    3:55 p.m. September 11, 2001: Bush Said to Be at Undisclosed Location
    White House adviser Karen Hughes briefly speaks to the media and says President Bush is at an undisclosed location, taking part in a video conference. This is possibly the only in-person media appearance by any Bush administration official since the attacks and until a news conference by Defense Secretary Rumsfeld at 6:40 p.m. [CNN, 9/12/2001]

    (9:00 p.m.-10:00 p.m.) September 11, 2001: Bush Meets with Advisers, Declares War Without Barriers
    President Bush meets with his full National Security Council. According to journalist Bob Woodward, this meeting turns out to be “unwieldy.” So at 9:30 p.m., Bush follows it with a meeting with a smaller group of his most senior principal national security advisers in the Presidential Emergency Operations Center (PEOC) beneath the White House. Bush and his advisers have already decided bin Laden is behind the attacks. As the president later recalls, in these meetings, “That’s when we first got the indication… we’ve identified, we think it’s al-Qaeda.” He says the FBI now thinks that “it’s al-Qaeda, and we start to develop our plans to get them. I mean, there wasn’t any hesitation. We’re starting the process of coalition-building and how to get ‘em.” (According to other accounts, though, the CIA had informed Bush hours earlier that it was virtually certain al-Qaeda was to blame for the attacks (see (3:15 p.m.) September 11, 2001).) CIA Director George Tenet says that al-Qaeda and the Taliban in Afghanistan are essentially one and the same. Tenet says, “Tell the Taliban we’re finished with them.” [Sammon, 2002, pp. 133; Woodward, 2002, pp. 31-33; Washington Post, 1/27/2002] The president says, “I want you all to understand that we are at war and we will stay at war until this is done. Nothing else matters. Everything is available for the pursuit of this war. Any barriers in your way, they’re gone. Any money you need, you have it. This is our only agenda.” When, later in the discussion, Defense Secretary Donald Rumsfeld points out that international law only allows force to prevent future attacks and not for retribution, Bush yells, “No. I don’t care what the international lawyers say, we are going to kick some ass.” [Clarke, 2004, pp. 23-24] Bush will subsequently announce a new US doctrine of preemptive attack the following June (see June 1, 2002). [Time, 6/23/2002] During the meeting, the president refers to the present political situation as a “great opportunity” (see (Between 9:30 p.m. and 10:00 p.m.) September 11, 2001). By the time the meeting ends, it is after 10 p.m. [Sammon, 2002, pp. 133]

    9:53 p.m. September 11, 2001: Rumsfeld’s Assistant Notes Three 9/11 Hijackers Were Followed
    Stephen Cambone, the Principal Deputy Undersecretary of Defense for Policy, makes the following note for Defense Secretary Rumsfeld at an emergency policy meeting, “AA 77—3 indiv have been followed since Millennium + Cole. 1 guy is assoc of Cole bomber. 2 entered US in early July (2 of 3 pulled aside and interrogated?).” Although four of the subsequently alleged Flight 77 hijackers were known to the authorities in connection with terrorism before 9/11, it appears that the three referred to here as being followed are Nawaf Alhazmi, Khalid Almihdhar, and Salem Alhazmi, due to their ties to an al-Qaeda Malaysia summit around the Millennium (see January 5-8, 2000) and ties to the USS Cole bombing (see October 12, 2000). Nawaf Alhazmi and Khalid Almihdhar initially arrived in the US shortly before or after the Millennium plot was due to come to fruition (see November 1999 and January 15, 2000), even entering at Los Angeles Airport (LAX), a target of the plot. If the note is literally correct that some US authorities were following these three since the Millennium, this would contradict the 9/11 Commission’s position that the trail of the three was lost shortly after the Millennium. The comment that one of the hijackers is an associate of a Cole bomber could refer to photos the CIA had before 9/11 identifying Almihdhar standing next to Cole bomber Fahad al-Quso (see Early December 2000) or photos of him standing next to Cole bomber Khallad bin Attash (see January 4, 2001). The note’s mention that two of them entered the US in July is also accurate, as Salem Alhazmi entered the US on June 29 (see April 23-June 29, 2001) and Khalid re-entered on July 4 (see July 4, 2001).     September 12, 2001: Bush Meeting Raises Iraq Attack Possibility
    White House counterterrorism advisor Richard Clarke meets with Defense Secretary Donald Rumsfeld, President Bush, and Secretary of State Colin Powell. Rumsfeld suggests that the US should bomb Iraq in retaliation for the attacks on the World Trade Center and the Pentagon. “Rumsfeld was saying we needed to bomb Iraq,” Clarke will later recall in his book, Against All Enemies. “… We all said, ‘But no, no. Al-Qaeda is in Afghanistan,’ and Rumsfeld said, ‘There aren’t any good targets in Afghanistan and there are lots of good targets in Iraq.’” [Clarke, 2004; Reuters, 3/19/2004; Associated Press, 3/20/2004; CBS News, 3/21/2004; Washington Post, 3/22/2004 Sources: Richard A. Clarke] Powell agrees with Clarke that the immediate focus should be al-Qaeda. However, Powell also says, “Public opinion has to be prepared before a move against Iraq is possible.” Clarke complains to him, “Having been attacked by al-Qaeda, for us now to go bombing Iraq in response would be like our invading Mexico after the Japanese attacked us at Pearl Harbor.” President Bush notes the goal should be replacing the Iraqi government, not just bombing it, but the military warns an invasion would need a large force and many months to assemble. [Clarke, 2004] Rumsfeld’s view is said to be closely aligned with that of his deputy, Paul Wolfowitz, who believes Saddam, not Osama bin Laden or al-Qaeda, should be the principal target of the “war on terrorism.” [Woodward, 2002, pp. 49] Commenting on his feelings after the meeting, Clarke will later write: “At first I was incredulous that we were talking about something other than getting al-Qaeda.     September 15, 2001: Top Officials Meet at Camp David; Wolfowitz Suggests Striking Iraq
    George W. Bush, CIA Director George Tenet, Dick Cheney, Colin Powell, Donald Rumsfeld, Treasury Secretary Paul O’Neill, National Security Advisor Condoleezza Rice, FBI Director Robert S. Mueller III, Paul Wolfowitz, and perhaps other officials as well, meet at Camp David to discuss war plans in Afghanistan. The meeting reportedly begins at 9:30 AM with a prayer. [Washington Post, 1/31/2002; Vanity Fair, 5/2004, pp. 232] There is discussion on a paper submitted by the Defense Department depicting Iraq, the Taliban, and al-Qaeda as priority targets. Paul Wolfowitz pushes for regime change in Iraq, claiming that there is a 10 to 50 percent chance that Iraq was involved in the attacks. [Woodward, 2002, pp. 83; Vanity Fair, 5/2004, pp. 232; Washington Post, 7/23/2004] Wolfowitz will later recall in an interview with Vanity Fair: “On the surface of the debate it at least appeared to be about not whether but when. There seemed to be a kind of agreement that yes it should be, but the disagreement was whether it should be in the immediate response or whether you should concentrate simply on Afghanistan first. To the extent it was a debate about tactics and timing, the president clearly came down on the side of Afghanistan first. To the extent it was a debate about strategy and what the larger goal was, it is at least clear with 20/20 hindsight that the president came down on the side of the larger goal.” [Vanity Fair, 5/9/2003]

    Mid-September, 2001: Cheney and Rumsfeld Create ‘Cabal’ to Influence Foreign Policy
    Shortly after the 9/11 attacks, Vice President Dick Cheney, Defense Secretary Donald Rumsfeld, and Deputy Defense Secretary Paul Wolfowitz create a secretive, ad hoc intelligence bureau within the Pentagon that they mockingly dub “The Cabal.” This small but influential group of neoconservatives is tasked with driving US foreign policy and intelligence reporting towards the goal of promoting the invasion of Iraq. To this end, the group—which later is folded into the slightly more official Office of Special Plans (OSP) (see 2002-2003)—gathers and interprets raw intelligence data for itself, refusing the participation of the experts in the CIA and DIA, and reporting, massaging, manipulating, and sometimes falsifying that information to suit their ends. [New Yorker, 5/12/2003] In October 2005, Larry Wilkerson, who during 2001-2005 served as Secretary of State Colin Powell’s chief of staff, will say of the Cabal and the OSP, “What I saw was a cabal between the vice president of the United States, Richard Cheney, and the secretary of defense, Donald Rumsfeld, on critical issues that made decisions that the bureaucracy did not know were being made. Now it is paying the consequences of making those decisions in secret, but far more telling to me is America is paying the consequences.” [Financial Times, 10/20/2005] He also says, “[T]he case that I saw for four-plus years was a case that I have never seen in my studies of aberrations, bastardizations, and perturbations in the national-security [policy-making] process.” Wilkerson is particularly scathing in his assessment of the Pentagon’s supervisor of the OSP, Douglas Feith, one of the original members of the Cabal. Asked if he agrees with General Tommy Franks’s assessment of Feith as the “f*cking stupidest guy on the planet.” Wilkerson says, “Let me testify to that. He was. Seldom in my life have I met a dumber man. And yet, after the [Pentagon is given] control, at least in the immediate post-war period in Iraq, this man is put in charge. Not only is he put in charge, he is given carte blanche to tell the State Department to go screw themselves in a closet somewhere.…That’s telling you how decisions were made and…how things got accomplished.” [Inter Press Service, 10/20/2005] Wilkerson will note that the Cabal/OSP’s secret decision-making is responsible for errors such as the long refusal to engage with North Korea or to back European efforts on Iran, and caused strife with those excluded from the decisions. “If you’re not prepared to stop the feuding elements in the bureaucracy as they carry out your decisions, you are courting disaster. And I would say that we have courted disaster in Iraq, in North Korea, in Iran,” he will say.     September 17, 2001: Wolfowitz Sends Memo to Rumsfeld Suggesting Saddam Hussein Had a Role in 9/11
    Deputy Defense Secretary Paul Wolfowitz sends a memo to Donald Rumsfeld raising the possibility that Saddam Hussein played a role in the September 11 attacks. The memo, titled “Preventing More Events,” claims that there is more than a ten percent likelihood that Saddam Hussein was behind the attacks, and cites a recent book by AEI scholar Laurie Mylroie which argues that Iraq masterminded the 1993 bombing of the World Trade Center.     September 19, 2001: Rumsfeld Memo Emphasizes Global Nature of Conflict
    Defense Secretary Donald Rumsfeld writes a memo to Gen. Hugh Shelton, chairman of the Joint Chiefs of Staff, insisting that initial war plans should emphasize, among other things, the global nature of the conflict. [Washington Post, 8/7/2004]

