, Nebraska and Wyoming. The measure is a response to complaints from the livestock industry that prairie dog populations are spreading from federal lands onto private property, ruining grazing land, causing erosion and damaging roads. Critics of the decision to lift the ban note that in 2000, the US Fish and Wildlife Service had concluded that prairie dogs should be listed as a threatened species. [Associated Press, 2/14/2004]

    February 26, 2004: British Whistleblower Free after Government Refuses to Reveal Information Necessary for Prosecution
    Katharine Gun, who leaked an NSA memo to the British press in February 2003 that revealed the existence of an elaborate US plan to “bug” UN delegates (see January 31, 2003), is arrested and charged with violating the Official Secrets Act for giving a copy of the memo to the press. Gun was a translator for British intelligence, who worked at the Government Communications Headquarters (GCHQ) before losing her job over the leak in June. Gun does not dispute leaking the memo, instead calling it “justified.” Any leaks she made exposed “serious illegality and wrongdoing on the part of the US Government,” she says, and were made to prevent “wide-scale death and casualties among ordinary Iraqi people and UK forces.” [BBC, 11/13/2003] Gun has had the support of a wide array of antiwar and civil rights activists, led in the US by actor Sean Penn and activist Jesse Jackson, who signed a statement shortly before her court appearance praising her as a whistleblower. [Observer, 1/18/2004] The British government decides to drop the charges against her. No official explanation for this is forthcoming, though it may have been precipitated by the defense’s intent to argue that Gun leaked to the media in order to save lives from being lost in a war, an argument that would cause political damage to the government. Liberty spokeswoman Shami Chakrabarti says the decision to charge Gun may itself have been politically motivated, perhaps to cow future whistleblowers, and observes, “One wonders whether disclosure in this criminal trial might have been a little too embarrassing.” Sir Menzies Campbell, the Liberal Democrats’ foreign affairs spokesman, says the reason for dropping the charges might be to keep the Attorney General’s legal advice for war with Iraq a secret. Prosecutor Mark Ellison merely tells the court, “There is no longer sufficient evidence for a realistic prospect of conviction. It would not be appropriate to go into the reasons for this decision.” The only thing needed for a successful prosecution under the Official Secrets Act is for the prosecution to show that Gun is covered by the act, which she is, and that she revealed information covered by the Act, which she has admitted. Gun’s lawyer, James Webb, calls the prosecution’s excuse “rather lame.” [BBC, 11/13/2003; Evening Standard, 2/25/2004] Gun says that leaking the NSA memo was “necessary to prevent an illegal war in which thousands of Iraqi civilians and British soldiers would be killed or maimed.… I have only ever followed my conscience.” [ZNet, 12/28/2005] A month before the court proceedings, the New York Times’s Bob Herbert writes in defense of Gun, “We are not talking about a big-time criminal here. We are not talking about someone who would undermine the democratic principles that George W. Bush and Tony Blair babble about so incessantly, and self-righteously, even as they are trampling on them. Ms. Gun is someone who believes deeply in those principles and was willing to take a courageous step in support of her beliefs. She hoped that her actions would help save lives. She thought at the time that if the Security Council did not vote in favor of an invasion, the United States and Britain might not launch the war.” [New York Times, 1/19/2004] And just days before the court proceedings begin, liberal columnist Molly Ivins wrote, “…Gun may be sentenced to prison for doing precisely what we all hope every government employee will try to do: Prevent the government from committing an illegal and immoral act. Some dare call it patriotism.” [AlterNet, 2/18/2004]

    US President George Bush announces that the US is sending US forces to Haiti to help stabilize the country. [Reuters, 3/1/2004]

    March 18-21, 2004: Terror Alert Follows Failure to Capture Al-Zawahiri
    On March 18, Pakistani regular and paramilitary troops use artillery and helicopter gunships to launch an assault against suspected al-Qaeda and Taliban fighters in South Waziristan, a tribal region near Afghanistan. An American news channel reporting from Pakistan states that Pakistani President General Pervez Musharraf told them that the assault is targeting a “high-value target” being protected by al-Qaeda fighters. [FOX News, 3/18/2004] Two Pakistani government sources reveal that intelligence indicates the surrounded figure is Ayman al-Zawahiri, al-Qaeda’s alleged second-in-command. Musharraf describes the 200 al-Qaeda fighters as well-trained and well-armed and says they are “in very strong dug-in positions. The houses there are almost forts, they are mud forts. And all of these forts are occupied.” [CNN, 3/18/2004] On March 19, Pakistani officials say that al-Zawahiri has escaped the South Waziristan village during the fighting which left at least 15 soldiers and 24 fighters dead. Up to 100 al-Qaeda fighters continued to mount a strong resistance. [Interactive Investor, 3/19/2004] Two days later, the State Department issues a terror alert, warning “that al-Qaeda continues to prepare to strike US interests abroad” and such attacks “could possibly involve non-conventional weapons such as chemical or biological agents as well as conventional weapons of terror.” More specific information is not provided. [Command Post, 3/21/2004] Coinciding with the terror alert, former counterterrorism “tsar” gives testimony before the 9/11 Commission that is harshly critical of the Bush administration’s counterterrorism efforts (see March 24, 2004).     March 21, 2004: Counterterrorism ‘Tsar’ Clarke Goes Public with Complaints Against Bush Response to Terrorism
    Richard Clarke, counterterrorism “tsar” from 1998 until October 2001, ignites a public debate by accusing Bush of doing a poor job fighting al-Qaeda before 9/11. In a prominent 60 Minutes interview, he says, “I find it outrageous that the president is running for re-election on the grounds that he’s done such great things about terrorism. He ignored it. He ignored terrorism for months, when maybe we could have done something to stop 9/11.… I think he’s done a terrible job on the war against terrorism.” He adds, “We had a terrorist organization that was going after us! Al-Qaeda. That should have been the first item on the agenda. And it was pushed back and back and back for months.” He complains that he was Bush’s chief adviser on terrorism, yet he never got to brief Bush on the subject until after 9/11. [CBS News, 3/21/2004; CBS News, 3/21/2004; Guardian, 3/23/2004; Salon, 3/24/2004] The next day, his book Against All Enemies is released and becomes a best seller. [Washington Post, 3/22/2004] He testifies before the 9/11 Commission a few days later (see March 24, 2004).

    April 8, 2004: Rice Testifies Before the 9/11 Commission
    National Security Adviser Rice testifies before the 9/11 Commission under oath and with the threat of perjury. The Bush administration originally opposed her appearance, but relented after great public demand. [Independent, 4/3/2004] In her statement she repeats her claim that “almost all of the reports [before 9/11] focused on al-Qaeda activities outside the United States.… The information that was specific enough to be actionable referred to terrorists operation overseas.” Moreover, she stresses that the “kind of analysis about the use of airplanes as weapons actually was never briefed to us.” But she concedes, “In fact there were some reports done in ‘98 and ‘99. I think I was—I was certainly not aware of them…” [Washington Post, 4/8/2004] During heated questioning several subjects are discussed:

    • Why didn’t counterterrorism “tsar” Richard Clarke brief President Bush on al-Qaeda before September 11? Clarke says he had wished to do so, but Rice states, “Clarke never asked me to brief the president on counterterrorism.” [Washington Post, 4/8/2004]
    • What was the content of the briefing President Bush received on August 6, 2001 (see August 6, 2001)? While Rice repeatedly underlines that it was “a historical memo… not threat reporting,” Commissioners Richard Ben-Veniste and Tim Roemer ask her why then it cannot be declassified. [Washington Post, 4/8/2004] Two days later the White House finally publishes it, and it is shown to contain more than just historical information.
    • Did Rice tell Bush of the existence of al-Qaeda cells in the US before August 6, 2001? Rice says that she does not remember whether she “discussed it with the president.” [Washington Post, 4/8/2004]
    • Were warnings properly passed on? Rice points out, “The FBI issued at least three nationwide warnings to federal, state, and law enforcement agencies, and specifically stated that although the vast majority of the information indicated overseas targets, attacks against the homeland could not be ruled out. The FBI tasked all 56 of its US field offices to increase surveillance of known suspected terrorists and to reach out to known informants who might have information on terrorist activities.” But Commissioner Jamie Gorelick remarks, “We have no record of that. The Washington field office international terrorism people say they never heard about the threat, they never heard about the warnings.” [Washington Post, 4/8/2004] Rice does not apologize to the families of the victims, as Clarke did weeks earlier. The Associated Press comments, “The blizzard of words in Condoleezza Rice’s testimony Thursday did not resolve central points about what the government knew, should have known, did and should have done before the September 11 terrorist attacks.” [Associated Press, 4/8/2004] The Washington Post calls “her testimony an ambitious feat of jujitsu: On one hand, she made a case that ‘for more than 20 years, the terrorist threat gathered, and America’s response across several administrations of both parties was insufficient.’ At the same time, she argued that there was nothing in particular the Bush administration itself could have done differently that would have prevented the attacks of September 11, 2001—that there was no absence of vigor in the White House’s response to al-Qaeda during its first 233 days in office. The first thesis is undeniably true; the second both contradictory and implausible.” [Washington Post, 4/9/2004]

    April 11, 2004: Bush Claims ‘Bin Laden Determined to Attack in US’ Memo ‘Said Nothing about an Attack on America’
    President Bush talks about the Presidential Daily Briefing (PDB) he was given on August 6, 2001, entitled “Bin Laden Determined to Strike in US.” He claims, “There was nothing in this report to me that said, ‘Oh, by the way, we’ve got intelligence that says something is about to happen in America.‘… There was nothing in there that said, you know, ‘There is an imminent attack.’ That wasn’t what the report said. The report was kind of a history of Osama’s intentions.” [Associated Press, 4/12/2004] He adds, “[T]he PDB was no indication of a terrorist threat. There was not a time and place of an attack. It said Osama bin Laden had designs on America. Well, I knew that. What I wanted to know was, is there anything specifically going to take place in America that we needed to react to.… I was satisfied that some of the matters were being looked into. But that PDB said nothing about an attack on America. It talked about intentions, about somebody who hated America—well, we knew that.… Had I known there was going to be an attack on America, I would have moved mountains to stop the attack.” [US President, 4/19/2004] The complete text of the PDB was released the day before Bush’s comments and in fact the PDB does very clearly discuss an imminent attack on the US. For instance, it says that FBI information “indicates patterns of suspicious activity in this country consistent with preparations for hijackings or other types of attacks, including recent surveillance of federal buildings in New York.” And it discusses a call to a US “embassy in the UAE in May [2001] saying that a group of bin Laden supporters was in the US planning attacks with explosives” (see August 6, 2001).