    September 20, 2001: Douglas Feith Suggests Targeting a ‘Non-Al-Qaeda Target, Like Iraq’
    Douglas Feith suggests in a draft memo [Washington Post, 8/7/2004] that the US should consider “hitting terrorists outside the Middle East in the initial offensive, perhaps deliberately selecting a non-al-Qaeda target like Iraq.” Other regions he proposes attacking include South America and Southeast Asia. He reasons that an initial attack against such targets would “surprise… the terrorists” and catch them off guard. [9/11 Commission, 7/24/2004, pp. 277, 533; Newsweek, 8/8/2004] According to Newsweek, the content of Feith’s memo derives from the work of the Counter Terrorism Evaluation Group (see Shortly After September 11, 2001), a project headed by Michael Maloof and David Wurmser. The group suggested that an attack on the remote Triborder region, where Paraguay, Argentina, and Brazil meet and where Iranian-backed Hezbollah is said to have a presence, would have a ripple effect among international Islamic militant groups. [Newsweek, 8/8/2004] Feith later says his memo merely expands upon ideas put forth by Defense Secretary Donald Rumsfeld in a memo (see September 19, 2001) the secretary wrote the day before to Gen. Hugh Shelton, chairman of the Joint Chiefs of Staff. [Washington Post, 8/7/2004] The logic behind proposing strikes against targets outside of the Middle East, Feith says, was based on the need to “cast a wide net” and achieve “additional objectives,” such as creating fissures in the enemy network, highlighting “the global nature of the conflicts,” showing “seriousness of US military purpose,” and demonstrating that the “war would not be limited geographically to Afghanistan.” [Washington Post, 8/7/2004]

    October 2001: US Military Downplays Importance of Targeting Bin Laden
    On October 8, 2001, Gen. Tommy Franks, Central Command commander in chief, says of the war in Afghanistan, “We have not said that Osama bin Laden is a target of this effort. What we are about is the destruction of the al-Qaeda network, as well as the… Taliban that provide harbor to bin Laden and al-Qaeda.” [USA Today, 10/8/2001] Later in the month, Defense Secretary Donald Rumsfeld makes similar comments, “My attitude is that if [bin Laden] were gone tomorrow, the same problem would exist. He’s got a whole bunch of lieutenants who have been trained and they’ve got bank accounts all over some 50 or 60 countries. Would you want to stop him? Sure. Do we want to stop the rest of his lieutenants? You bet. But I don’t get up in the morning and say that is the end; the goal and the endpoint of this thing. I think that would be a big mistake.” [USA Today, 10/24/2001] One military expert will later note, “There appears to be a real disconnect between what the US military was engaged in trying to do during the battle for Tora Bora - which was to destroy al-Qaeda and the Taliban - and the earlier rhetoric of President Bush, which had focused on getting bin Laden.” [Christian Science Monitor, 3/4/2002] Joint Chiefs of Staff Chairman Richard Myers will make a similar comment in April 2002 (see April 4, 2002).     October 12, 2001: Rumsfeld Allegedly Says that Missile Hit Pentagon
    In an interview for Parade magazine Defense Secretary Donald Rumsfeld apparently says the Pentagon was hit by a missile. In the printed interview and a Defense Department website re-posting he is quoted as saying: “Here we’re talking about plastic knives and using an American Airlines flight filled with our citizens, and the missile to damage this building and similar (inaudible) that damaged the World Trade Center.” [U.S. Department of Defense, 10/12/2001] This will be taken by some who think the Pentagon was not hit by American Airlines Flight 77 (see Early March 2002) as an accidental admission of a missile strike. However, in 2004 Parade will say that a “transcription error led to the confusion, but conspiracy theorists latched onto Rumsfeld’s supposed admission and spread it over the Internet.” Although the transcription error is not specified, if the word “and” is replaced by the word “as” the statement becomes “[…] using an American Airlines flight filled with our citizens as the missile to damage this building.” [Parade Magazine, 9/4/2004]

    October 29, 2001: Rumsfeld Establishes Office of Force Transformation
    Defense Secretary Donald Rumsfeld announces the establishment of a new unit within the Office of the Secretary of Defense, called the Office of Force Transformation (OFT). Rumsfeld had called for the establishment of this office “as part of President Bush’s broad mandate to transform the Department of Defense. This transformation process challenges the organizational status quo with a new architecture for American defense in order to ensure an overwhelming and continuing competitive advantage for America’s military for decades to come.” He appoints retired Navy Vice Admiral Arthur Cebrowski—the former president of the Naval War College in Newport, Rhode Island—as its director. [US Department of Defense, 11/26/2001] Also recruited for this new department, as assistant for strategic futures, is Thomas Barnett, a senior strategic researcher at the Naval War College. As the “vision guy,” Barnett’s job is “to generate and deliver a compelling brief that would mobilize the Defense Department toward generating the future fighting force demanded by the post-9/11 strategic environment.” Barnett claims that, over time, senior military officials will come to cite his brief as “a Rosetta stone for the Bush Administration’s new national security strategy.” [Barnett, 2004, pp. 5-6] Prior to 9/11, Barnett was the director of a research partnership between the Naval War College and the Wall Street bond firm Cantor Fitzgerald, called the New Rule Sets Project (see May 1, 2000-June 4, 2001). Considering that the OFT is a personal initiative of the defense secretary, it is interesting that Rumsfeld was in the late 1990s one of the founders of the neoconservative think tank, Project for the New American Century (PNAC) (see June 3, 1997). [BBC, 8/25/2005; Washington Post, 6/12/2006; Federal Computer Week, 9/4/2006] In September 2000, PNAC published a strategy document called “Rebuilding America’s Defenses” (see September 2000). Among other things, this laid out the need to establish “four core missions” for US military forces, one of these being to “transform US forces to exploit the ‘revolution in military affairs.’” The OFT appears to be fulfilling this mission. However, the PNAC document had continued, “the process of transformation, even if it brings revolutionary change, is likely to be a long one, absent some catastrophic and catalyzing event—like a new Pearl Harbor.” [Project for the New American Century, 9/2000, pp. iv and 51 pdf file]

    Late October 2001
    White House lawyers have become impatient with the interagency group’s (see Before September 23, 2001) less than full endorsement of the use of military commissions to try suspected terrorists. By late October, Timothy E. Flanigan takes the task of designing a strategy for prosecuting terrorists away from the group and proceeds to focus on military commissions as the only preferable option. The White House lawyers now work more in secret, excluding many agencies and most of the government’s experts in military and international law, but together with the lawyers of the Office of Legal Counsel (OLC), with the intention of drafting a presidential military order. [New York Times, 10/24/2004] There is a remarkable secrecy surrounding the drafting process. Both Attorney General John D. Ashcroft and his deputy, Larry D. Thompson, are closely consulted. But the head of the Justice Department’s Criminal Division, Michael Chertoff is kept out of the loop. Secretary of Defense Donald H. Rumsfeld is informed through his general counsel, Williams J. Haynes II. Other Pentagon experts, however, are excluded. [New York Times, 10/24/2004] When the order is signed many expressed surprise. “That came like a bolt from the blue,” a former Pentagon official says. “Neither I nor anyone I knew had any insight, any advance knowledge, or any opportunity to comment on the president’s military order.” [Guardian, 6/9/2004] “I can’t tell you how compartmented things were,” retired Rear Adm. Donald J. Guter, the Navy’s Judge Advocate General, later recalls. “This was a closed administration.” [New York Times, 10/24/2004]

    November 13, 2001: Bush Authorizes Military Tribunals for Alleged Terrorists
    President Bush issues a 3-page executive order authorizing the creation of military commissions to try non-citizens alleged to be involved in international terrorism. The president will decide which defendants will be tried by military commissions. Defense Secretary Rumsfeld will appoint each panel and set its rules and procedures, including the level of proof needed for a conviction. A two-thirds vote is needed to convict a defendant and impose a sentence, including life imprisonment or death. Only the president or the secretary of defense has the authority to overturn a decision. There is no provision for an appeal to US civil courts, foreign courts, or international tribunals. Nor does the order specify how many judges are to preside on a tribunal or what qualifications they must have. [US Department of Defense, 11/13/2001; Washington Post, 11/14/2001; New York Times, 10/24/2004] The order also adopts a rule of evidence stemming from the 1942 Supreme Court case of United States v. Quirin that says evidence shall be admitted “as would… have probative value to a reasonable person.” This rule, according to Judge Evan J. Wallach, “was repeatedly used [in World War II and in the post-war tribunals] to admit evidence of a quality or obtained in a manner which would make it inadmissible under the rules of evidence in both courts of the United States or courts martial conducted by the armed forces of the United States.” [Wallach, 9/29/2004] Evidence derived from torture, for example, could theoretically be admitted. It should be noted that the order is unprecedented among presidential directives in that it takes away some individuals’ most basic rights, while claiming to have the power of law, with the US Congress not having been so much as consulted. During the next few years, lawyers will battle over the exact proceedings of the trials before military commissions, with many of the military lawyers arguing for more rights for the defendants and with Haynes, and the Justice and White House lawyers, Gonzales, Addington, and Flanigan, taking a more restrictive line. [New York Times, 10/24/2004] Both Rice and Powell were left outside of the circle during the drafting of this directive (see November 6, 2001) (see November 9, 2001). Rice is reportedly angry about not be informed. [New York Times, 10/24/2004]

    “The executive order violates separation of powers as the creation of military commissions has not been authorized by the Congress and is outside the president’s constitutional powers…. The broad application of the military commission order would be unconstitutional even if authorized by the Congress….The authorization of military detention of aliens inside the United States on the say-so of the president is also an unconstitutional end-run around the provisions of the USA Patriot Act….The Executive Order is an unconstitutional attempt to suspend the writ of habeas corpus….If Congress were to recognize a state of war and authorize the use of military commissions, such commissions must act in accord with both constitutional guarantees and international law.” — November 19, 2001 [Center for National Security Studies, 11/19/2001]

    November 14-25, 2001: US Secretly Authorizes Airlift of Pakistani and Taliban Fighters
    At the request of the Pakistani government, the US secretly allows rescue flights into the besieged Taliban stronghold of Kunduz, in Northern Afghanistan, to save Pakistanis fighting for the Taliban (and against US forces) and bring them back to Pakistan. Pakistan’s President “Musharraf won American support for the airlift by warning that the humiliation of losing hundreds—and perhaps thousands—of Pakistani Army men and intelligence operatives would jeopardize his political survival.” [New Yorker, 1/21/2002] Dozens of senior Pakistani military officers, including two generals, are flown out. [NOW with Bill Moyers, 2/21/2003] In addition, it is reported that the Pakistani government assists 50 trucks filled with foreign fighters to escape the town. [New York Times, 11/24/2001] Many news articles at the time suggest an airlift is occurring. [Independent, 11/16/2001; New York Times, 11/24/2001; BBC, 11/26/2001; Independent, 11/26/2001; Guardian, 11/27/2001; MSNBC, 11/29/2001] Significant media coverage fails to develop, however. The US and Pakistani governments deny the existence of the airlift. [US Department of State, 11/16/2001; New Yorker, 1/21/2002] On December 2, when asked to assure that the US did not allow such an airlift, Rumsfeld says, “Oh, you can be certain of that. We have not seen a single—to my knowledge, we have not seen a single airplane or helicopter go into Afghanistan in recent days or weeks and extract people and take them out of Afghanistan to any country, let alone Pakistan.” [MSNBC, 4/13/2003] Reporter Seymour Hersh believes that Rumsfeld must have given approval for the airlift. [NOW with Bill Moyers, 2/21/2003] However, The New Yorker magazine reports, “What was supposed to be a limited evacuation apparently slipped out of control and, as an unintended consequence, an unknown number of Taliban and al-Qaeda fighters managed to join in the exodus.” A CIA analyst says, “Many of the people they spirited away were in the Taliban leadership” who Pakistan wanted for future political negotiations. US intelligence was “supposed to have access to them, but it didn’t happen,” he says. According to Indian intelligence, airlifts grow particularly intense in the last three days before the city falls on November 25. Of the 8,000 remaining al-Qaeda, Pakistani, and Taliban, about 5,000 are airlifted out and 3,000 surrender.     When asked under what terms the US might be willing to accept a surrender from Taliban Leader Mullah Mohammed Omar, Rumsfeld reponds: “The United States is not inclined to negotiate surrenders, nor are we in a position, with relatively small numbers of forces on the ground, to accept prisoners.… Any idea that those people in that town who have been fighting so viciously and who refuse to surrender should end up in some sort of a negotiation which would allow them to leave the country and go off and destabilize other countries and engage in terrorist attacks on the United States is something that I would certainly do everything I could to prevent.     November 21, 2001: Bush Wants Iraq Invasion Plan
    George W. Bush and Donald Rumsfeld speak in private. Bush asks the Defense Secretary what kind of plan the Pentagon has for invading Iraq. “What have you got in terms of plans for Iraq? What is the status of the war plan? I want you to get on it. I want you to keep it secret,” Bush says. When Rumsfeld says its current plan is outdated, Bush instructs him to devise a new one. “Let’s get started on this,” Bush says. “And get Tommy Franks looking at what it would take to protect America by removing Saddam Hussein if we have to.” Bush requests that discussion about Iraq remain low-key. “I knew what would happen if people thought we were developing a potential war plan for Iraq,” Bush later explains to journalist Bob Woodward. Bush does not share the details of his conversation with Condoleezza Rice, only telling her that Rumsfeld will be working on Iraq.     Uzbek Northern Alliance leader General Abdul Rashid Dostum meets with Mullah Faizal, the Taliban commander in Kunduz, to discuss what should be done with the Taliban’s fanatical “foreign legion.” They agree that the 5000 Afghan Taliban fighters “would be given safe passage after surrender, but the foreign fighters would be handed over to General Dostum.” [Guardian, 11/27/2001; London Times, 11/28/2001] This is in line with orders from Washington, which has demanded that the foreign fighters not be freed. Top US officials, including Defense Secretary Donald Rumsfeld, have publicly opposed any plan that would allow the foreign Taliban troops to be freed in exchange for their surrender (see November 19, 2001).     November 27, 2001: Rumsfeld Tells Franks ‘to look at options for Iraq’
    At the request of President Bush (see November 21, 2001), Defense Secretary Donald Rumsfeld telephones Gen. Tommy Franks with instructions to work on war plans for Iraq. “General Franks, the president wants us to look at options for Iraq,” the general will later recall being told. In his memoirs, Franks will write: “‘Son of a bitch,’ I thought. ‘No rest for the weary.’” Franks will brief Bush on the progress of his work a month later (see December 28, 2001).     After a number of survivors are discovered in the basement of the Qala-i-Janghi fortress, Northern Alliance soldiers drop artillery rockets into the basement and detonate them by fuses. [Newsweek, 12/1/2001; CNN, 8/3/2002] Northern Alliance soldiers then redirect an irrigation stream into the basement of a one-story building in the Qala-i-Janghi fortress where surviving Taliban soldiers are, flooding it with freezing cold water. John Walker Lindh almost drowns and suffers from hypothermia.     December 2001: US General Tells Rumsfeld US Attacks in Iraq ‘No-Fly’ Zones Should Be Strategic
    US General Tommy Franks tells Defense Secretary Donald Rumsfeld that US planes patrolling the Iraq “no-fly” zones should begin “spurts of activity followed by periods of inactivity.” “We want the Iraqis to become accustomed to military expansion, and then apparent contraction,” he later recalls telling the secretary. “As Phase I is completed, we could flow steadily for the next sixty days, while continuing spikes of activity to lend credence to our deception.     Taliban survivors who have been holding out in the basement of a one-story building in the Qala-i-Janghi fortress surrender.     December 3-5, 2001
    As soon as he hears the news, Lindh’s father immediately hires James Brosnahan, a well-respected lawyer, on behalf of his son. On December 3, Brosnahan faxes a letter to Powell, Ashcroft, Rumsfeld, and CIA Director George Tenet. He introduces himself as Lindh’s lawyer, expressing his wish to see him, and stating: “Because he is wounded and, based upon press reports, went for three days without food, I would ask that any further interrogation be stopped, especially if there is any intent to use it in any subsequent legal proceedings.” When Brosnahan receives no reply, he writes again, “I would ask that no further interrogation of my client occur until I have the opportunity to speak with him. As an American citizen, he has the right to counsel and, under all applicable legal authorities, I ask for the right to speak with my client as soon as possible.” On December 5, still having received no reply, he urges that “we have a conversation today.” Again, no reply comes.     December 10, 2001: Pakistani Troops Start to Guard Tora Bora Border but Then Withdraw
    In November 2001, Pakistani President Pervez Musharraf promised to seal off the Pakistani side of the border near the Tora Bora region of Afghanistan in return for consierable US economic aid (see November 2001). But Musharraf spends two weeks negotiating with tribal chieftains on the border before starting the deployment. Around December 10, two brigades begin to take up positions along the border. [Christian Science Monitor, 3/4/2002; Newsweek, 8/11/2002] On December 11, Defense Secretary Donald Rumsfeld says of this border region, “It’s a long border. It’s a very complicated area to try to seal, and there’s just simply no way you can put a perfect cork in the bottle.” [Christian Science Monitor, 3/4/2002] But armed gunmen storm the Indian Parliament on December 13, and a group based in Pakistan and allied with al-Qaeda is blamed (see December 13, 2001). Tensions suddenly rise between India and Pakistan, and Musharraf halts troop deployments to the Afghan border. The border near Tora Bora still is not adequately guarded by Pakistan when the Tora Bora battle ends on December 17. Less than 100 stragglers entering Pakistan around December 19 are captured by Pakistani forces, but a number of these subsequently escape. [Newsweek, 8/11/2002]

    December 17, 2001
    US intelligence and Pentagon officials admit having lost track of Osama bin Laden in the Tora Bora area in the Northwest of Afghanistan. “The chatter stopped,” says John Stufflebeem. According to commanders of the Northern Alliance, as many as 500 al-Qaeda members might still be at large. [St. Petersburg Times, 12/18/2001] The same day, Rumsfeld says he has heard that there were 30 or 31 persons being held in custody around Tora Bora as of December 16. It is unclear whether any high-ranking al-Qaeda members are among them. Meanwhile, a detention center is being built at Kandahar. [Associated Press, 12/17/2001]

    December 27, 2001
    Rumsfeld makes a public announcement that he is planning to move Taliban and al-Qaeda suspects to the Guantanamo Bay Naval Station. The number of people in US custody and destined for Guantanamo is allegedly small. According to the Chairman of the Joint Chiefs of Staff, Air Force Gen. Richard B. Myers, they number eight individuals aboard the USS Peleliu and thrity-seven at a US base near Kandahar airport. [Dawn (Karachi), 12/28/2001] Troops, earlier stationed at nearby Camp Rhino, where Lindh was detained, are being transferred to Guantanamo. [GlobalSecurity (.org), 1/15/2005] The reason for choosing Guantanamo for detaining suspected al-Qaeda and Taliban members is unclear. Rumsfeld says, “I would characterize Guantanamo Bay, Cuba, as the least worst place we could have selected.     January 1, 2002: Rumsfeld Says He Is Not Concerned About Detainee Treatment
    In response to criticisms from the public, media, and human rights organizations concerning the treatment of detainees at Guantanamo, Defense Secretary Donald Rumsfeld remarks, “I do not feel the slightest concern at their treatment. They are being treated vastly better than they treated anybody else.” [BBC, 1/15/2002]