    April 13, 2004: Bush Explains Genoa Threat Inspired Him to Ask For Famous August 2001 Briefing
    In a news conference, President Bush is asked about the August 6, 2001 Presidential Daily Briefing entitled “bin Laden Determined to Strike in US.” (see August 6, 2001) Bush explains: “I asked for the briefing. And the reason I did is because there had been a lot of threat intelligence from overseas. And part of it had to do with the Genoa G8 conference that I was going to attend. And I asked at that point in time, let’s make sure we are paying attention here at home as well. And that’s what triggered the report.” Apparently he made this request on July 5, 2001 (see July 5, 2001) (see June 20, 2001). [US President, 4/19/2004] The main threat to the late July 2001 Genoa conference, as discussed in numerous articles even before the conference, was an al-Qaeda plot to fly an airplane into the conference building, killing Bush and other world leaders (see Mid-July 2001). But Bush’s tacit admission that a plot involving planes as weapons helped inspire the well-known August briefing passes without comment by the mainstream media. However, a professor writes a letter to the editor of Britain’s Financial Times noting Bush’s remark and commenting, “If President Bush had been sufficiently alarmed by the Italian defenses [against a suicide air attack] in Genoa to request a special report, he must have been able to recognize that, yes, it could happen in the US.” [Financial Times, 4/27/2004]

    April 13, 2004: Bush Continues to Insist That 9/11 Could Not Have Been Prevented
    In a press conference, President Bush states, “We knew he [Osama bin Laden] had designs on us, we knew he hated us. But there was nobody in our government, and I don’t think [in] the prior government, that could envision flying airplanes into buildings on such a massive scale.” [Guardian, 4/15/2004] He also says, “Had I any inkling whatsoever that the people were going to fly airplanes into buildings, we would have moved heaven and earth to save the country.” [New York Times, 4/18/2004; US President, 4/19/2004] Bush made similar comments two days earlier (see April 11, 2004). In July 2004, he will claim even more generally, “Had we had any inkling whatsoever that terrorists were about to attack our country, we would have moved heaven and earth to protect America.” [New Jersey Star-Ledger, 7/22/2004]

[Source: Associated Press / Charles Dharapak]Attorney General John Ashcroft’s testimony before the 9/11 Commission (see April 13, 2004) sparks a wave of attacks against 9/11 Commissioner Jamie Gorelick, who was Deputy Attorney General during the Clinton administration. In 1995 Gorelick played a leading role in extending the “wall,” a set of procedures that regulated the passage of information from FBI intelligence agents to FBI criminal agents and prosecutors (see March 4, 1995 and July 19, 1995). Ashcroft calls the wall “the single greatest structural cause for September 11.” The attacks include:
    • On April 14 James Sensenbrenner, chairman of the House Judiciary Committee, calls on Gorelick to resign because of her “crippling conflict of interest.” He says “the public cannot help but ask legitimate questions about her motives” and argues that the commission will be “fatally damaged” if she continues. Other Republican congresspersons repeat this call;
    • On April 16 House Majority Leader Tom Delay writes to Commission Chairman Tom Kean saying Gorelick has a conflict of interest and accusing the commission of “partisan mudslinging, circus-atmosphere pyrotechnics, and gotcha-style questioning,” as well as undermining the war effort and endangering the troops;
    • Criticism of Gorelick also appears in several media publications, including the New York Times, New York Post, National Review, Washington Times, and Wall Street Journal. For example, an op-ed piece published in the New York Times by former terrorism commissioners Juliette Kayyem and Wayne Downing says the commissioners are talking too much and should “shut up.” [National Review, 4/13/2004; National Review, 4/19/2004; Kean and Hamilton, 2006, pp. 200-203]
    • On April 22 Senator Christopher Boyd and ten other Republican senators write to the commission calling on Gorelick to testify in public;
    • On April 26 Congressman Lamar Smith and 74 other Republicans write to Gorelick demanding answers to five questions about her time as deputy attorney general;
    • On April 28 the Justice Department declassifies other memos signed by Gorelick;
    • In addition to hate mail, Gorelick receives a bomb threat, requiring a bomb disposal squad to search her home.
    Commission Chairmen Tom Kean and Lee Hamilton will call this an “onslaught” and say her critics used the wall “as a tool to bludgeon Jamie Gorelick, implicate the Clinton administration, and undermine the credibility of the commission before we had even issued our report.” Gorelick offers to resign, but the other commissioners support her and she writes a piece for the Washington Post defending herself. [Washington Post, 4/18/2004; Kean and Hamilton, 2006, pp. 200-205] When the commission meets President Bush and Vice President Cheney at the end of the month (see April 29, 2004), Bush tells Kean and Hamilton he does not approve of memos being declassified and posted on the Justice Department’s website. At this point, the commissioners realize “the controversy over Jamie Gorelick’s service on the commission was largely behind us.” That afternoon, the White House publicly expresses the president’s disappointment over the memos and the effort to discredit Gorelick loses momentum.     Evening April 28, 2004
    CBS “60 Minutes II” airs the Abu Ghraib prison photos (see March 23, 2004) having learned that the New Yorker is about to publish a piece on abuses at Abu Ghraib. Bush reportedly first learns about these photos from the television report. [CBS News, 5/6/2004; Los Angeles Times, 5/6/2004; Baltimore Sun, 5/6/2004; St. Petersburg Times, 5/9/2004] Most of the photos show prisoners being forced to engage in humiliating sexual acts. For example in one photo a hooded naked man is forced to masturbate as a grinning female MP, Lynndie England, looks on, giving a thumbs-up. Another photo shows two naked hooded men, one standing, while the other is kneeling in front of him, simulating oral sex. The Bush administration will portray these forced acts of humiliation as the immature pranks of low ranking soldiers. But others will argue that the acts were ordered from above with the intent to exploit Arab culture’s conservative views with regard to sex and homosexuality (see (2002-March 2003)). [New Yorker, 5/10/2004; New Yorker, 5/17/2004] A different picture shows a hooded-man with his arms spread and wires dangling from his fingers, toes, and penis. He was apparently told that if he fell off the box he would be electricuted. The tactic is known as the “The Vietnam,” an “arcane torture method known only to veterans of the interrogation trade” that had been first used by Brazilians in the 1970s. [Seattle Times, 5/14/2004; Newsweek, 5/24/2004 Sources: Darius Rejali] Another picture is of Manadel al-Jamadi who was killed after being “stressed” too much (see (7:00 a.m.) November 4, 2003). [New Yorker, 5/10/2004; New Yorker, 5/17/2004] “A generation from now,” one observer notes, “historians may look back to April 28, 2004, as the day the United States lost the war in Iraq.” [Washington Monthly, 11/2004]

    April 29, 2004: Bush and Cheney Privately Meet with 9/11 Commission; Decline to Provide Testimony Under Oath
    President Bush and Vice President Cheney appear for three hours of private questioning before the 9/11 Commission. (Former President Clinton and former Vice President Al Gore met privately and separately with the commission earlier in the month. [Washington Post, 4/30/2004; New York Times, 4/30/2004] ) The commission permits Bush and Cheney to appear together, in private, and not under oath. The testimony is not recorded. Commissioners can take notes, but the notes are censored by the White House. [Knight Ridder, 3/31/2004; Newsweek, 4/2/2004; New York Times, 4/3/2004] The commission drew most of their questions from a list submitted to the White House before the interview, but few details about the questions or the answers given are available. [Washington Post, 4/29/2004] Two commissioners, Lee Hamilton and Bob Kerrey, leave the session early for other engagements. They claim they had not expected the interview to last more than the previously agreed upon two-hour length. [New York Times, 5/1/2004]

    May 4, 2004
    Maj. Gen. Geoffrey Miller says during a Coalition Provisional Authority briefing that while physical contact between the interrogator and detainees is prohibited, “sleep deprivation and stress positions and all that could be used—but they must be authorized.” (see April 16, 2003) But as Amnesty International later notes in a letter to George Bush, “The United Nations Committee against Torture, the expert body established by the Convention against Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment has expressly held that restraining detainees in very painful positions, hooding, threats, and prolonged sleep deprivation are methods of interrogation which violate the prohibition on torture and cruel, inhuman, or degrading treatment.” [Amnesty International, 5/7/2004]

    May 5, 2004: Bush Says Abuse Scandal Does Not Reflect American Values; Does Not Say Sorry
    President Bush appears on two Arab television channels, the US-funded Al-Hurra network and the Al-Arabiya satellite channel. The interviews last ten minutes for each station. He says: “People in Iraq must understand that I view those practices as abhorrent.…must also understand that what took place in that prison does not represent the America that I know.” He adds: “The America that I know has sent troops to Iraq to promote freedom.” [CBS News, 5/5/2004] During the interviews, Bush is not asked to make an apology and nor does he offer one. [BBC, 5/5/2004] Later in the day, White House spokesman Scott McClellan uses the word “sorry” a half-dozen times. “The president is sorry for what occurred and the pain it has caused.” Asked why the president has not apologized himself, McClellan says: “I’m saying it now for him.” [CBS News, 5/5/2004]

    US Secretary of State Colin Powell says, “We kept the president informed of the concerns that were raised by the ICRC and other international organizations as part of my regular briefings of the president, and advised him that we had to follow these issues, and when we got notes sent to us or reports sent to us… we had to respond to them, and the president certainly made it clear that that’s what he expected us to do.” (see (May 2003-May 2004)) [Baltimore Sun, 5/12/2004]

    May 13, 2004: Bush Says He’s ‘Disgraced’ by Torture Scandal
    President Bush says he has been “disgraced” by the abuse at Abu Ghraib. [New York Times, 5/13/2004]

    May 14, 2004: Former Detainees Write Open Letter Calling Attention to Abuses in Guantanamo
    Shafiq Rasul and Asif Iqbal allege in an open letter to President Bush, that the treatment of prisoners at Guantanamo resembles that of detainees at Abu Ghraib. “From the moment of our arrival at Guantanamo Bay (and indeed from long before) we were deliberately humiliated and degraded,” they write. Women would “inappropriately provoke and indeed molest them. It was completely clear to all the detainees that this was happening to particularly vulnerable prisoners, especially those who had come from the strictest of Islamic backgrounds.” [Guardian, 5/14/2004]

    May 14, 2004: Bush Blames Prison Abuse Scandal on the Actions of a ‘Few’
    President Bush, referring to the Abu Ghraib scandal, alleges it is “the cruelty of a few” that “has brought discredit to their uniform and embarrassment to our country.” [US President, 5/24/2004]

    May 22, 2004: FBI Agent e-mail Notes Contradictions in Interrogation Guidelines
    In an e-mail, an “On Scene Commander” of the FBI in Baghdad refers to an executive order by President Bush allowing aggressive interrogation techniques to be used at any rate in Iraq by Task Force 6-26, which is the new name for JTF-121. These techniques include sleep deprivation, stress positions, loud music, yelling, stripping, dogs, and hooding. The executive order is still in use even though the use of hooding, stress positions, dogs, and stripping at Guantanamo and in Afghanistan were prohibited on January 15, 2003 (see January 15, 2003). Since the FBI agent has been ordered to report instances of abuse (see May 19, 2004), he notes a dilemma: would the techniques authorized by the executive order constitute abuse or not? He writes: “This instruction begs the question of what constitutes ‘abuse.’ We assume this does not include lawful interrogation techniques authorized by executive order.” A week before, apparently as a result of the unfolding of the Abu Ghraib scandal, some techniques described in the executive order could only be used with special approval from top levels in the hierarchy. Thus, the FBI agent says in his e-mail: “[W]e will still not report the use of these techniques as ‘abuse’ since we will not be in a position to know whether, or not, the authorization for these tactics was received from the aforementioned high-level officials. We will consider as abuse any physical beatings, sexual humiliation or touching, and other conduct clearly constituting abuse. Yet, there may be a problem if OGC [FBI Office of General Counsel] does not clearly define ‘abuse’ and if OGC does not draw a clear line between conduct that is clearly abusive and conduct that, while seemingly harsh, is permissible under applicable Executive Orders and other laws. In other words, we know what’s permissible for FBI agents but are less sure what is permissible for military interrogators.” [ [Sources: Email to FBI agent Chris Briese, 5/14/2004]

    June 3, 2004: CIA Director George Tenet Resigns
    Citing personal reasons, CIA Director Tenet announces he will be stepping down in the next month. President Bush praises Tenet’s service, but there is widespread agreement that significant intelligence failures occurred during Tenet’s tenure, most strikingly 9/11 itself. Sources also suggest that Tenet, originally a Clinton appointee, has been made a convenient scapegoat for Bush administration intelligence failures in Iraq and elsewhere. [CNN, 6/4/2004; Independent, 6/4/2004]

    June 8, 2004: Ashcroft Insists Bush Administration ‘Rejects Torture’
    Attorney General John Ashcroft tells a Senate committee, “This administration rejects torture.” [Guardian, 6/9/2004] When asked whether torture might be justified in certain situations, Ashcroft responds, “I condemn torture. I don’t think it’s productive, let alone justified.” [Washington Post, 6/8/2004] With regard to President Bush’s involvement, he says: “Let me completely reject the notion that anything that this president has done or the Justice Department has done has directly resulted in the kind of atrocity which were cited. That is false.” [Guardian, 6/9/2004] Ashcroft adds, “There is no presidential order immunizing torture.” [Washington Post, 6/8/2004]

    June 9, 2004: Former Official Says Bush Policy On Interrogations Motivated by Concern for American Safety
    A former senior government official says President Bush “felt very keenly that his primary responsibility was to do everything within his power to keep the country safe, and he was not concerned with appearances or politics or hiding behind lower-level officials. That is not to say he was ready to authorize stuff that would be contrary to law. The whole reason for having the careful legal reviews that went on was to ensure he was not doing that.” [Washington Post, 6/9/2004]

    June 10, 2004: Bush Insists Interrogation Policy Consistent with US and International Law
    President Bush rejects the notion that he approved the use of torture. “The authorization I gave,” the president says, “was that all we did should be in accordance with American law and consistent with our international treaty obligations. That’s the message I gave our people.” He adds, “What I authorized was that we stay within the framework of American law.” And to emphasize his point, he says: “Listen, I’ll say it one more time.… The instructions that were given were to comply with the law. That should reassure you. We are a nation of laws. We follow the law. We have laws on our books. You could go look at those laws and that should reassure you.” [US President, 6/21/2004]

    June 15, 2004: Cheney Claims Hussein Linked to Al-Qaeda
    President Bush defends Vice President Dick Cheney’s claim this week that Saddam Hussein had longstanding ties with al-Qaeda. Speaking at a news conference with Afghan president Hamid Karzai, Bush asserts that Hussein “had ties to terrorist organizations.” He does not mention al-Qaeda by name. The day before, Cheney claimed that Hussein was “a patron of terrorism” and said “he had long established ties with al-Qaeda” (see June 14, 2004). [Boston Globe, 6/16/2004]

    June 21, 2004: Kofi Annan Urges Security Council to Vote against Exemption for US Troops
    UN Secretary-General Kofi Annan urges the Security Council to vote against a resolution that would exempt US soldiers serving in UN approved operations from prosecution before the International Criminal Court (ICC). Talking to journalists, he says, “For the past two years, I have spoken quite strongly against the exemption, and I think it would be unfortunate for one to press for such an exemption, given the prisoner abuse in Iraq.” [Inter Press Service, 6/21/2004] He adds, “It would discredit the Council and the United Nations that stands for the rule of law and the primacy of the rule of law.” [Truthout (.org), 6/28/2004] Since President Bush has taken office, the US, by threatening to withdraw funding for UN peacekeeping missions (see July 12, 2002), has made the Security Council adopt a resolution each year prohibiting the ICC from investigating or prosecuting officials from states that have not ratified the Rome Statute, like the US, for acts committed during participation in a UN-authorized mission. “Given the recent revelations from Abu Ghraib prison,” said Richard Dicker from Human Rights Watch, “the US government has picked a hell of a moment to ask for special treatment on war crimes.” [Inter Press Service, 6/21/2004] The US will eventually withdraw the resolution knowing China will use its veto power. China’s ambassador to the UN, Wang Guangya, later explains that his country did not want to support a resolution that could grant impunity to people committing abuses like the ones that happened at Abu Ghraib. [New York Times, 6/5/2004] The “major diplomatic defeat,” as the Financial Times calls it, “also marked,” according to the Washington Post, “the most concrete evidence of a diplomatic backlash against the scandal over abuses of US detainees in Afghanistan and Iraq.” [Truthout (.org), 6/28/2004] However, even with the defeat at the Security Council there is little chance that the US will be brought before the court for any future alleged war crimes because of bilateral immunity agreements that are still in force between the US and several countries (see August 2002-July 1, 2003).     June 22, 2004: White House Declassifies Several Documents Related to Interrogation Policy
    To demonstrate that President Bush has never authorized torture against prisoners, the White House declassifies and releases a large number of internal documents, including the February 7, 2002 memo (see February 7, 2002) signed by Bush, and documents, inter alia from Gen. James T. Hill, showing that the US military interrogators were seeking more aggressive interrogation techniques. The disclosures are made, according to Alberto R. Gonzales, because the government “felt that it was harmful to this country, in terms of the notion that perhaps we may be engaging in torture.” [Washington Post, 6/23/2004]

    June 22, 2004: Government Lawyers Renounce August 2002 Memo
    Aides to President Bush, including Alberto Gonzales, publicly renounce the internal memo of August 1, 2002 (see August 1, 2002) that outlined a legal opinion by the Justice Department’s Office of Legal Counsel (OLC). They say it created the false impression that the US government was claiming the right to authorize interrogation techniques in violation of international law. Gonzales agrees that some of its conclusions were “controversial” and “subject to misinterpretation.” [Washington Post, 6/23/2004] The White House announces that all legal advice rendered by the OLC on interrogations will be reviewed and that sections of the August memo will be rewritten. Gonzales says the section in the memo arguing that the president, as Commander-in-Chief, is not bound by anti-torture laws is “unnecessary.” Justice Department officials also say the section will be scrapped. [Washington Post, 6/27/2004] In his introductory statement, however, Gonzales describes the circumstances under which the memo had come about: “We face an enemy that lies in the shadows, an enemy that doesn’t sign treaties, they don’t wear uniforms, an enemy that owes no allegiance to any country, they do not cherish life. An enemy that doesn’t fight, attack, or plan according to accepted laws of war, in particular Geneva Conventions.” [Washington File, 6/23/2004] Gonzales claims that giving these people a protected status under the Geneva Conventions would be tantamount to rewarding the terrorists’ lawlessness. “[T]o protect terrorists when they ignore the law is to give incentive to continued ignoring that law,” he says. [Washington File, 6/23/2004] Gonzales says he thinks that Bush never actually saw the August 2002 memo: “I don’t believe the president had access to any legal opinions from the Department of Justice.” [New York Times, 6/24/2004]

    June 22, 2004: Bush Denies That He Ordered Torture
    President Bush, responding to questions regarding reports that prisoners have been tortured in Iraq, says: “Let me make very clear the position of my government and our country: We do not condone torture. I have never ordered torture. I will never order torture. The values of this country are such that torture is not a part of our soul and our being.” [Washington Post, 6/23/2004]

    June 25, 2004: Michael Moore’s Fahrenheit 9/11 Movie Highlights 9/11 Issues
    Fahrenheit 9/11, a film by well-known filmmaker and author Michael Moore, is released in the US. Amongst other things, this film reveals connections between the Bush family and prominent Saudis including the bin Laden family. [New York Times, 5/6/2004; New York Times, 5/17/2004; Toronto Star, 6/13/2004] It reviews evidence the White House helped members of Osama bin Laden’s family and other Saudis fly out of the US in the days soon after 9/11. [New York Times, 5/17/2004; Toronto Star, 6/13/2004; New York Times, 6/18/2004; Los Angeles Times, 6/23/2004; Newsweek, 6/30/2004] It introduces to the mainstream damning footage of President Bush continuing with a photo-op for seven minutes (see (9:06 a.m.) September 11, 2001) after being told of the second plane hitting the WTC on 9/11. [New York Times, 6/18/2004; Washington Post, 6/19/2004; Newsweek, 6/20/2004; Los Angeles Times, 6/23/2004] Disney refused to let its Miramax division distribute the movie in the United States, supposedly because the film was thought too partisan. [New York Times, 5/6/2004; Guardian, 6/2/2004; Los Angeles Times, 6/11/2004; Agence France-Presse, 6/23/2004] The film won the top award at the prestigious Cannes film festival—the first documentary to do so in nearly 50 years. [BBC, 5/24/2004; Guardian, 5/24/2004; Agence France-Presse, 6/23/2004] It is generally very well received, with most US newspapers rating it favorably. [Agence France-Presse, 6/23/2004; Editor & Publisher, 6/27/2004] The film is an instant hit and is seen by tens of millions. [Associated Press, 6/27/2004; BBC, 6/28/2004; Associated Press, 6/28/2004; CBS News, 6/28/2004] There are some criticisms that it distorts certain facts, such as exaggerating the possible significance of Bush and bin Laden family connections, and gripes about a $1.4 billion number representing the money flowing from Saudi companies to the Bush family. However, the New York Times claims that the public record corroborates the film’s main assertions. [New York Times, 5/17/2004; New York Times, 6/18/2004; Newsweek, 6/30/2004]

    June 26, 2004: Bush Denounces Torture; Says US Committed to Eliminating Torture Worldwide
    On the United Nations International Day in Support of Victims of Torture, President Bush says: “America stands against and will not tolerate torture. We will investigate and prosecute all acts of torture… in all territory under our jurisdiction.… Torture is wrong no matter where it occurs, and the United States will continue to lead the fight to eliminate it everywhere.” [US President, 7/5/2004]

    July 8, 2004: Magazine Correctly Predicts ‘July Surprise’ Al-Qaeda Arrest
    On July 8, 2004, the New Republic predicts a “July surprise” from the Bush-Cheney reelection campaign involving the arrest of a high-value target in Pakistan by the end of the month. The magazine reports that in the spring of 2004, the administration increased pressure on Pakistan to kill or capture Osama bin Laden, his deputy, Ayman al-Zawahiri, or Taliban leader Mullah Mohammed Omar, all believed to be hiding in Pakistan. Bush officials such as CIA Director George Tenet, Secretary of State Colin Powell and his assistant, Christina Rocca, State Department counterterrorism chief Cofer Black, and others all visited Pakistan in recent months to urge Pakistan to increase its efforts in the war on terrorism. The New Republic comments, “This public pressure would be appropriate, even laudable, had it not been accompanied by an unseemly private insistence that the Pakistanis deliver these high-value targets (HVTs) before Americans go to the polls in November.” Bush spokespeople deny that the administration exerted any such pressure. But according to one source in the Pakistani ISI, “The Pakistani government is really desperate and wants to flush out bin Laden and his associates after the latest pressures from the US administration to deliver before the [upcoming] US elections.” Another source in the Pakistani Interior Ministry says, “The Musharraf government has a history of rescuing the Bush administration. They now want Musharraf to bail them out when they are facing hard times in the coming elections.” And another ISI source says that the Pakistanis “have been told at every level that apprehension or killing of HVTs before [the] election is [an] absolute must.” The Pakistanis have even been given a target date, according to the second ISI source: “The last ten days of July deadline has been given repeatedly by visitors to Islamabad and during [ISI director Lieutenant General Ehsan ul-Haq’s] meetings in Washington.” The source says that a White House aide told ul-Haq last spring that “it would be best if the arrest or killing of [any] HVT were announced on twenty-six, twenty-seven, or twenty-eight July”—the first three days of the Democratic National Convention in Boston. One Pakistani general said recently, “If we don’t find these guys by the election, they are going to stick this whole nuclear mess [relating to A. Q. Khan] up our asshole.” The Bush administration apparently is using a carrot-and-stick approach to make sure such an arrest takes place on schedule. The New Republic observes, “Pushing Musharraf to go after al-Qaeda in the tribal areas may be a good idea despite the risks. But, if that is the case, it was a good idea in 2002 and 2003. Why the switch now? Top Pakistanis think they know: This year, the president’s reelection is at stake.” [New Republic, 7/29/2004] Pakistan will announce the capture of al-Qaeda leader Ahmed Khalfan Ghailani on July 29, just hours before Democratic presidential John Kerry’s acceptance speech at the Democratic National Convention. The authors of the New Republic article will claim vindication for their prediction (see July 25-29, 2004).