    January 8, 2002
    Congress receives an edited version of the Nuclear Posture Review (NPR), a comprehensive review laying “out the direction for American nuclear forces over the next five to ten years.” [US Department of Defense, 1/9/2002] Congress requested the review in September 2000. [Los Angeles Times, 3/9/2002] The classified document, signed by Donald Rumsfeld and now being used by the US Strategic Command to prepare a nuclear war plan, advocates that the US adopt a “New Triad” of weapon types for its strategic arsenal that would include an “offensive strike leg” (nuclear and conventional forces), “active and passive defenses” (anti-missile systems and other defenses) and “a responsive defense infrastructure” (ability to develop and produce nuclear weapons and resume nuclear testing). The new triad would replace the United States’ current triad of bombers, long-range land-based missiles and submarine-launched missiles. [US Department of Defense, 1/9/2002; Los Angeles Times, 3/9/2002; Los Angeles Times, 3/10/2002; Globe and Mail, 3/12/2002] The report asserts that the new strategy is necessary in order to assure “allies and friends,” “dissuade competitors,” “deter aggressors” like rogue states and terrorist organizations, and “defeat enemies.” [US Department of Defense, 1/9/2002; Globe and Mail, 3/12/2002] The review offers several possible scenarios where nuclear weapons might be used. For example, the document explains such weapons could be deployed to “pre-empt” the use of weapons of mass destruction against American or allied troops; in retaliation for an attack involving nuclear, biological, or chemical weapons; “in the event of surprising military developments;” or against targets that the US is incapable of destroying by conventional means, such as bunkers located deep underground. The NPR even names countries that could become targets of US nuclear weapons. For example, it says that they could be used against China, North Korea, Russia, Libya, Syria, Iraq, or any Arab country that threatens Israel. US Special Forces on the ground could be used to pin-point the targets and direct the weapon’s deployment.     January 11, 2002: First Prisoners Transferred to Guantanamo Bay
    Guantanamo receives its first twenty prisoners from the Afghan battlefield. [Reuters, 1/11/2002] It is reported that the prisoners are hooded, shackled, and possibly drugged during their flight to Cuba. [Guardian, 1/11/2002] Pictures of prisoners being transferred in conditions clearly in violation of international law are later leaked, prompting an outcry. But rather than investigating the inhumane transfer, the Pentagon begins investigating how the pictures were leaked. [Associated Press, 11/9/2002] The prisoners are sent to this base—leased by Cuba to the US—because it is on foreign territory and therefore beyond the jurisdiction of US law (see December 28, 2001). [Globe and Mail, 9/5/2002] Rumsfeld, acting on the advice of the Justice Department’s Office of Legal Counsel, publicly declares them “unlawful combatants” and thereby not entitled to the rights of the Geneva Conventions. “Unlawful combatants do not have any rights under the Geneva Convention,” Rumsfeld says. Though according to Rumsfeld, the government will “for the most part treat them in a manner that is reasonably consistent with the Geneva Conventions, to the extent they are appropriate.” [Reuters, 1/11/2002] There is no reason to feel sorry for these detainees, is Gen. Richard B. Myers’ message, chairman of the Joint Chiefs of Staff and the highest ranking military officer in the US.     Rumsfeld sends a memo to General Richard Myers informing him that Bush has declared the Geneva Conventions invalid with regard to conflicts with al-Qaeda and the Taliban (see January 18, 2002).     February 19, 2002: New York Times Breaks Story on Office of Strategic Influence
    The New York Times is the first to report that the Office of Strategic Influence, a secret Pentagon office established shortly after the September 11 attacks (see Shortly after September 11, 2001), is “developing plans to provide news items, possibly even false ones, to foreign media organizations as part of a new effort to influence public sentiment and policy makers in both friendly and unfriendly countries.” The article reports that many inside the government are opposed to these plans. “[S]everal senior officials have questioned whether its mission is too broad and possibly even illegal,” the Times says. “[T]hey are disturbed that a single office might be authorized to use not only covert operations like computer network attacks, psychological activities, and deception, but also the instruments and staff of the military’s globe—spanning public affairs apparatus.” Critics are also concerned that “disinformation planted in foreign media organizations, like Reuters or Agence France-Presse, could end up being published or broadcast by American news organizations.” [New York Times, 2/19/2002] The Washington Post similarly reports that discussions on the use of disinformation “have sparked widespread concern inside the Defense Department among officials who feel that the new office, by seeking to manipulate information and even knowingly dispense false information, could backfire and discredit official Pentagon statements.” [Washington Post, 2/25/2002] News of the Defense Department’s initiative causes an immediate public outcry and the Pentagon denies that it is considering plans to disseminate disinformation. “The Department of Defense, this secretary and the people that work with me tell the American people and the people of the world the truth,” Donald Rumsfeld insists.     February 20, 2002: Pentagon Office Designed for Telling Lies Revealed; Declared Closed
    The Pentagon announces the existence of the new Office of Strategic Influence (OSI), which “was quietly set up after September 11.” The role of this office is to plant false stories in the foreign press, phony e-mails from disguised addresses, and other covert activities to manipulate public opinion. The new office proves so controversial that it is declared closed six days later. [CNN, 2/20/2002; CNN, 2/26/2002] It is later reported that the “temporary” Office of Global Communications will be made permanent (it is unknown when this office began its work). This office seems to serve the same function as the earlier OSI, minus the covert manipulation. [Washington Post, 7/30/2002] Defense Secretary Rumsfeld later states that after the OSI was closed, “I went down that next day and said fine, if you want to savage this thing fine I’ll give you the corpse.     February 24, 2002: US General Visits Niger; Finds No Evidence that Uranium Could be Diverted to Iraq
    Four-Star Marine General Carlton W. Fulford Jr., deputy commander of the US European Command, arrives in Niger on a scheduled refueling stop. At the request of US Ambassador to Niger Barbro Owens-Kirkpatrick, Fulford joins the ambassador at a meeting with Niger’s President Mamadou Tandja and Foreign Minister Aichatou Mindaoudou. He explains the importance of keeping Niger’s ore deposits secure. At the meeting, President Tandja assures the ambassador and General Fulford that Niger is determined to keep its uranium “in safe hands.” [Washington Post, 7/15/2003; Voice of America, 7/15/2003; Vanity Fair, 5/2004, pp. 282; US Congress, 7/7/2004] After the meeting, Fulford is of the opinion that Niger’s uranium is securely under the control of a French consortium and that there is little risk that the material will end up in the wrong hands.     February 26, 2002: Rumsfeld Says Office of Strategic Influence Has Been Closed
    Secretary of Defense Donald Rumsfeld announces the closure of the Office of Strategic Influence (see Shortly after September 11, 2001), after news of the Pentagon initiative causes a public stir (see February 19, 2002). “The office has clearly been so damaged that it is pretty clear to me that it could not function effectively,” he tells reporters. “So it is being closed down.” Asked if he instructed Rumsfeld to close the office, President Bush says, “I didn’t even need to tell him this. He knows how I feel about this.” [New York Times, 2/27/2002] Nine months later, Defense Secretary Rumsfeld says that after the OSI was closed, “I went down that next day and said fine, if you want to savage this thing fine I’ll give you the corpse. There’s the name. You can have the name, but I’m gonna keep doing every single thing that needs to be done and I have.” [US Department of Defense, 11/18/2002]

    March 2002
    Retired Lieutenant-General Brent Scowcroft leads a presidential panel which proposes that control of the National Security Agency, the National Reconnaissance Office, and the National Imagery and Mapping Agency be transferred from the Department of Defense to the director of central intelligence (DCI). The plan is favored by the Congressional 911 joint inquiry but opposed by Donald Rumsfeld and Richard Cheney. For years experts have argued that the US intelligence community’s 13 disparate agencies— “85 percent of whose assets reside in the Defense Department” —should be consolidated under the DCI.     March 3, 2002: Powell Denies ISI Links to Daniel Pearl Murder
    Secretary of State Powell rules out any links between “elements of the ISI” and the murderers of reporter Daniel Pearl. [Dawn (Karachi), 3/3/2002] The Guardian later calls Powell’s comment “shocking,” given the overwhelming evidence that the main suspect, Saeed Sheikh, worked for the ISI. [Guardian, 4/5/2002] Defense Secretary Rumsfeld called Saeed a possible “asset” for the ISI only a week earlier. [London Times, 2/25/2002] The Washington Post says, “The [ISI] is a house of horrors waiting to break open. Saeed has tales to tell.” [Washington Post, 3/28/2002] The Guardian says Saeed “is widely believed in Pakistan to be an experienced ISI ‘asset.’” [Guardian, 4/5/2002]

    March 21, 2002
    Secretary of Defense Donald Rumsfeld signs Military Commission Order No. 1 prescribing the procedures of the military commission trials. The order says a two-third majority is required to determine a sentence and unanimity for applying the death penalty. But it fails to provide for the possibility of appeals. It also says evidence submitted before a commission “shall” be declared admissible if the presiding officer or a majority of the commission members consider that it “would have probative value to a reasonable person.” [US Department of Defense, 3/21/2002 pdf file] Thus, if the presiding member or a majority considers a statement made under any form of coercion to have some “probative value,” it “shall” be admitted. Professor Neil Katyal of Georgetown University later says this is a break with standard proceedings in civil courts and courts-martial and calls it “clearly at odds with American military justice.” [Los Angeles Times, 8/18/2004] Under the rules, the “Accused” is assigned a military officer to conduct his defense, but may select another officer. He may also retain a civilian attorney; however, only one who is vetted by the military. Unlike a military attorney, the civilian lawyer can be excluded from the trial if the presiding member of the commission decides to hold closed proceedings. This prompts Amnesty International to observe that the commissions “will restrict the right of defendants to choose their own counsel and to an effective defense.” [Amnesty International, 10/27/2004] Under the rules of the military commissions the military is allowed to monitor private conversations between defense lawyers and their clients. This violates, as Human Rights Watch remarks, “the fundamental notion of attorney-client confidentiality.” [Human Rights Watch, 1/9/2004] In a discussion of the new rules, Deputy Secretary of Defense Paul Wolfowitz, in an appearance on the PBS News Hours with Jim Lehrer, explains that the detainees being held in Guantanamo are “dangerous people, whether or not they go before a military commission.” He adds, “We’re dealing with a special breed of person here….” [PBS, 3/21/2002]

    April 17, 2002: Failure to Capture Bin Laden in Afghan War Is Called ‘Gravest Error’
    The Washington Post reports that, “The Bush administration has concluded that Osama bin Laden was present during the battle for Tora Bora late last year and that failure to commit US ground troops to hunt him was its gravest error in the war against al-Qaeda,” allowing bin Laden to escape. The newspaper claims that while the administration has failed to acknowledge the mistake publicly, “inside the government there is little controversy on the subject.” [Washington Post, 4/17/2002] The next day, Defense Secretary Rumsfeld denies this, and states he did not know at the time of the assault, “nor do I know today of any evidence that he was in Tora Bora at the time or that he left Tora Bora at the time or even where he is today.” [USA Today, 4/18/2002] Apparently, Rumsfeld soon forces the removal of Cofer Black from his position of head of the CIA’s counterterrorism division, because Rumsfeld thinks Black leaked information for this damning Washington Post article (see May 17, 2002).