    July 16, 2004: 9/11 Commission Chairman’s Comments Lead to Flurry of Reporting on Iran, None on Pakistan
    Shortly before the 9/11 Commission is due to release its final report (see July 22, 2004), Commission Chairman Thomas Kean says, “We believe. . . . that there were a lot more active contacts, frankly, [between al-Qaeda and] Iran and with Pakistan than there were with Iraq.” [Time, 7/16/2004] The US media immediately runs prominent stories on the Commission’s evidence regarding Iran and nearly completely ignores evidence regarding Pakistan. The Commission’s final report mentions that around ten of the hijackers passed through Iran in late 2000 and early 2001. At least some Iranian officials turned a blind eye to the passage of al-Qaeda agents, but there was no evidence that the Iranian government had any foreknowledge or involvement in the 9/11 plot. [Time, 7/16/2004; Reuters, 7/18/2004] In the wake of these findings, President Bush states of Iran, “As to direct connections with September 11, we’re digging into the facts to determine if there was one.” This puts Bush at odds with his own CIA, which has seen no Iran-9/11 ties. [Los Angeles Times, 7/20/2004] Bush has long considered Iran part of his “axis of evil,” and there has been talk of the US attacking or overthrowing the Iranian government. [Reuters, 7/18/2004] Provocative articles appear, such as one in the Daily Telegraph titled, “Now America Accuses Iran of Complicity in World Trade Center Attack.” [Daily Telegraph, 7/18/2004] Yet, while this information on Iran makes front page news in most major newspapers, evidence of a much stronger connection between Pakistan and 9/11 is nearly completely ignored. For instance, only UPI reports on a document suggesting high-level Pakistani involvement in the 9/11 attacks that is revealed this same week. [United Press International, 7/22/2004] Furthermore, the 9/11 Commission’s final report will contain almost nothing on Pakistan’s ties to al-Qaeda, despite evidence given to the Commission that, according to one commissioner speaking to the Los Angeles Times, showed that Pakistan was “up to their eyeballs” in intrigue with al-Qaeda. [Los Angeles Times, 7/16/2004; 9/11 Commission, 7/24/2004]

    July 17, 2004: Bush defends claims of relationship between Iraq and al-Qaeda
    President Bush forcefully disputes statements by the 9/11 Commission (see Early July 2004) that there was no evidence of collaboration between Iraq and al-Qaeda. “The reason I keep insisting that there was a relationship between Iraq and Saddam and al-Qaeda, because there was a relationship between Iraq and al-Qaeda,” Bush says.     July 19, 2004: White House Withholds Iraq Contract Information, Money Spent Unaccounted For
    The head of the International Advisory and Monitoring Board, Jean-Pierre Halbwachs, says the Bush administration is withholding information regarding the more than $1 billion in contracts awarded to Halliburton and other companies in Iraq. This information is believed by UN-sanctioned auditors to confirm that these contracts were won without competitive bidding. The White House has rejected requests for this information since March, and will not produce a list of other companies that have obtained such contracts. [The Moscow Times, 7/19/2004] The IAMB, a multi-agency organization in place to oversee the Coalition Provisional Authority’s disbursements from the Development Fund for Iraq, later discovers that over a hundred contracts involving billions of dollars were in need of investigation and possible criminal prosecution. They also discover that $8.8 billion that passed through the new Iraqi government ministries under CPA control is unaccounted for, while an additional $3.4 billion appropriated by Congress for development eventually became earmarked to fund “security.” The IAMB, once established, was forced to spend months finding auditors acceptable to US authorities. These auditors, appointed in April 2004, are then stonewalled. It is believed that the Bush administration wished to stall until the end of June 2004, at which time the CPA would no longer be extant and Paul Bremer, the pro consul and head of the CPA, would not be answerable to the press. The auditors’ report reveals that the CPA hadn’t kept accounts of the hundreds of millions of dollars of cash in its vault, had awarded contracts worth billions of dollars to American firms without tender, and had no idea what was happening to the money from the Development Fund for Iraq (DFI), which was being spent by the interim Iraqi government ministries.     July 25-29, 2004: Al-Qaeda Suspect Arrested in Pakistan; Some Allege Announcement Is Timed for Political Effect
    Ahmed Khalfan Ghailani, a high-level al-Qaeda operative from Tanzania suspected of participating in the 1998 bombings of US embassies in East Africa, is captured in Gujrat, Pakistan, after a violent standoff with Pakistani police. [CNN, 8/3/2004] Ghailani’s arrest is publicly announced on July 29, four days later. The announcement by Pakistan’s Interior Minister Faisal Hayat is made in an unusual late-night press conference that takes place just hours before John Kerry accepts the Democratic nomination for president. [Salon, 8/17/2004] Pakistani authorities say the announcement of Ghailani’s arrest was delayed four days because of the need to confirm his identity before making the proclamation. [BBC, 7/30/2004] But former Pakistani official Husain Haqqani later claims the announcement was timed to upstage the Kerry speech. [Salon, 8/17/2004; United States Conference on International Religious Freedom, 6/30/2005] An article in the New Republic published earlier in the month reported that the Bush administration was asking Pakistan to make high-profile arrests of al-Qaeda suspects during the Democratic National Convention in order to redirect US media attention from the nomination of John Kerry (see July 8, 2004). [New Republic, 7/29/2004] John Judis, who co-wrote the article predicting such an arrest, says the day after the arrest is announced, “Well, the latest development pretty much confirms what we wrote in the article, which is that there was pressure for Pakistan to produce a high-value target during the last 10 days of July and to announce that arrest.” He also asks why is it “they announced [the arrest] at all? Because when you have somebody who’s been in hiding since 1998, they have an enormous amount of information and contacts. By announcing this guy’s arrest, what you do is you warn off everybody who’s been associated with him from the last five or six years. You tell them that they better get their act together or they are going to be found. So, there’s some, really a lot of questions of why they announced this thing when they did.… It may be in this case that we—that we, and the Pakistanis got somebody and prematurely announced this person’s arrest in order to have an electoral impact.” [Democracy Now!, 7/30/2004]

    August 1, 2004: Terror Alert Issued Using Old Information; Alleged to be Politically Motivated
    The Bush administration issues a terror alert in the wake of the Democratic presidential convention, which ended on July 29, 2004. New Code Orange alerts are put into effect for New York City, Newark, and Washington, DC. Homeland Security Director Tom Ridge says, “Now this afternoon, we do have new and unusually specific information about where al-Qaeda would like to attack.… Compared to previous threat reporting, these intelligence reports have provided a level of detail that is very specific. The quality of this intelligence, based on multiple reporting streams in multiple locations, is rarely seen and it is alarming in both the amount and specificity of the information.… As of now, this is what we know: reports indicate that al-Qaeda is targeting several specific buildings, including the International Monetary Fund and World Bank in the District of Columbia; Prudential Financial in Northern New Jersey; and Citigroup buildings and the New York Stock Exchange in New York.” [Department of Homeland Security, 8/1/2004; Washington Post, 8/3/2004] But Ridge fails to mention that the so-called “casing disks” are from 2000 and 2001, nor does he discuss the fact that the decision on whether to issue the alerts had been hotly debated by officials over the weekend. Within 24 hours, the age of the intelligence is leaked, causing a controversy about the merit and urgency of the orange alert. [Suskind, 2006, pp. 325-326] The next day it will be revealed that the warning was based on information from the computer of recently captured al-Qaeda operative Muhammad Naeem Noor Khan (see August 2, 2004). President Bush and his top advisors learned of the arrest and subsequent “turning” of Noor Khan just the day before. They decide to publicize an alert based on data captured with Noor Khan, even though doing so could jeopardize a sting operation launched just days earlier in which Noor Khan is contacting dozens of al-Qaeda operatives around the world (see July 24-25, 2004). [Guardian, 8/8/2004] But even though Khan was arrested just weeks before, one senior law enforcement official who was briefed on the alert says, “There is nothing right now that we’re hearing that is new. Why did we go to this level?… I still don’t know that.” Homeland Security officials admit that that there is no indication that any terrorist action was imminent. “What we’ve uncovered is a collection operation as opposed to the launching of an attack,” says one. However, administration officials insist that even three-year-old intelligence, when coupled with other information about al-Qaeda’s plans to attack the US, justifies the security response in the three cities. President Bush says of the alerts, “It’s serious business. I mean, we wouldn’t be, you know, contacting authorities at the local level unless something was real.” A senior counterterrorism official says, “Most of the information is very dated but you clearly have targets with enough specificity, and that pushed it over the edge. You’ve got the Republican convention coming up, the Olympics, the elections…. I think there was a feeling that we should err on the side of caution even if it’s not clear that anything is new.” [Washington Post, 8/3/2004] Former Democratic presidential candidate Howard Dean says he worries “every time something happens that’s not good for President Bush, he plays this trump card, which is terrorism. It’s just impossible to know how much of this is real and how much of this is politics, and I suspect there’s some of both.” But conservatives defend the alert and Democratic presidential candidate John Kerry swiftly moves to disassociate his campaign from Dean’s remarks. [New York Observer, 8/4/2007] Author William Rivers Pitt points out that Laura Bush and daughters Barbara and Jenna make high-profile visits to the Citigroup Center in New York City on the first day of Ridge’s new orange alert. Noting this was one of the target buildings, Pitt asks, “George W. Bush sent his entire family to the very place that was supposedly about to be blown to smithereens?” Pitt concludes, “Bush and his administration officials are using terrorism—the fear of it, the fight against it—to manipulate domestic American politics. They are, as they have every day for almost three years now, using September 11 against their own people.” [Truthout (.org), 8/4/2004]