    May 8, 2002: War in Afghanistan Called ‘All But Won’
    Brigadier Roger Lane, the commander of British forces in Afghanistan, says the war there against al-Qaeda and the Taliban is “all but won.” He claims that military operations will end in a matter of weeks rather than months. [BBC, 5/8/2002] In March 2003, Defense Secretary Donald Rumsfeld will announce that the Afghanistan war is over.(see May 1, 2003). But his pronouncement will be just as inaccurate as Lane’s. Al-Qaeda and Taliban forces will begin regrouping in Afghanistan in the autumn of 2002 (see Autumn 2002).

    May 17, 2002: CIA Counterterrorism Head Fired for Criticizing Failure to Capture Bin Laden
    It is announced that Cofer Black, head of the CIA’s counterterrorism division for the last three years, has been assigned to another position. However, in 2004, six anonymous US intelligence officials will claim that, in fact, Black is removed by Defense Secretary Donald Rumsfeld because Black publicly revealed details of the US military’s failure to capture or kill bin Laden in Tora Bora, Afghanistan, in late 2001. Sources will call Black “very aggressive, very knowledgeable,” in fighting al-Qaeda. According to these sources, after the Tora Bora battle ended, an intelligence analysis determined that bin Laden had been trapped in Tora Bora, and deemed his escape a “significant defeat” for the US. Rumsfeld, however, disagreed with the criticism, and said there was not enough “solid evidence” to come to that conclusion. Black then spoke on deep background to the Washington Post, and on April 17, 2002, the Post called the failure to capture bin Laden “the gravest error in the war against al-Qaeda.”(see April 17, 2002) Rumsfeld learned about Black’s role and used his influence to get him removed.     May 20-24, 2002: Flurry of Government Terrorist Warnings Given at Politically Suspicious Time
    The Bush administration issues a remarkable series of terror warnings that many believe are politically motivated. Vice President Cheney warns it is “not a matter of if, but when” al-Qaeda will next attack the US. [CNN, 5/20/2002] Homeland Security Director Tom Ridge says the same thing. Defense Secretary Rumsfeld says terrorists will “inevitably” obtain weapons of mass destruction. FBI Director Mueller says more suicide bombings are “inevitable.” [Washington Post, 5/22/2002] Authorities also issue separate warnings that al-Qaeda militants might target apartment buildings nationwide, banks, rail and transit systems, the Statue of Liberty, and the Brooklyn Bridge. USA Today titles an article, “Some Question Motives Behind Series of Alerts.” [USA Today, 5/24/2002] David Martin, CBS’s national security correspondent, says, “Right now they’re putting out all these warnings to change the subject from what was known prior to September 11 to what is known now.” It had been revealed the week before that Bush received a briefing in August 2001 entitled, “Bin Laden Determined to Strike in US” (see August 6, 2001). [Washington Post, 5/27/2002] Remarkably, even Press Secretary Ari Fleischer says the alerts were issued “as a result of all the controversy that took place last week.” [Washington Times, 5/22/2002; Village Voice, 5/23/2002] A retired CIA official reveals that the administration “made a political decision” to make any threat public, even those deemed to be hoaxes. In response to the alleged threat to New York, the former head of the FBI bureau there states that “there really isn’t any hard information.” [Rolling Stone, 9/21/2006 pdf file] Time notes, “Though uncorroborated and vague, the terror alerts were a political godsend for an administration trying to fend off a bruising bipartisan inquiry into its handling of the terrorist chatter last summer. After the wave of warnings, the Democratic clamor for an investigation into the government’s mistakes subsided.” [Time, 5/27/2002]

    Summer 2002: Rumsfeld: ‘I’m Going to Create My Own Intelligence Agency’
    Secretary of Defense Donald Rumsfeld invites a group of influential Washington lobbyists and consultants, including Haley Barbour and Vin Weber, to his office to discuss national security issues. At one point during the meeting he complains about the intelligence he is getting from the CIA and says, “I’m going to create my own intelligence agency.” Rumsfeld’s remark is likely a reference to the Office of Special Plans, which will be formally created in September (see September 2002) [Isikoff and Corn, 2006, pp. 107]

    June 9, 2002
    President Bush designates Padilla, who has been in custody since May 8 (see May 8, 2002), an “enemy combatant” on advice from Rumsfeld and Ashcroft, and directs Rumsfeld to see that he his taken into military custody. Padilla is taken to the Consolidated Naval Brig in Charleston, South Carolina sometime during the middle of that night. At the time of the transfer, Padilla was awaiting a judgment on a request made by his counsel to have the material witness warrant (see May 8, 2002) vacated. [CNN, 6/11/2002]

    June 10, 2002
    Attorney General John Ashcroft announces Padilla’s arrest (see June 9, 2002), claiming that “in apprehending [Padilla] as he sought entry into the United States,” the US government has “disrupted an unfolding terrorist plot to attack the United States by exploding a radioactive ‘dirty bomb.’” [CBS News, 6/10/2002] Similarly, President Bush says: “This guy, Padilla, is a bad guy. And he is where he needs to be—detained,” along with many other “would-be killers” as part of the war on terrorism. And Rumsfeld too, states that Padilla “was unquestionably involved in terrorist activities.” [CNN, 6/11/2002] Padilla becomes publicly known as the “dirty-bomber.”

    June 11, 2002
    In Doha, Qatar, Rumsfeld says the purpose of detaining Padilla is to obtain information from him. “Our interest, really, in this case, is not law enforcement,” he says. “It is not punishment. Because he was a terrorist or working with the terrorists, our interest at the moment is to try to find out everything he knows so hopefully we can stop other terrorist acts.” To illustrate his argument, Rumsfeld describes a recent situation in which intelligence gained from a prisoner in Kandahar led to the prevention of three terrorist attacks in Singapore. “If someone had said when we found that information or that person, ‘Well, now, let’s arrest the person and let’s start the process of punishing that person for having done what he did,’ we never would have gotten that information, and people would have died.” [American Forces Press Service, 6/11/2002]

    June 21, 2002: CIA Prepares Report on Iraq-Al Qaeda Links under Pressure from Administration
    The CIA issues a classified report titled, “Iraq and al-Qaeda: A Murky Relationship.” According to its cover note, the report “purposely aggressive in seeking to draw connections” between Iraq and Osama bin Laden’s organization. The document, which was prepared in response to pressure from the White House and vice president’s office, is heavily criticized by analysts within the agency. Analysts in the Near East and South Asia division complain that the report inflates “sporadic, wary contacts” between two independent actors into a so-called “relationship.” A complaint is filed with the CIA’s ombudsman for politicization. After interviewing 24 analysts, the ombudsman concludes that the report was crafted under pressure from the administration, later telling Senate investigators that “about a half-dozen [analysts] mentioned ‘pressure’ from the administration; several others did not use that word, but spoke in a context that implied it.” Despite being “purposely aggressive,” the report does not satisfy Undersecretary of Defense for Policy Douglas Feith, an adamant hawk who strongly believes Iraq is working closely with Islamic militant groups.     President George Bush issues an executive order transferring control of the covert operation Gray Fox (it now has a new codename) from the Army to Special Operations Command (SOCOM) in Tampa at the insistence of Rumsfeld’s office. [New Yorker, 1/24/2005 Sources: unnamed former high-level intelligence official interviewed by Seymour Hersh]

    July 22, 2002: New Rumsfeld Policy Prefers Interrogation or Killing of Terrorists Over Legally Arresting Them
    Defense Secretary Donald Rumsfeld issue a secret directive ordering commander of Special Operations Air Force General Charles Holland “to develop a plan to find and deal with members of terrorist organizations.” The directive says, “The objective is to capture terrorists for interrogation or, if necessary, to kill them, not simply to arrest them in a law-enforcement exercise.” The manhunt would be global in its reach. Holland is to cut through the Pentagon bureaucracy and process deployment orders “in minutes and hours, not days and weeks.” In internal Defense Department memos, Rumsfeld and the civilian officials close to him lay out the case for a new approach to the war on terrorism, one that would partly rely on the killing of individuals outside war zones. [New Yorker, 12/16/2002] The first public manifestation of this new policy will be the November 2002 assassination of al-Qaeda leader Qaed Salim Sinan al-Harethi in Yemen with a Predator missile strike (see November 3, 2002).

    August 20, 2002
    Secretary of State Donald Rumsfeld, citing various “intelligence reports,” claims that the Iraqi government is “hosting, supporting or sponsoring” an al-Qaeda presence in Iraq. When asked if he has evidence to support this claim Rumsfeld responds: “There are al-Qaeda in a number of locations in Iraq…. The suggestion that… [Iraqi government officials] who are so attentive in denying human rights to their population aren’t aware of where these folks [al-Qaeda] are or what they’re doing is ludicrous in a vicious, repressive dictatorship.” He also says, “It’s very hard to imagine that the government is not aware of what’s taking place in the country.” [US Department of Defense, 8/20/2002; New York Times, 8/20/2002] Shortly after the defense secretary’s allegations, an unnamed intelligence official tells the Guardian, “They are not the official guests of the government,” adding that any al-Qaeda in the region are still “on the run.” A month later, Knight Ridder reports that according to an anonymous US official, Rumsfeld’s charge is based on information from Kurdish opposition groups which are feeding information to the Pentagon.     Speaking to US Marines of the 1st Marine Division at Camp Pendleton in California, Secretary of Defense Donald Rumsfeld says: “Leadership in the right direction finds followers and supporters….     Secretary of Defense Donald Rumsfeld appears on CBS’ “Face the Nation” and talks about Iraq. He tells host Bob Schieffer, “[President Bush] has decided to go to the Congress and to the United Nations later this week and make the case of what Iraq has done for 11 years. It has invaded its neighbors; it’s violated almost every single UN resolution that relates to Iraq. And against the agreement they had to disarm, they proceeded to develop weapons of mass destruction—chemical, biological and nuclear.” When asked if the government has “smoking gun” evidence that Iraq is developing nuclear weapons, Rumsfeld responds: “The smoking gun is an interesting phrase. It implies that what we’re doing here is law enforcement, that what we’re looking for is a case that we can take into a court of law and prove beyond a reasonable doubt. The problem with that is, the way one gains absolutely certainty as to whether a dictator like Saddam Hussein has a nuclear weapon is if he uses it, and that’s a little late. It’s not late if you’re interested in protecting rights of the defendant in a court of law, but it’s a quite different thing if one thinks about it.” Schieffer then asks the defense secretary whether or not the administration has information that has not yet been shared with the public. Rumsfeld says: “The problem we have, of course, is a real one. Intelligence, we spend billions of dollars gathering intelligence. And to do it, you have to have methods of doing it and sources from whom you get this information. And to the extent you take that intelligence and spread it out in the public record, what you do is you put people’s lives at risk, the sources of that information, because people can connect the dots there and say, well, who knew that, and then they go out and they stop people from helping us learn that type of information, or if it’s a source, a satellite or some other thing. To the extent that we reveal the information and show our capability, we then lose that capability because they find ways to deceive and deny us from gaining access to it.     In an appearance on Good Morning America with Charlie Gibson, Rumsfeld dismisses the notion that the administration needs to disclose evidence about Iraq’s banned weapons to the public before going to war. Gibson asks: “One of the sentinel moments of my life was when John Kennedy went on television and showed satellite photos of Soviet missiles on Cuban soil. Isn’t it going to take and do you have that kind of direct evidence?”In response, Rumsfeld states: “You know, the idea of direct evidence is not like a court of law under Article 3 of our Constitution where your goal is to punish somebody for doing something wrong. That really isn’t the case here. This is self defense, and the United States task is to see that we don’t allow an event to happen that then one has to punish someone.” Gibson then follows with another question: “But you can’t go to war without American public support and I’m asking don’t you need that kind of direct evidence? Or do you have it, to get the American public support or to get a coalition?” Rumsfeld replies: “The evidence is certainly there. The President has to decide what precisely he believes is the best approach.     September 13, 2002: Rumsfeld Suggests Iraqis Will ‘Started Singing and Flying Kites’ When Hussein Is Removed
    During a media roundtable discussion with the BBC And Voice Of America, Secretary of Defense Donald Rumsfeld says: “Think of the faces in Afghanistan when the people were liberated, when they moved out in the streets and they started singing and flying kites and women went to school and people were able to function and other countries were able to start interacting with them. That’s what would happen in Iraq.” [US Department of Defense, 9/13/2002]

    September 18, 2002: Rumsfeld Testifies that Iraq Has WMDs
    Defense Secretary Donald Rumsfeld warns the House Armed Services Committee of the serious and imminent threat that Saddam Hussein poses to Western countries. He says: “No terrorist state poses a greater and more immediate threat to the security of our people and the stability of the world than the regime of Saddam Hussein.” He adds: “What has not changed is Iraq’s drive to acquire those weapons of mass destruction, and the fact that every approach that the United Nations has taken to stop Iraq’s drive has failed. This is a critical moment for our country and for the world. Our resolve is being put to the test. It is a test unfortunately the world’s free nations have failed before in recent history with unfortunate consequences.” [US Congress, 9/18/2002; Daily Telegraph, 9/19/2002; Agence France-Presse, 9/19/2002] Rumsfeld says of Iraq’s putative nuclear weapons program, “Some have argued that the nuclear threat from Iraq is not imminent—that Saddam [Hussein] is at least 5-7 years away from having nuclear weapons. I would not be so certain…. He has, at this moment, stockpiles of chemical and biological weapons, and is pursuing nuclear weapons.” [Salon, 3/6/2004] The Secretary of Defense also says that Congress must authorize the president to use military force against Iraq before the Security Council votes on the issue. “Delaying a vote in the Congress would send a message that the US may be unprepared to take a stand, just as we are asking the international community to take a stand and as we are cautioning the Iraqi regime to consider its options,” argues Rumsfeld, adding, “Our job today—the president’s, the Congress’ and the United Nations’—is to… anticipate vastly more lethal attacks before they happen and to make the right decision as to whether or not it’s appropriate for this country to take action…. The goal is not inspections, the goal is disarmament.” [US Congress, 9/18/2002; Associated Press, 9/19/2002] He also tries to discredit Iraq’s September 16, 2002 (see September 16, 2002), offer to admit UN inspectors without conditions. He says: “There’s no doubt in my mind but that the inspection program that currently is on the books wouldn’t work because it’s so much weaker than the earlier one. The more inspectors that are in there, the less likely something is going to happen. The longer nothing happens, the more advanced their weapons programs go along.” [US Congress, 9/18/2002] Rumsfeld is drastically revising his own stance from over a year before, when he told an interviewer on February 12, 2001, that Iraq was “probably not a nuclear threat” (see February 12, 2001).

    September 19, 2002
    Secretary of Defense Donald Rumsfeld is subjected to intense questioning by Senator Robert Byrd about the United States’ role in providing Iraq with the materials for its chemical and biological weapons and Rumsfeld’s December 20, 1983 visit to Baghdad (see December 20, 1983). And I did meet with Saddam Hussein and spent some time visiting with them about the war they were engaged in with Iran. At the time our concern, of course, was Syria and Syria’s role in Lebanon and Lebanon’s role in the Middle East and the terrorist acts that were taking place.     September 21, 2002: Feith Pushes Iraq-Al-Qaeda Collaboration Theory at White House Meeting
    Deputy National Security Advisor Stephen J. Hadley convenes a meeting in the White House Situation Room to discuss Iraq with Colin Powell, George Tenet, and Donald Rumsfeld. The White House wants to be sure they are all on the same page when they testify before Congress next week. When a CIA officer notes that the alleged ties between Iraq and al-Qaeda are not supported by current intelligence, Douglas Feith cuts in insisting that Mohamed Atta had met an Iraqi agent in Prague, and that the director of Iraqi intelligence had met with Osama bin Laden in 1996. Both theories have been dismissed by the intelligence community. After a few minutes, Hadley cuts him off and tells him to sit down. [Isikoff and Corn, 2006, pp. 113-114]

    September 26, 2002: Rumsfeld Incorrectly Connects Al-Zarqawi to Iraqi Government
    Rumsfeld claims the US government has “bulletproof” confirmation of ties between the Iraqi government and al-Qaeda members, including “solid evidence” that al-Qaeda maintains a presence in Iraq. The allegation refers to Abu Musab al-Zarqawi, a Jordanian-born Palestinian who is the founder of al-Tawhid, an organization whose aim is to kill Jews and install an Islamic regime in Jordan (see Late 2001-May 2002). No solid evidence ever surfaces to suggest that the group works with al-Qaeda. Rumsfeld’s statement is based on intercepted telephone calls in which al-Zarqawi was overheard calling friends or relatives. But Knight Ridder Newspapers reports that according to US intelligence officials, “The intercepts provide no evidence that the suspected terrorist was working with the Iraqi regime or that he was working on a terrorist operation while he was in Iraq.” [Knight Ridder, 10/7/2002 Sources: Unnamed US Intelligence Officials]

    October 1, 2002: US Intelligence Completes National Intelligence Estimate on Iraq
    The National Intelligence Council, a board of senior analysts that prepares reports on crucial national security issues, completes a National Intelligence Estimate (NIE) on Iraq. The purpose of an NIE is to provide policy-makers with an intelligence assessment that includes all available information on a specific issue so they can make sound policy decisions. The formal document is supposed to be the result of a collaborative effort of the entire intelligence community and is supposed to be untainted by political interests. The decision to produce the assessment on Iraq followed criticisms that the administration had already made a decision to invade Iraq without having thoroughly reviewed all available intelligence on Iraq. Congress wanted the NIE completed prior to voting on a bill authorizing the president to use force against Iraq (see September 5, 2002). NIEs such as this usually take months to prepare, however this document took a mere three weeks. The person in charge of preparing the document was weapons expert Robert Walpole. According to the Independent of London, Walpole has a track record of tailoring his work to support the biases of his superiors. “In 1998, he had come up with an estimate of the missile capabilities of various rogue states that managed to sound considerably more alarming than a previous CIA estimate issued three years earlier,” the newspaper later reports. “On that occasion, he was acting at the behest of a congressional commission anxious to make the case for a missile defense system; the commission chairman was none other than Donald Rumsfeld….” [Independent, 11/3/2003; New York Times, 10/3/2004]