    August 2, 2004: Bush Officials Leak Name of Cooperating Al-Qaeda Operative, Ruining Investigations
    Muhammad Naeem Noor Khan.Muhammad Naeem Noor Khan. [Source: BBC]The New York Times reveals the identity of al-Qaeda operative Muhammad Naeem Noor Khan. Bush administration officials allegedly revealed his name to the Times in an attempt to defend a controversial US terror alert issued the day before (see August 1, 2004). [Associated Press, 8/10/2004; Suskind, 2006, pp. 325-326] Officials from the Department of Homeland Security apparently gave out the name without revealing that Khan had already been turned and was helping to catch other al-Qaeda operatives. [Daily Times (Lahore), 8/8/2004] A few days later, National Security Adviser Condoleezza Rice confirms that US officials named Khan to the reporters “on background.” [Boston Globe, 8/10/2004] But some days after that, anonymous Pakistani government sources will claim that Khan’s name was initially leaked by Pakistani officials. [Salon, 8/17/2004] Middle East expert Juan Cole suggests both accounts have merit. In the hours after the August 1 terror alert that was based on information secured from Khan’s computer, reporters scramble to determine the source of the alert. One reporter learns of the Khan arrest from a CIA analyst, though the analyst refuses to give out any names. Cole believes that New York Times reporter David Rohde then acquires Khan’s name from his Pakistani sources and confirms it through US sources at the Department of Homeland Security. [Antiwar.com, 8/19/2004] Khan, an al-Qaeda computer expert, was arrested in Pakistan on July 13 and quickly began cooperating with investigators. He started sending e-mails to other operatives around the world and asked them to report back in. As they replied, investigators began tracing their locations. But Khan’s name is revealed before his computer contacts could be fully exploited. Many al-Qaeda members, including some suspected plotters planning strikes on US targets, escape arrest because of the outing. One Pakistani official says, “Let me say that this intelligence leak jeopardized our plan and some al-Qaeda suspects ran away.” [Associated Press, 8/10/2004; Suskind, 2006, pp. 325-326] Intelligence reports also indicate that the exposure of Khan makes al-Qaeda members more cautious in their electronic communications. Many cells abruptly move their hideouts, causing the US losing track of them. [Salon, 8/9/2004; Village Voice, 8/2/2005] Some are critical about the leak of Khan’s name:


    • Tim Ripley, a security expert who writes for Jane’s Defense publications, says, “The whole thing smacks of either incompetence or worse. You have to ask: what are they doing compromising a deep mole within al-Qaeda, when it’s so difficult to get these guys in there in the first place? It goes against all the rules of counter-espionage, counter-terrorism, running agents, and so forth. It’s not exactly cloak and dagger undercover work if it’s on the front pages every time there’s a development, is it?”
    • British Home Secretary David Blunkett is openly contemptuous of the White House’s management of the information. “In the United States there is often high-profile commentary followed, as in the current case, by detailed scrutiny, with the potential risk of ridicule. Is it really the job of a senior cabinet minister in charge of counter-terrorism to feed the media? To increase concern? Of course not. This is arrant nonsense.” [Salon, 8/9/2004]
    • Other high-level British officials are “dismayed by the nakedly political use made of recent intelligence breakthroughs both in the US and in Pakistan.” They complain that they had to act precipitously in arresting low-level al-Qaeda figures connected to Khan instead of using those suspects to ferret out more senior al-Qaeda figures. These officials are “dismayed by the nakedly political use made of recent intelligence breakthroughs both in the US and in Pakistan.” [New York Observer, 8/11/2004]
    • Senator Charles Schumer (D-NY) writes in a letter to Bush officials, “I respectfully request an explanation [about] who leaked this Mr. Khan’s name, for what reason it was leaked, and whether the British and Pakistani reports that this leak compromised future intelligence activity are accurate.” [Boston Globe, 8/10/2004]
    • Senator George Allen (R-VA) says, “In this situation, in my view, they should have kept their mouth shut and just said, ‘We have information, trust us’.” [Inter Press Service, 8/10/2004]
    • Middle East expert Juan Cole notes that the leak of Khan’s name forced the British to arrest 12 members of an al-Qaeda cell prematurely, allowing others to escape. “[T]his slip is a major screw-up that casts the gravest doubts on the competency of the administration to fight a war on terror. Either the motive was political calculation, or it was sheer stupidity. They don’t deserve to be in power either way.” [Daily Times (Lahore), 8/8/2004]
    • Salon’s Dale Davis says, “[S]adly, the damage [the Bush administration’s] machinations have caused to the goal of defeating al-Qaeda will be measured in the loss of the young American servicemen and women who carry the burden of their failed policies.” [Salon, 8/13/2004]
    Fall 2004
    At the request of Donald Rumsfeld, President George Bush issues an Executive Order on the Global War on Terrorism (GWOT) authorizing the military “to find and finish” terrorist targets, including certain al-Qaeda network members, al-Qaeda senior leadership, and other high-value targets.     September 27, 2004: Bush Says ‘Taliban No Longer Is in Existence’
    President Bush, campaigning for reelection, says in a speech, “And as a result of the United States military, Taliban no longer is in existence. And the people of Afghanistan are now free.” [White House, 9/27/2004]

    October 2004: Presidential Candidates Debate Tora Bora Battle; Evidence Supports Kerry’s Position
    In the 2004 presidential campaign, Democratic challenger Sen. John Kerry accuses the Bush administration of allowing bin Laden to escape Afghanistan in late 2001 by not sending enough US troops to contain him when he was trapped in the Tora Bora region. The New York Times publishes an op-ed by Gen. Tommy Franks, the former head of US Central Command. Franks writes, “On more than one occasion, Senator Kerry has referred to the fight at Tora Bora in Afghanistan during late 2001 as a missed opportunity for America. He claims that our forces had Osama bin Laden cornered and allowed him to escape. How did it happen? According to Mr. Kerry, we ‘outsourced’ the job to Afghan warlords. As commander of the allied forces in the Middle East, I was responsible for the operation at Tora Bora, and I can tell you that the senator’s understanding of events doesn’t square with reality.… We don’t know to this day whether Mr. bin Laden was at Tora Bora in December 2001. Some intelligence sources said he was; others indicated he was in Pakistan at the time; still others suggested he was in Kashmir. Tora Bora was teeming with Taliban and al-Qaeda operatives, many of whom were killed or captured, but Mr. bin Laden was never within our grasp.” Franks is a vocal supporter of Bush’s reelection. [New York Times, 10/19/2004] Shortly after Franks’ comments, four Knight Ridder reporters who had been at Tora Bora during the battle revisit the issue. They discover that “Franks and other top officials ignored warnings from their own and allied military and intelligence officers that the combination of precision bombing, special operations forces, and Afghan forces that had driven the Taliban from northern Afghanistan might not work in the heartland of the country’s dominant Pashtun tribe.” [Knight Ridder, 10/30/2004] Author Peter Bergen asserts, “There is plenty of evidence that bin Laden was at Tora Bora, and no evidence indicating that he was anywhere else at the time.” Bergen cites after-action US intelligence reports and interviews with US counterterrorism officials that express confidence bin Laden was at Tora Bora. He notes that bin Laden discussed his presence at the Tora Bora battle in a audio message released in 2003. [PeterBergen (.com), 10/28/2004] In 2005, Gary Bernsten, who was in charge of an on-the-ground CIA team trying to find bin Laden, will claim that he gave Franks definitive evidence that bin Laden was trapped in Tora Bora (see Late October-Early December 2001). [Financial Times, 1/3/2006] In 2006, former counterterrorism “tsar” Richard Clarke will comment, “Yes, we know [bin Laden] absolutely was there.… And yes, he did escape. And Gen. Franks and the president can deny it until the cows come home, but they made a mistake. They did let him go away.” [PBS Frontline, 6/20/2006] In late 2006, it will be reported that the CIA possesses a video showing bin Laden walking out of Afghanistan at the end of the Tora Bora battle. It has not been reported if the CIA was aware of this video in 2004 or not (see Mid-December 2001).

    October 12, 2004: Security Scholars: US Atrocities Increases Terrorism
    A group of more than 650 Western foreign affairs specialists, calling themselves “Security Scholars for a Sensible Foreign Policy,” write an “Open Letter to the American People,” which says: “American actions in Iraq, including but not limited to the scandal of Abu Ghraib, have harmed the reputation of the US in most parts of the Middle East and, according to polls, made Osama bin Laden more popular in some countries than is President Bush. This increased popularity makes it easier for al-Qaeda to raise money, attract recruits, and carry out its terrorist operations than would otherwise be the case.” [Anti-war (.com), 10/12/2004]

    October 25, 2004: Former President Jimmy Carter Says Bush Exploited 9/11 Attacks
    Former President Jimmy Carter (D) says in an interview, “President Bush has exploited the September 11, 2001, attacks for political gain.” He adds: “I think the basic reason is that our country suffered, in 9/11, a terrible and shocking attack… and George Bush has been adroit at exploiting that attack and he has elevated himself, in the consciousness of many Americans, to a heroic commander in chief, fighting a global threat against America. He’s repeatedly played that card, and to some degree quite successfully.” [Reuters, 10/25/2004]

    President Bush signs the 2004 Defense Authorization Act which contains a provision giving the Pentagon authority for US special operations to give cash, equipment and weapons to foreign fighters and groups who are willing to ally themselves with the US on certain military operations. Under the new piece of legislation, US Special Operations Command will have as much as $25 million a year to spend on supporting “foreign forces, irregular forces, groups or individuals.” Commenting on Congress’ generous appropriation, retired Army Gen. Wayne Downing tells the Associated Press, “For the kind of stuff they want to do—buy AK-47s, pick-up trucks, stuff like that—this is a lot of money. If they can slip someone $100,000 to buy information or buy support (from foreign individuals or groups), then that would be very useful.” Until now, these types of operations were restricted to the CIA—but only when authorized by a presidential directive. This new provision imposes no such restrictions on the Pentagon’s special operations. Some observers have expressed concern that this will lead to problems. They fear that special operations will end up funding and arming unsavory foreign elements that later turn against the US, as has happened on countless occasions during the last half-century. Others say the measure is part of Rumsfeld’s strategy to make the defense department more autonomous so its activities will not be subject to the oversight of other agencies.     October 29, 2004: National Security Council Principals Know Bush’s Ratings Go Up When Bin Laden Appears
    Several members of the National Security Council conclude that Osama bin Laden’s presence on the international stage is helping George Bush’s presidential campaign. (The CIA has apparently concluded the same (see October 29, 2004 and October 29, 2004).) Author Ron Suskind will write, “While the CIA glimpsed at the issue of bin Laden’s motivations and turned away, there were those who understood just how acutely this heated, global dialog—of ideas and message and the preservation of power, of us and them—was a two way street. On that score, any number of NSC principals could tell you something so dizzying that not even they will touch it: that Bush’s ratings track with bin Laden’s ratings in the Arab world. No one doubts that George Bush is earnest when he thinks of the victims of 9/11 and speaks of his longing to bring the culprits to justice. Yet he is an ambitious man, atop a nation of ambitious and complex desires, who knows that when the al-Qaeda leader displays his forceful presence, his own approval ratings rise, and vice versa.” [Suskind, 2006, pp. 336-7]