    Summary of NIE Conclusions - The NIE says there are potentially links between Iraq and al-Qaeda, but uses cautionary language and acknowledges that its sources—Iraqi defectors and captured al-Qaeda members—have provided conflicting reports. The sections dealing with weapons of mass destruction are also filled with caveats and nuanced statements. In the second paragraph of its “key judgment” section, the NIE states that US intelligence lacks “specific information” on Iraq’s alleged arsenal of weapons of mass destruction. And while the NIE says that Iraq probably has chemical and biological weapons, it also says that US intelligence analysts believe that Saddam Hussein would only launch an attack against the US if he felt a US invasion were inevitable.     Reconstituted nuclear weapons programs - According to the NIE, “most” of the US’ six intelligence agencies believe there is “compelling evidence that Saddam [Hussein] is reconstituting a uranium enrichment effort for Baghdad’s nuclear weapons program.” The one agency that disagrees with this conclusion is the State Department’s Bureau of Intelligence and Research (INR), which says in its dissenting opinion: “The activities we have detected do not, however, add up to a compelling case that Iraq is currently pursuing what INR would consider to be an integrated and comprehensive approach to acquire nuclear weapons. Iraq may be doing so, but INR considers the available evidence inadequate to support such a judgment. Lacking persuasive evidence that Baghdad has launched a coherent effort to reconstitute its nuclear weapons programs, INR is unwilling to… project a timeline for the completion of activities it does not now see happening.” It is later learned that nuclear scientists in the Department of Energy’s in-house intelligence office were also opposed to the NIE’s conclusion and wanted to endorse the State’s alternative view. However, the person representing the DOE, Thomas Ryder, silenced them and inexplicably voted to support the position that Iraq had reconstituted its nuclear weapons program (see Late September 2002). The DOE’s vote was seen as critical, since the department’s assessment was supposed to represent the views of the government’s nuclear experts.     Iraqi attempts to obtain uranium from Africa - According to the NIE, Iraq is “vigorously trying” to obtain uranium and “reportedly” is working on a deal to purchase “up to 500 tons” of uranium from Niger. It reads: “A foreign government service reported that as of early 2001, Niger planned to send several tons of ‘pure uranium’ (probably yellowcake) to Iraq. As of early 2001, Niger and Iraq reportedly were still working out arrangements for this deal, which could be for up to 500 tons of yellowcake. We do not know the status of this arrangement. Reports indicate Iraq also has sought uranium ore from Somalia and possibly the Democratic Republic of the Congo.” But the alternative view—endorsed by the State Department’s Bureau of Intelligence and Research (INR)—says that it is doubtful Iraq is trying to procure uranium from Africa. “(T)he claims of Iraqi pursuit of natural uranium in Africa are, in INR’s assessment, highly dubious,” it reads.     Iraqi attempts to obtain aluminum tubes - The NIE says that most “agencies believe that Saddam’s personal interest in and Iraq’s aggressive attempts to obtain high-strength aluminum tubes for centrifuge rotors—as well as Iraq’s attempts to acquire magnets, high-speed balancing machines, and machine tools—provide compelling evidence that Saddam is reconstituting a uranium enrichment effort for Baghdad’s nuclear weapons program.” To support its analysis of the tubes, it includes a chart which compares the dimensions of the aluminum tubes sought by Iraq with those that would be needed for a “Zippe-type” centrifuge. The chart’s comparison of the tubes makes it appear that the tubes are similar. But the NIE neglects to say that the aluminum tubes are an exact match with those used in Iraq’s 81-millimeter rocket. The estimate also claims that the tubes are not suitable for rockets. The assertion ignores the fact that similar tubes are used in rockets from several countries, including the United States. [US Congress, 7/7/2004, pp. 84; New York Times, 10/3/2004] It does note however that the 900 mm tubes ordered by Iraq would have to have been cut in half to make two 400 mm rotors, and that the tubes would have needed other modifications as well in order to be used in centrifuge rotors. [The Commission on the Intelligence Capabilities of the United States Regarding Weapons of Mass Destruction (aka 'Robb-Silberman Commission'), 3/31/2005] The NIE’s conclusion about the tubes is challenged by two US intelligence agencies, the DOE’s in house intelligence agency, and the State Department’s Bureau of Intelligence and Research. In its dissenting opinion, the DOE says, “It is well established in open sources that bare aluminum is resistant to UF6 and anodization is unnecessary for corrosion resistance, either for the aluminum rotors or for the thousands of feet of aluminum piping in a centrifuge facility. Instead, anodization would likely introduce uncertainties into the design that would need to be resolved before a centrifuge could be operated.” The DOE’s dissenting opinion—written mainly by nuclear physicist William Domke at the Energy Department’s Lawrence Livermore National Laboratory and nuclear physicist Jeffrey Bedell at the Los Alamos National Laboratory—also notes that anodization is a standard practice in missile construction for environmental protection. The Energy Department’s centrifuge physicists suggested more than a year before that the tubes were meant to serve as casings for conventional rockets (see May 9, 2001), but CIA analysts held fast to their theory. [Washington Post, 7/19/2003; USA Today, 7/31/2003; Washington Post, 10/26/2003; US Congress, 7/7/2004, pp. 59] Years later a DOE intelligence analyst will tell two journalists, “[The DOE’s nuclear scientists] are the most boring people. Their whole lives revolve around nuclear technology. They can talk about gas centrifuges until you want to jump out of a window. And maybe once every ten years or longer there comes along an important question about gas centrifuges. That’s when you should really listen to these guys. If they say an aluminum tube is not for a gas centrifuge, it’s like a fish talking about water.” [Isikoff and Corn, 2006, pp. 40] The State Department’s Bureau of Intelligence and Research, similarly writes in its dissenting footnote: “In INR’s view Iraq’s efforts to acquire aluminum tubes is central to the argument that Baghdad is reconstituting its nuclear weapons program, but INR is not persuaded that the tubes in question are intended for use as centrifuge rotors. INR accepts the judgment of technical experts at the US Department of Energy (DOE) who have concluded that the tubes Iraq seeks to acquire are poorly suited for use in gas centrifuges to be used for uranium enrichment and finds unpersuasive the arguments advanced by others to make the case that they are intended for that purpose. INR considers it far more likely that the tubes are intended for another purpose, most likely the production of artillery rockets. The very large quantities being sought, the way the tubes were tested by the Iraqis, and the atypical lack of attention to operational security in the procurement efforts are among the factors, in addition to the DOE assessment, that lead INR to conclude that the tubes are not intended for use in Iraq’s nuclear weapon program.” [Washington Post, 7/19/2003; USA Today, 7/31/2003]

    Chemical and Biological Weapons - On the question of chemical and biological weapons, the NIE says: “We judge Iraq has some lethal and incapacitating BW agents and is capable of quickly producing and weaponizing a variety of such agents, including anthrax, for delivery by bombs, missiles, aerial sprayers, and covert operatives.” But the document also highlights the belief that it is unlikely that Iraq has any intention to use these against the US. “… Baghdad for now appears to be drawing a line short of conducting terrorist attacks with conventional or CBW [Chemical/Biological Weapons] against the United States, fearing that exposure of Iraqi involvement would provide Washington with a stronger case for making war.” Iraq would probably only use such weapons against the United States if it “feared an attack that threatened the survival of the regime were imminent or unavoidable, or possibly for revenge.” [Central Intelligence Agency, 10/1/2002]

    Unmanned Aerial Vehicles - Citing defectors and exiles, the NIE states that Iraq possesses unmanned aerial vehicles (UAVs) which can be used to deploy biological and chemical weapons. But the document includes a dissenting opinion by the Air Force’s National Air and Space Intelligence Center. The center, which controls most of the US military’s UAV fleet, says there is little evidence that Iraq’s drones are related to the country’s suspected biological weapons program. Current intelligence suggests that the drones are not capable of carrying much more than a camera and a video recorder. The Air Force believes that Iraq’s unmanned aerial vehicles (UAVs) are for reconnaissance, like its counterparts in the US. The dissenting opinion reads: “… The Director, Intelligence, Surveillance and Reconnaissance, US Air Force, does not agree that Iraq is developing UAVs primarily intended to be delivery platforms for chemical and biological warfare (CBW) agents. The small size of Iraq’s new UAV strongly suggests a primary role of reconnaissance, although CBW delivery is an inherent capability.” [Associated Press, 8/24/2003; Washington Post, 9/26/2003; Knight Ridder, 2/10/2004 Sources: US Government officials and scientists] Bob Boyd, director of the Air Force Intelligence Analysis Agency, will tell reporters in August 2003 that his department thought the allegation in the NIE “was a little odd,” noting that Air Force assessments “all along” had said that reconnaissance, not weapons delivery, was the purpose of Iraq’s drones. “Everything we discovered strengthened our conviction that the UAVs were to be used for reconnaissance,” he will explain. “What we were thinking was: Why would you purposefully design a vehicle to be an inefficient delivery means? Wouldn’t it make more sense that they were purposefully designing it to be a decent reconnaissance UAV?” [Associated Press, 8/24/2003; Washington Post, 9/26/2003 Sources: Bob Boyd] The NIE also says that Iraq is attempting to obtain commercially available route-planning software that contains topographic data of the United States. According to the NIE, this data could facilitate targeting of US sites. But Air Force analysts were not convinced by the argument, noting that this sort of information could easily be retrieved from the Internet and other highly accessible sources. “We saw nothing sinister about the inclusion of the US maps in route-planning software,” Boyd will tell reporters.     Aftermath - After the completion of the National Intelligence Estimate, the Bush administration will continue to make allegations concerning Iraq’s weapons capabilities and ties to militant Islamic groups, but will include none of the qualifications and nuances that are present in the classified NIE. After excerpts from the classified version of the NIE are published in the press in July of 2003 (see July 11, 2003), administration officials will claim that neither Bush, Rice, nor other top officials were informed about the alternative views expressed by the DOE, INR, and the Air Force intelligence agency. They will also assert that the dissenting views did not significantly undermine the overall conclusion of the NIE that Iraq was continuing its banned weapons program despite UN resolutions. [Washington Post, 7/19/2003; New York Times, 7/19/2003; Washington Post, 7/27/2003] But this claim is later disputed in an article by the Washington Post, which reports: “One person who has worked with Rice describes as ‘inconceivable’ the claims that she was not more actively involved. Indeed, subsequent to the July 18 briefing, another senior administration official said Rice had been briefed immediately on the NIE—including the doubts about Iraq’s nuclear program—and had ‘skimmed’ the document. The official said that within a couple of weeks, Rice ‘read it all.’” [Washington Post, 7/27/2003 Sources: two unnamed administration officials] The official’s account, will in fact be confirmed by Rice herself, who reportedly tells Gwen Ifill at the National Association of Black Journalists Convention in Dallas on August 7, 2003: “I did read everything that the CIA produced for the president on weapons of mass destruction. I read the National Intelligence Estimate cover to cover a couple of times. I read the reports; I was briefed on the reports. This is—after 20 years, as somebody who has read a lot of intelligence reports—this is one of the strongest cases about weapons of mass destruction that I had ever read.” [Daily Howler, 8/11/2003] George Bush is also provided with a summary of the NIE’s dissenting views. According to the Robb-Silberman report, released in early 2005, the president’s summary of the NIE notes that “INR and DOE believe that the tubes more likely are intended for conventional weapon uses.” [The Commission on the Intelligence Capabilities of the United States Regarding Weapons of Mass Destruction (aka 'Robb-Silberman Commission'), 3/31/2005] Additionally, senior CIA analyst Stuart Cohen, the acting chairman of the National Intelligence Council at this time, who helped write the document, will tell the Agence France-Presse, “Any reader would have had to read only as far as the second paragraph of the Key Judgments to know that as we said, ‘we lacked specific information on many key aspects of Iraq’s WMD program.’” The Key Judgments section is also where INR’s detailed dissent on the aluminum tubes allegation was located. [Agence France-Presse, 11/30/2003 Sources: Michael Hayden] A Senate Intelligence Committee investigation will determine in July 2004 that “most of the major key judgments in the Intelligence Community’s October 2002 National Intelligence Estimate (NIE), Iraq’s Continuing Programs for Weapons of Mass Destruction, either overstated, or were not supported by, the underlying intelligence reporting.” [US Congress, 7/7/2004, pp. 59] And in 2006, one of the report’s authors, CIA senior analyst Paul Pillar, will admit the NIE had been written with the intent of “strengthen[ing] the case of going to war with the American public.” [PBS Frontline, 6/20/2006]