    October 29, 2004: CIA and Other Analysts Conclude Bin Laden’s Speech Favors Bush’s Reelection Chances
    he CIA analyzes bin Laden’s new speech, which was released four days before the US presidential election (see October 29, 2004), and concludes that it improves George Bush’s reelection chances. According to author Ron Suskind, the CIA, which has “spent years… parsing each word of the al-Qaeda leader,” knows that “bin Laden speaks only for strategic reasons—and those reasons are debated with often startling depth inside the organization’s leadership.” The analysts conclude that “bin Laden’s message was clearly designed to assist the president’s reelection.” Deputy Director John McLaughlin says in a meeting analyzing the speech, “Bin Laden certainly did a nice favor today for the president.” CIA deputy associate director Jami Miscik similarly comments, “Certainly, he would want Bush to keep doing what he’s doing for a few more years.” However, the CIA does not discuss why bin Laden wants Bush to stay. Suskind will write, “But an ocean of hard truths before them—such as what did it say about US policies that bin Laden would want Bush reelected—remained untouched.” CIA officer Rolf Mowatt-Larssen will later say: “It was sad. We just sat there. We were dispirited.” Several National Security Council members have already reached the conclusion that bin Laden’s presence on the international stage helps Bush (see October 29, 2004). Both presidential candidates condemn bin Laden. John Kerry says, “As Americans, we are absolutely united in our determination to hunt down and destroy Osama bin Laden.” George Bush says, “Americans will not be intimidated or influenced by an enemy of our country.” [Suskind, 2006, pp. 335-6] Several commentators believe the intervention will help Bush, for example:
    • Veteran journalist Walter Cronkite says, “I have a feeling that it could tilt the election a bit. In fact, I’m a little inclined to think that Karl Rove, the political manager at the White House, who is a very clever man, he probably set up bin Laden to this thing.” [CNN, 10/29/2004]
    • Roger Simon of US News and World Report says, “I don’t have any trouble parsing out who this helps. I think this is an enormous boost for George Bush.” [CNN, 10/29/2004]
    • MSNBC host Chris Matthews says, “The big thing in politics, of course, is picking the right topic… This creates a terrible situation for the challenger, because it seems to me that Karl Rove has his finger on this.” [MSNBC, 10/29/2004]
    • MSNBC correspondent Andrea Mitchell says, “It makes it harder for Kerry, and it shifts the subject matter back to what George Bush is strongest on. So the Bush people may not say that they are happy about this, but I’m sure that they could not be more pleased that this is the subject of the closing days. How do you say October surprise? This is one that could benefit the president.” [MSNBC, 10/29/2004]
    • CNBC co-host Lawrence Kudlow says, “It will play into Bush’s hands.… it falls into Bush’s lap. And unlike 2000, I think it’s the kind of thing that will cause the remaining undecided voters in the next 72 hours or so to break for Bush.” [MSNBC, 10/29/2004]
    • Weekly Standard staff writer Stephen Hayes says, “I think that, as most people have indicated, that is likely to help President Bush.” [MSNBC, 10/29/2004]
    Other commentators from across the political spectrum who suggest the speech will help Bush include Fox News correspondent Major Garrett, Boston Herald columnist Mike Barnicle, Time magazine correspondent Karen Tumulty, former plumber G. Gordon Liddy, former presidential candidate Pat Buchanan, MSNBC host Joe Scarborough, the Cook Political Report editor and publisher Charlie Cook, Washington Post journalist Jeffery Birnhaum, and Roll Call executive editor Morton Kondracke. [Fox News, 10/29/2004; Fox News, 10/29/2004; CNN, 10/29/2004; MSNBC, 10/29/2004; MSNBC, 10/29/2004] Some right wing commentators suggest that the tape will help Kerry, including Fox News political commentator Dick Morris, Weekly Standard executive editor Fred Barnes, Washington Times reporter Bill Gertz, Fox News host Sean Hannity, and author Peggy Noonan. [Fox News, 10/29/2004; Fox News, 10/29/2004; Fox News, 10/29/2004; Fox News, 10/29/2004] A Newsweek poll shows that Bush’s lead increases after the tape is released and, after the election, John Kerry, the losing Democratic candidate, will attribute his failure to bin Laden’s intervention: “We were rising in the polls until the last day the tape appeared. We flat-lined the day the tape appeared, and went down on Monday.” [Daily Telegraph, 11/1/2004; MSNBC, 1/30/2005] George Bush will also agree that the tape helped, saying, “I thought it was going to help. I thought it would help remind people that if bin Laden doesn’t want Bush to be the president, something must be right with Bush.” [Reuters, 3/1/2006]

    October 29, 2004: In Speech Released Just Prior to US Elections, Bin Laden Criticizes President Bush and Takes Credit for 9/11 Attacks for First Time
    Four days before the presidential election in the US, Osama bin Laden releases a new video in which he addresses the US people and alludes to his role in 9/11. The tape was handed to an employee at Al Jazeera’s bureau in Islamabad, Pakistan, on the day it was broadcast. [MSNBC, 10/30/2004] In his strongest admission yet that he was involved in planning 9/11, he says, “Allah knows that the plan of striking the towers had not occurred to us, but the idea came to me when things went just too far with the American-Israeli alliance’s oppression and atrocities against our people in Palestine and Lebanon.” After likening the US and Israel to “a crocodile devouring a child,” he continues, “As I looked at those destroyed towers in Lebanon, it occurred to me to punish the oppressor in kind by destroying towers in America, so that it would have a taste of its own medicine and would be prevented from killing our women and children.” He attempts to isolate the US from other Western countries, pointing out that “security is one of the pillars of human life” and that al-Qaeda has not attacked Sweden, for example, because Sweden has not attacked the Middle East: “If the US leaves Muslims alone, they will leave it alone.” He is critical of President Bush and his inaction on 9/11: “It did not occur to us that the Commander-in-Chief of the American armed forces would leave fifty thousand of his citizens in the two towers to face this great horror on their own, just when they needed him most. It seems that a little girl’s story about a goat and its butting was more important than dealing with airplanes and their butting into skyscrapers.” He comments that the Bush administration favors certain corporations and has mismanaged public funds: “To some analysts and diplomats, it seems as if we and the White House are on the same team shooting at the United States’ own goal, despite our different intentions.” He concludes, “I say unto you in truth that your security lies not in the hands of Kerry, Bush, or al-Qaeda. It lies in your own hands, and whichever state does not encroach on our security thereby ensures its own. Allah is our master; you have none. Peace be upon those who follow true guidance.” [Laden, 2005, pp. 237-244] Despite the criticism of Bush in the speech, most commentators think it will actually help Bush get reelected. For example, Time magazine correspondent Karen Tumulty says, “I find it hard to find any way that this helps John Kerry. What we’ve seen over and over and over again is that when terrorism is the topic, and when people are reminded of 9-11, Bush’s numbers go up.” [CNN, 10/29/2004] The CIA also concludes this is what bin Laden intended (see October 29, 2004).

    November 2004: Aggressive Afghan Counter-Narcotics Program Proposed and Ultimately Rejected
    Assistant Secretary of State Bobby Charles, who runs the State Department’s Bureau for International Narcotics and Law Enforcement Affairs (INL), has been growing increasingly concerned about the worsening drug crisis in Afghanistan. He starts warning his superiors that unless the problem is dealt with, it could “devour” the Afghan government. Charles pushes for a multi-faceted counter-narcotics program. One controversial aspect of his program would involve aggressive aerial spraying of Afghan poppy fields using a diluted solution of the pesticide known commercially as Roundup. To minimize Afghan opposition to the spraying, the program would be combined with an informational campaign asserting that the pesticide is safe and an aid package for alternative agricultural development. Further, the US military would begin counter-narcotics missions such as destroying drug labs. Secretary of State Colin Powell presents Charles’ program to President Bush and other top officials shortly after Bush’s reelection. Bush completely agrees with the program, even saying that he is determined not to “waste another American life on a narco-state.” However, Defense Secretary Rumsfeld is firmly opposed to the program and, as author James Risen notes, “Time and again in the Bush administration, Rumsfeld simply ignored decisions made by the president in front of his war cabinet, according to several senior administration officials.” One month later, with Powell losing power as he leaves the Bush administration, Rumsfeld decreases support for the program, effectively killing it. Charles is told that he is now “highly inconvenient” and is pushed out of his job by the new Secretary of State Condoleezza Rice in early 2005. [Risen, 2006, pp. 152-162]

    November 2, 2004: George W. Bush Reelected
    President George W. Bush and Vice President Dick Cheney are re-elected to the US presidency for a second term. In the coming months, some important cabinet officials are replaced. Secretary of State Colin Powell resigns. Condoleezza Rice moves from National Security Adviser to Secretary of State. Her Deputy National Security Adviser Steven Hadley becomes the new National Security Adviser. Attorney General John Ashcroft resigns and is replaced by Alberto Gonzalez. Department of Homeland Security Director Tom Ridge resigns and is replaced by Michael Chertoff.

    November 8, 2004: US District Judge Rules that Guantanamo Hearings for Hamdan Unlawful; Halts Hearing
    US District Judge James Robertson rules that the Combatant Status Review Tribunal being held at the Guantanamo base in Cuba to determine the status of detainee Salim Ahmed Hamdan is unlawful and cannot continue. At the time of the decision, Hamdan is before the Guantanamo military commission. [Washington Post, 11/9/2004; USA Today, 11/9/2004] Robertson, in his 45-page opinion, says the government should have conducted special hearings to determine whether detainees qualified for prisoner-of-war protections under the Geneva Conventions at the time of capture. [USA Today, 11/9/2004] He says that the Bush administration violated the Geneva Conventions when it designated prisoners as enemy combatants, denied them POW protections, and sent them to Guantanamo. [Boston Globe, 11/9/2004] The Combatant Status Review Tribunals that are currently being held in response to a recent Supreme Court decision (see June 28, 2004) are inadequate, Robertson says, because their purpose is to determine whether detainees are enemy combatants, not POWs, as required by the Third Geneva Convention. [USA Today, 11/9/2004] Robertson also rejects the administration’s claim that the courts must defer to the president in a time of war. “The president is not a ‘tribunal,’” the judge says. [USA Today, 11/9/2004] Clinton appointee Robertson thus squarely opposes both the president’s military order of November 13, 2001 (see November 13, 2001) establishing the possibility of trial by military tribunal, and his executive order of February 7, 2002 (see February 7, 2002) declaring that the Geneva Conventions do not to apply to Taliban and al-Qaeda prisoners. “The government has asserted a position starkly different from the positions and behavior of the United States in previous conflicts,” Robertson writes, “one that can only weaken the United States’ own ability to demand application of the Geneva Conventions to Americans captured during armed conflicts abroad.” [USA Today, 11/9/2004; Washington Post, 11/9/2004; Boston Globe, 11/9/2004] Robertson orders that until the government conducts a hearing for Hamdan before a competent tribunal in accordance with the Third Geneva Conventions, he can only be tried in courts-martial, according to the same long-established military rules that apply to trials for US soldiers. [Washington Post, 11/9/2004; Boston Globe, 11/9/2004] Robertson’s ruling is the first by a federal judge to assert that the commissions are illegal. [Washington Post, 11/9/2004] Anthony D. Romero, director of the American Civil Liberties Union; Eugene R. Fidell, president of the National Institute of Military Justice; and Michael Ratner, president of the Center for Constitutional Rights, all applaud Robertson’s ruling. [Boston Globe, 11/9/2004] The Bush administration refutes the court’s ruling and announces its intention to submit a request to a higher court for an emergency stay and reversal of the decision. “We vigorously disagree.… The judge has put terrorism on the same legal footing as legitimate methods of waging war,” Justice Department spokesman Mark Corallo says. “The Constitution entrusts to the president the responsibility to safeguard the nation’s security.     President George Bush issues a presidential directive establishing an interagency group to consider whether it “would best serve the nation” to give the Pentagon complete control over the CIA’s elite paramilitary units. [Associated Press, 11/22/2004; New York Times, 11/23/2004; New Yorker, 1/24/2005 Sources: unnamed pentagon consultant] The units carry out the government’s most sensitive covert operations including “training rebel forces; destabilizing governments and organizations through violence; and directly attacking enemy targets and individuals.” [Associated Press, 11/22/2004] CIA paramilitary activities are conducted under presidential directives called “findings.” [New York Times, 11/23/2004] The panel will consist of representatives from the State and Justice Departments, the Pentagon, and the CIA. Critics of the proposal, including veteran members of special operations branches, note that CIA units operate “under a different set of findings and carry different legal protections than the military, in particular for cases in which they are ordered to conduct the most extreme clandestine operations,” the New York Times reports. Other critics say the move, which is based on a recommendation by the 911 Commission, is part of a Pentagon strategy to wrest control of covert operations from the CIA. Thomas W. O’Connell, the assistant defense secretary for special operations and low-intensity conflict, denies this, telling the New York Times, “I have heard it said that there is a conspiracy within the Department of Defense to go and rip off the agency’s capabilities, and I can assure you that nothing could be further from the truth.” [New York Times, 11/23/2004] However, former CIA officers tell investigative reporter Seymour Hersh a few months later that they believe otherwise.     Intelligence Brief, a newsletter published by former CIA officers Vince Cannistraro and Philip Giraldi, reports that the White House has given the Pentagon permission “to operate unilaterally in a number of countries where there is a perception of a clear and evident terrorist threat,” including Algeria, Sudan, Yemen, Syria, Malaysia, [New Yorker, 1/24/2005] and Tunisia. [New Yorker, 1/24/2005 Sources: unnamed former high-level intelligence official interviewed by Seymour Hersh] The operations’ chain of command will include Donald Rumsfeld and two of his deputies, Stephen Cambone, the undersecretary of defense for intelligence, and Army Lieutenant General William G. (Jerry) Boykin. Under these new arrangements, “US military operatives would be permitted to pose abroad as corrupt foreign businessmen seeking to buy contraband items that could be used in nuclear-weapons systems,” New Yorker magazine reports. “In some cases, according to the Pentagon advisers, local citizens could be recruited and asked to join up with guerrillas or terrorists. This could potentially involve organizing and carrying out combat operations, or even terrorist activities.” Describing how the operations would be conducted, Seymour Hersh of the New Yorker reports: “The new rules will enable the Special Forces community to set up what it calls ‘action teams’ in the target countries overseas which can be used to find and eliminate terrorist organizations. ‘Do you remember the right-wing execution squads in El Salvador?’… [a] former high-level intelligence official asked me…. ‘We founded them and we financed them,’ he said. ‘The objective now is to recruit locals in any area we want. And we aren’t going to tell Congress about it.’ A former military officer, who has knowledge of the Pentagon’s commando capabilities, said, ‘We’re going to be riding with the bad boys.’” [New Yorker, 1/24/2005]

    (December 2004): President Bush Asks the King of Jordan to Pardon Ahmed Chalabi for Role in Petra Bank Collapse
    President Bush reportedly asks King Abdulla of Jordan to pardon Ahmed Chalabi for his role in the 1989 collapse of Petra Bank (see August 2, 1989). In 1992, a military court found Chalabi guilty on 31 counts of embezzlement and other charges, sentencing him to 22 years of hard labor and ordering him to return $230 million in embezzled funds (see April 9, 1992). According to Seymour Hersh, the king is “stunned” by the request. “How can he pardon Chalabi after what he had done?” Hersh asks. “The money he stole was from old women and children… and he was reviled.” [Democracy Now!, 5/11/2005]

    December 8, 2004
    President Bush signs into law the 2005 Consolidated Appropriations Act 2005 setting a $338 billion budget for “Foreign Operations, Export Financing, and Related Programs.” Section 574 of the Act (see August 2, 2002) blocks the distribution of economic aid to countries that are party to the Rome Statute (see July 17, 1998) and have not signed “Article 98” agreements (see August 2002-July 1, 2003) with the US. The provision states: “None of the funds made available in this Act in title II under the heading `Economic Support Fund’ may be used to provide assistance to the government of a country that is a party to the International Criminal Court and has not entered into an agreement with the United States pursuant to Article 98 of the Rome Statute preventing the International Criminal Court from proceeding against United States personnel present in such country.” [Washington Post, 11/26/2002; US Congress, 11/20/2004; Seattle Post-Intelligencer, 12/3/2004]

    2005: Bush Surprised by Small Number of CIA Hunting Bin Laden, but Problem Not Fixed
    In 2005, the CIA gives President Bush a secret slide show updating him on the hunt for bin Laden. Bush is taken aback by the small number of CIA case officers posted to Afghanistan and Pakistan. A former intelligence officer will later tell Newsweek that Bush asks, “Is that all there are?” In fact, the CIA had recently doubled the number of officers in the area, but many are inexperienced and raw recruits. Most veteran officers are involved in the Iraq war instead. [Newsweek, 8/28/2007] However, rather than increase the staff working on bin Laden in response to Bush’s complaint, later in the year the CIA will close Alec Station, the unit hunting bin Laden (see Late 2005).

    2005: FISA Judge Complains of Illegal Evidence Being Used to Secure Wiretapping Warrants
    Judge Colleen Kollar-Kotelly, the presiding judge over the Foreign Intelligence Surveillance Court (FISC), warns the Justice Department that if it does not stop using evidence collected with warrantless wiretaps to obtain warrants to continue surveillance, her court will be more reluctant to grant warrants for surveillance. Kollar-Kotelly has complained about this before (see 2004). Though both Kollar-Kotelly and her predecessor, Judge Royce Lambeth, express concerns to senior officials that Bush’s warrantless wiretapping program is inherently unconstitutional, neither judge feels that they have the authority to rule on the president’s power to order such surveillance. Instead, they work to preserve the integrity of the FISA process. Eventually, the judges reach a compromise with government lawyers: any case using evidence from warrantless wiretaps that is to be presented to the judges for FISA warrants to continue monitoring the same suspects will be “tagged,” and that evidence will not be used to obtain warrants. Those cases, numbering less than ten a year, are to be presented only to the presiding judge. Lambeth and Kollar-Kotelly both feel that the process will work primarily because of the trust they have developed in James Baker, the Justice Department’s liason to FISC. Part of the problem stems from contradictory statements and claims from the administration; after the wiretapping program began (see September 13, 2001, NSA chief Michael Hayden and then-Attorney General John Ashcroft made it clear in private meetings with the judges that President Bush wanted to gain all possible information on any potential terrorist attacks, and that such information-gathering must by necessity go beyond the FISA court’s probable-cause requirement. But more recent assertions by Hayden and Ashcroft’s successor, Alberto Gonzales (see December 19, 2005, claiming that NSA analysts do not listen to domestic calls unless they already have some evidence that one of the parties to the call has links to terrorism, contradict earlier administration claims to the judges. Kollar-Kotelly suspects that the entire truth of the matter is not being presented to her and the FISC. Her suspicions are validated when her court is, in spite of administration reassurances, again presented with warrant applications based on illegally obtained evidence (see Late 2005).     January 7, 2005: Still-Classified Report Is Said to Blame CIA Leaders For 9/11 Failures, But There Are Pressures to Water It Down
    Details of an internal CIA report (see June-November 2004) investigating the CIA’s failure to stop the 9/11 attacks are leaked to the New York Times. The report by John Helgerson, the CIA’s inspector general, was completed in June 2004 but remains classified (see June-November 2004). It sharply criticizes former CIA Director George Tenet, as well as former Deputy Director of Operations James Pavitt. It says these two and others failed to meet an acceptable standard of performance, and recommends that an internal review board review their conduct for possible disciplinary action. Cofer Black, head of the CIA’s Counter Terrorism Center at the time of 9/11, is also criticized. However, the New York Times notes that, “It is not clear whether either the agency or the White House has the appetite to reprimand Mr. Tenet, Mr. Pavitt or others.… particularly since President Bush awarded a Medal of Freedom to Mr. Tenet last month.” It is unclear if any reprimands will occur, or even if the final version of the report will point blame at specific individuals. [New York Times, 1/7/2005] In late October 2004, the new CIA Director, Porter Goss, had asked Helgerson to modify the report to avoid drawing conclusions about whether individual CIA officers should be held accountable. [New York Times, 11/2/2004] Helgerson “appears to have accepted [Goss’s] recommendation” and will defer any final judgments to a CIA Accountability Review Board. The final version of the report is said to be completed within weeks. [New York Times, 1/7/2005] However, months pass, and in October 2005, CIA Director Porter Goss will announce that he is not going to release the report, and also will not convene an accountability board to hold anyone responsible.(see October 10, 2005)

    February 7, 2005: Bush Administration Proposes 6 Percent Cut to FEMA’s Emergency Management Performance Grant Program
    The Bush administration’s fiscal year 2006 budget request includes a six percent reduction in funding for Emergency Management Performance Grants. The cut would reduce the $180 million appropriated by Congress in 2005 to $170 million in 2006. “The grants are the lifeblood for local programs and, in some cases, it’s the difference between having a program in a county and not,” says Dewayne West, the director of Emergency Services for Johnston County, North Carolina, and president of the International Association of Emergency Managers. “It’s awfully difficult. More money is needed.” The White House however insists it is unfair to say Bush’s budget for the performance grants are a “cut,” because it was Congress, not the White House, that had increased the program’s budget in 2005 to $180 million. [Reuters, 9/17/2005]

    February 17, 2005: Bush Nominates Negroponte to Oversee US Intelligence Agencies
    President Bush nominates John Negroponte to be the first Director of National Intelligence, a new position created to oversee all the various US intelligence agencies. Negroponte had been serving as the US Ambassador to Iraq for the previous year. Prior to that he had been the US Ambassador to the United Nations and held a variety of other government positions. [New York Times, 2/17/2005] The nomination is controversial because, as the Los Angeles Times reports, “While ambassador to Honduras from 1981-85, Negroponte directed the secret arming of Nicaragua’s Contra rebels and is accused by human rights groups of overlooking—if not overseeing—a CIA-backed Honduran death squad during his tenure.” Additionally, “He also helped orchestrate a secret deal later known as Iran-Contra to send arms through Honduras to help the Contras overthrow the Sandinista government.” [Los Angeles Times, 3/26/2001]

    Sam Seder, hosting Air America’s Randi Rhodes show, interviews Scott Ritter about statements he made at Olympia’s Capitol Theater three days earlier (see February 18, 2005). Responding to a question about possible US military air strikes on Iran, Ritter says: “I have sources, which are unimpeachable, which I would not state who they are, who told me in October of 2004 that the president had been briefed on military strike options against Iran that were to commence in June of 2005. And that the president signed off on these plans.” [Air America Radio, 2/21/2005]