    Gen. Rick Baccus is relieved of his duties at Guantanamo and also as an officer in the Rhode Island National Guard. With regard to the latter position, his commanding officer in the Rhode Island National Guard, Maj. Gen. Reginald Centracchio, says he has fired him for reasons that “culminated in my losing trust and confidence in him.” One of those reasons, a National Guard spokesman says, is failing to keep headquarters up to date with reports on the well-being of troops. Baccus denies the allegation and expresses surprise. “I’m a little amazed that after being deployed for seven months, separated from my wife, family, and my job and being called to active duty, this is the kind of reception I’m getting.” [Guardian, 10/16/2002] In response to the allegation that his treatment of prisoners made it more difficult for the interrogators, Baccus states that “in no instance did I interfere with interrogations.” [Guardian, 10/16/2002] Paradoxically, this is exactly what the Pentagon is planning to change. Baccus’s sacking coincides with the merger of his Joint Task Force (JTF) 160 with military intelligence unit JTF-170 into a new JTF-GTMO. By doing this Rumsfeld will give military intelligence control of all aspects of the camp, including the MPs. [Newsweek, 5/24/2004] Military police, now called the Joint Detention Operations Group (JDOG), and the Joint Intelligence Group report directly to the commander of JTF-GTMO. The MPs are fully incorporated into a joint effort of extracting information from prisoners. Vice Admiral Albert T. Church III, naval inspector general, will later describe the arrangement during a press briefing in May 2004: “They monitor the detainees, they monitor their behavior, they monitor who the leaders are, who the followers are, they monitor what is said and they ask for an interpreter if there’s a lot of conversation going on. They’ll know eating habits, and they’ll record this in a management information system, which could be useful to the intelligence group, during the interrogations.” [US Department of Defense, 5/12/2004]

    November 3, 2002: CIA Assassinates Al-Qaeda Suspects with Remote Drone One Day Before US Elections
    A CIA-operated Predator drone fires a missile that destroys a truck of suspected al-Qaeda operatives in Yemen. The target of the attack is Qaed Salim Sinan al-Harethi, a top al-Qaeda operative, but five others are also killed, including American citizen Kamal Derwish. [Washington Post, 11/4/2002; Associated Press, 12/3/2002] Al-Harethi is said to have been involved in the 2000 bombing of the USS Cole. Bush administration officials say Derwish was the ringleader of a sleeper cell in Lackawanna, New York, and connected to the so-called “Buffalo Six.” [Washington Post, 11/9/2002; Newsweek, 11/11/2002] A former high-level intelligence officer complains that Defense Secretary Donald Rumsfeld wants “to take guys out for political effect.” Al-Harethi was being tracked for weeks through his cell phone. [New Yorker, 12/16/2002] The attack happens one day before mid-term elections in the US. Newsweek will note that timing of the strike “was, at the very least, fortuitous” for the Bush administration. [Newsweek, 11/11/2002] New Yorker magazine will later report, “The Yemeni government had planned to delay an announcement of the attack until it could issue a joint statement with Washington. When American officials released the story unilaterally, in time for Election Day, the Yemenis were angry and dismayed.” [New Yorker, 12/16/2002] Initial reports suggest the truck was destroyed by a car bomb. But on November 5, Deputy Defense Secretary Paul Wolfowitz will brag about the strike on CNN, thus ruining the cover story and revealing that the truck was destroyed by a US missile (see November 5, 2002).     November 5- December, 2002: Remote Strike in Yemen Raises Legal and Ethical Issues
    The revelation that the US killed Qaed Salim Sinan al-Harethi in Yemen with a Predator missile strike (see November 3, 2002 and November 5, 2002) sparks a debate about the morality and legality of remote attacks outside of war zones. The Bush administration had previously criticized Israel’s policy of “targeted killings” of Palestinian militants. Newsweek comments, “A State Department spokesman bobbed and weaved and tried to draw distinctions. But, privately, administration officials say the difference is really one of scale and frequency.” [Newsweek, 11/11/2002] Many international lawyers and some foreign governments question the legality of the assassination. [Guardian, 11/6/2002] For decades, the US government has been prohibited from conducting assassinations. The Bush administration says it still adheres to that policy but makes an exception for “enemy combatants” such as al-Qaeda leaders. In December 2002, it will be revealed that President Bush approved a secret “high-value target list” of about two dozen terrorist leaders, giving the CIA basic executive and legal authority to either kill or capture those in the list. The CIA is also empowered to capture or kill terrorists not mentioned in the list (see Autumn 2001). [New York Times, 12/15/2002] Additional controversy is generated when it is discovered that US citizen Kamal Derwish was one of those killed in the strike. Derwish is alleged to have been connected to an al-Qaeda cell in Buffalo, New York. US officials say the CIA has the legal authority to target and kill US citizens it believes are working for al-Qaeda (see July 22, 2002). [Associated Press, 12/3/2002] The New Yorker reveals that there were two planned Predator strikes in Yemen called off at the last minute that turned out to be aimed at innocent people instead of al-Harethi. One recently retired Special Forces operative who served on high-level planning staffs at the Pentagon warns that the civilians running the military are no longer trying to “avoid the gray area.” Defense Secretary Donald Rumsfeld is reportedly behind the effort to use the CIA and special forces for more remote killings (see July 22, 2002). One former high-level intelligence officer complains, “They want to turn these guys into assassins. They want to go on rumors—not facts—and go for political effect, and that’s what the Special Forces Command is really afraid of.” [New Yorker, 12/16/2002] Noting that in its battle against al-Qaeda, the US has effectively deemed the entire planet a combat zone, Scott Silliman, director of Duke University’s Center on Law, Ethics and National Security says, “Could you put a Hellfire missile into a car in Washington, DC?…The answer is yes, you could.” But National Security Adviser Condoleezza Rice says, “No constitutional questions are raised here.” [Chicago Tribune, 11/24/2002; Associated Press, 12/3/2002]

    US and British warplanes attack sites northeast of Mosul after Iraqi defense forces fire anti-aircraft artillery at coalition aircraft patrolling the so-called “no-fly” zones. In a separate incident, warplanes attack two Iraqi air defense communications facilities and one air defense radar site in southern Iraq in Wassit and Dhi Oar after “Iraqi air defenses fired multiple surface-to-air missiles and anti-aircraft artillery at coalition aircraft.” [New York Times, 11/19/2002; Scotsman, 11/19/2002; Reuters, 11/19/2002; Associated Press, 11/20/2002] According to Iraqi authorities, four Iraqi civilians were wounded as a result of the attacks in southern Iraq. [Associated Press, 11/20/2002] White House spokesperson Scott McClellan says in a press briefing, “The United States believes that firing upon our aircraft in the no-fly zone, or British aircraft, is a violation—it is a material breach.” [White House, 11/18/2002; New York Times, 11/19/2002] And Donald Rumsfeld, who is in Chile, says: “I do find it unacceptable that Iraq fires. It is for the president of the United States and the UN Security Council to make judgments about their view of Iraq’s behavior over a period of time.” [Daily Telegraph, 11/19/2002; New York Times, 11/19/2002; CNN, 11/23/2002] This is the second time the US has bombed Iraq since the passing of UN resolution 1441. The US will conduct at least 22 more aerial attacks on Iraq before the March 19, 2003 invasion. [Colorado Campaign for Middle East Peace, 1/11/2006] UN officials disagree with Washington’s assessment. Secretary-General Kofi Annan states, “Let me say that I don’t think that the council will say this is in contravention of the resolution of the Security Council.” [Reuters, 11/19/2002] Responding to Annan’s remarks, Rumsfeld argues, “I don’t know that he (Annan) necessarily reflects the UN, the center of gravity of the Security Council, on any particular issue at any particular time…. Whenever resolutions are passed, they tend to be compromises, and there tend to be calculated ambiguities written into them to gain votes. So it does not come as a surprise to me…. The United Nations sat there for years with 16 resolutions being violated. So, just as we’ve seen a pattern of behavior on the part of Saddam Hussein, we’ve seen a pattern of behavior on the part of the United Nations.” [US Department of Defense, 11/19/2002; CNN, 11/19/2002] No comments supporting the US position are made by the British.