    February 22, 2005
    During a news conference with European Union leaders in Brussels, President Bush says that rumors suggesting the US is preparing to strike Iran are “simply ridiculous.” But he quickly adds that “all options are on the table.” [Reuters, 2/22/2005; CBS News, 2/22/2005]

    March 7, 2005: President Bush Appoints John Bolton as Ambassador to UN
    President George Bush selects John Bolton, currently an official in the State Department, to be the US ambassador to the UN. Bolton is a staunch neoconservative with a long record of opposing multilateral efforts. As undersecretary of state for arms control, Bolton opposed a multilateral effort in July 2001 to create broad worldwide controls on the sale of small arms (see July 9, 2001). In February 2002, Bolton made it clear that the Bush administration did not feel bound to the 1978 pledge not to use nuclear weapons against non-nuclear states (see February 2002). Bolton was also a strong advocate of taking unilateral action against Saddam Hussein (see January 26, 1998) and in May 2002, he effectively removed the US signature from the Rome Statute, which established the International Criminal Court (ICC) (see May 6, 2002).     May 24, 2005: US to Have Long-Term Military Presence in Afghanistan
    President Bush and Afghanistan’s President Hamid Karzai sign a “strategic partnership” allowing the US to have a long-term military presence in Afghanistan. The US is allowed to have access to existing military bases and potentially new bases as well. [Agence France-Presse, 5/24/2005] Both the US and Afghanistan government try to avoid talk of permanent US military bases in Afghanistan, because the idea is highly unpopular with the Afghan population. There are about 18,000 foreign troops in the country, half of them American. There also is a NATO-led force of 8,500 peacekeepers in the capital of Kabul. [Reuters, 4/26/2005] Asia Times reports that the US is constructing new military bases in the country, and in fact began work in February 2005. The bases “can be used in due time as a springboard to assert a presence far beyond Afghanistan.” The largest US air base is Afghanistan is located only about 50 miles from the border with Iran, “a location that makes it controversial.” [Asia Times, 3/30/2005]

    June 7, 2005: Reporter Asks Bush and Blair if Pre-War Intelligence Was ‘Fixed’; Bush Avoids Answering Question
    During a joint press conference with President Bush and British Prime Minister Tony Blair, a Reuters reporter asks both leaders whether comments made by Sir Richard Dearlove, recorded in the minutes of a July 23 British cabinet meeting (see July 23, 2002), were accurate. According to the minutes, Dearlove said that the “intelligence and the facts were being fixed around the policy [of regime change].” Responding to the question, Blair insists that the facts were not fixed “in any shape or form at all.” Bush’s response, however, does not answer the question. Instead, he addresses another issue that was raised by the Downing Street minutes. The minutes, along with several other recently published Downing Street documents, called into question the Bush administration’s claim that the decision to use military force against Iraq did not take place until shortly before the invasion began. In his response to the reporter’s question, Bush chooses to discuss this issue instead. “And somebody said, ‘Well, you know, we had made up our mind to go to use military force to deal with Saddam.’ There’s nothing farther from the truth… [Saddam Hussein] made the decision.” Significantly, neither Bush nor Blair, in their responses, attempt to challenge the authenticity of the memo. [New York Times, 6/8/2005; US President, 6/13/2005]

    July 22, 2005: Former Louisiana Governors and Senators Urge Bush to Support Energy Bill Revenue Sharing Provision
    Several prominent former Louisiana politicians sign a letter urging President Bush to support the 2005 Energy Policy Act (HR 6)‘s provisions for revenue sharing (see April 21, 2005) (see June 28, 2005). Endorsed by former Governors Mike Foster (R), Buddy Roemer (R), David Treen (R) and former Senators John Breaux (D) and J. Bennett Johnston (D), the letter states: “Louisiana puts an average of $5 billion each year into the Federal treasury from revenues produced off its shore. Energy Bill provisions that would give a meaningful share of those revenues through direct payments to Louisiana and other coastal states that host so much of the nation’s energy production are critical.” [Associated Press, 7/22/2005; Louisiana, 7/22/2005]

    July 28, 2005: Blanco Invites Bush and Energy Secretary to See Louisiana’s Coastal Erosion Problem
    In a letter to President Bush, Louisiana Governor Kathleen Blanco urges the president and his energy secretary, Samuel W. Bodman, to visit the Louisiana coast and see first-hand the deteriorating condition of the state’s coastal wetlands. She wants the administration to reconsider its objection (see July 15, 2004) to a provision in the House (see April 21, 2005) and Senate (see June 28, 2005) versions of the 2005 Energy Policy Act (HR 6) that would channel oil and gas royalties from offshore operations to coastal states for coastal wetland restoration. In her letter, she emphasizes how Louisiana’s disappearing wetlands is making the oil and gas industry’s vast network of pipelines increasingly vulnerable to damage. She also stresses that coastal wetlands have historically protected the coast from the full fury of hurricanes and, without this barrier, a major hurricane could devastate low-elevation coastal communities like New Orleans. “Let me show you the fragile wetlands that are the only protection for the thousands of miles of pipelines that connect this nation to 80 percent of its offshore energy supply and to a full third of all its oil and gas, both foreign and domestic. The vulnerability of those protective wetlands is all the more apparent to our two million coastal zone residents during this active hurricane season.” [Louisiana, 7/20/2005; Houma Today, 7/21/2005]

    August 13, 2005: President Bush Changes Vacation Venues
    President Bush, who has been on vacation for the month of August, changes venues, traveling to Idaho for more biking and fishing. As he noted 10 days ago during a bike ride with journalists at his Crawford ranch, “I think the people want the president to be in a position to make good, crisp decisions and to stay healthy… .     President Bush declares that a major disaster exists in Louisiana, releasing federal aid to supplement state and local recovery efforts in the area struck by Tropical Storm Cindy on July 5-6, 2005. [White House, 8/23/2005] Louisiana Governor Blanco had declared a state of emergency in light of Tropical Storm Cindy on July 6, 2005. [Louisiana, 7/6/2005]

    August 27, 2005: Several White House Officials Enjoy Vacation
    As Katrina barrels towards the Gulf Coast, most of the top White House staff members are on vacation, taking advantage of President Bush’s five-week vacation at his Crawford, Texas ranch. Andrew Card, White House Chief of Staff, and a veteran crisis manager who managed the federal response to hurricanes under George H.W. Bush, is vacationing at his lakefront summer home in Maine. Vice President Dick Cheney is vacationing at his Wyoming ranch. Frances Townsend, the White House Homeland Security Advisor who reports to Bush on Homeland Security policy and combating terrorism matters, is vacationing as well. After Katrina sweeps through the Gulf Coast, she will attend several meetings in Washington, before leaving on a previously scheduled trip to Saudi Arabia where she will work on joint counterterrorism projects. Bush will urge Townsend to make the trip despite the unfolding Katrina disaster as a “signal to… the enemy” that the hurricane has not distracted Bush’s attention from terrorists, according to one report. Later, White House representatives will decline to identify the person in charge of preparing for the hurricane in Washington, maintaining that Bush and his aides can run the government just as well from their summer homes. “Andy Card is the chief of staff, and he was in close contact with everyone,” White House Press Secretary Scott McClellan will say at one point. “And the president is the one who’s in charge at the White House.” [Los Angeles Times, 9/11/2005] On Tuesday, August 30, when asked to identify the person leading the White House’s response to Katrina, McClellan will reply that Joe Hagin, Deputy Chief of staff is the “point person in terms of overseeing efforts from the White House.” [White House, 8/30/2005]

    Early Morning August 27, 2005: Louisiana Governor Asks President Bush to Declare an Emergency For Louisiana
    Louisiana Governor Blanco, determining that the storm will be so big that state and local governments will not be able to handle it, asks President Bush to declare a state of emergency. The exact timing of Blanco’s letter is unclear. The PDF version of the letter is dated August 28. [Louisiana, 8/28/2005 pdf file] However, the Federal News dateline for the letter is 4:27 am EDT August 27. [Federal News Service, 8/27/2005] Governor Blanco’s office and the Times-Picayune will publish the full text of the letter today. [Louisiana, 8/27/2005; Walker, 8/27/2005]

    (Midday) August 27, 2005: President Bush Declares Emergency in Louisiana
    President Bush declares an emergency for Louisiana, and orders federal aid to supplement state and local response efforts in the affected area. This declaration activates the National Response Plan, and authorizes FEMA to provide appropriate assistance for required emergency measures to save lives, protect property and public health and safety for parishes in the storm’s path and to minimize or avert the threat of a catastrophe in multiple parishes. Bush’s declaration authorizes FEMA to provide appropriate assistance for required emergency measures, including specifically, “[m]easures undertaken to preserve public health and safety and to eliminate threats to public or private property.” In response to this declaration, FEMA Director Michael Brown appoints William Lokey as the Federal Coordinating Officer for federal recovery operations in the affected area. [White House, 8/27/2005; US Department of Homeland Security, 9/7/2005] . As Governor Blanco will later note, this pre-impact declaration is extremely unusual. The last time a president issued a pre-impact declaration was when Hurricane Andrew was bearing down on Florida in 1992. [CNN, 8/27/2005] Note that while President Bush’s emergency declaration identifies 39 parishes, it does not identify the parishes in Katrina’s path, apparently due to a clerical error. [Knight Ridder, 9/11/2005] This omission has no practical effect, and a corrected declaration will be issued on Monday. [US Department of Homeland Security, 9/7/2005]
    Note 1 - Reuters will later incorrectly report that Bush appoints William Lokey as the Federal Coordinating Officer, and will imply that such action is somehow unusual. [Reuters, 9/15/2005] In fact, as reflected in the official Federal Register entry, and in the White House release, Brown appoints Lokey as the coordinating officer for Louisiana. This appointment is consistent with standard practice: For each declared emergency, a different (lower level) individual is appointed as the federal coordinating officer.

    Note 2 - Knight Ridder (and other news media) will later incorrectly report that Bush failed to trigger the federal government’s responsibility, and that it is not triggered until DHS Secretary Chertoff’s August 31 announcement that the Katrina disaster is an “Incident of National Significance.” [Knight Ridder, 9/11/2005; Knight Ridder, 9/15/2005] In fact, Bush’s declaration (a) effectively authorizes FEMA to provide a full and immediate federal response to the unfolding crisis, and (b) makes the crisis an “Incident of National Significance.” [US Department of Homeland Security, 12/2004] , at 7 (“Note that while all Presidentially declared disasters and emergencies under the Stafford Act are considered Incidents of National Significance, not all Incidents of National Significance necessarily result in disaster or emergency declarations under the Stafford Act.”); [US Department of Homeland Security, 9/7/2005] (granting FEMA full authority to respond to the emergency.) The strategy behind DHS Secretary Chertoff’s much ballyhooed—and inaccurate—August 31 announcement that his declaration triggers for the first time a coordinated federal response to states and localities overwhelmed by disaster remains unclear at this time.

    Afternoon August 27, 2005: President Considers Adjusting Schedule in Light of Katrina
    In a meeting with aides this afternoon, President Bush discusses the coming storm. Aides inform Bush that the evacuations are proceedings as planned, and that 11,000 National Guard troops will be in a position to respond to the emergency, according to a senior White House official. (The actual number in position will be less than half of this number, however.) Bush tells senior advisor Dan Bartlett that he may need to rearrange his schedule to add a trip to the Gulf Coast next week. [Washington Post, 9/11/2005]
